1 Exaro is an SFPUC LBE and is ineligible for LBE participation credit for this project as only SF LBE Small and/or Micro certified firms are eligible for LBE participation credit.

As of June 28, 2023, KJ-AGS JV has invoiced $1,676,457. The Micro/Small-LBE participation achieved by KJ-AGS JV is as follows:

Per the Prime, and as confirmed by the SFPUC, ATS, Cadnet, CHS Consulting Group, and SCA have been underutilized to date as “there have been limited requests by SFPUC for” Environmental Advisory/Habitat Environmental Work, Computer Aided Drafting/BIM work, Traffic Engineering work, and Hazardous Materials/Special Inspections work. However, the Prime has confirmed that it is committed in utilizing ATS, Cadnet, CHS Consulting Group, and SCA for its respective listed scopes of work in the next stage of this project. Additionally, as it pertains to OLMM, “there have not been requests by SFPUC for new Structural Engineering work. The only Structural Engineering work has been for continuing services during construction from a design project started under the expired PRO.0076.A As-Needed Contract.”

The Prime is required to make good faith efforts to utilize LBEs for any scope of work, or portions thereof, which can reasonably be subcontracted out throughout the life of the contract.

In light of this requirement, the Prime has performed good faith outreach to LBE firms. As part of its good faith efforts, the Prime added Structus Inc to this contract.

1 Exaro is an SFPUC LBE and is ineligible for LBE participation credit for this project as only SF Small and/or Micro LBEs are eligible for LBE participation credit.
2 Small and/or Micro SF LBE firms are eligible to receive LBE credit for the scopes of work they are certified to perform. NBA Engineering Inc., at the time of proposal, was listed to perform Civil Engineering and Electrical Engineering, of which, the firm is not certified to perform. The firm is an SF Small LBE with respect to Mechanical Engineering and is eligible for LBE credit for work they perform under this certification. However, since there was no specification in the proposal regarding the allocation of work per scope CMD is unable to provide LBE credit at this time.

As of July 3, 2023, Hazen-Lee invoiced $459,429. The Micro/Small-LBE participation achieved by Hazen-Lee is as follows:

3 Pursuant to communications with Hazen-Lee, and as confirmed by the SFPUC, the scopes of work that Applied Technology & Science (“A-T-S”), Cadnet, Meridian Surveying Engineering Inc, NBA Engineering, Ryan Joyce Structural Design, SCA Environmental Inc, Stephen & Associates, and Terra Engineers Inc are listed to perform, have not arisen. However, “Cadnet will be working on Task Order 1 starting in August.”

Additionally, Exaro Technologies Corp is providing potholing services for four task orders and has not invoiced anything yet because most of their work has not started. Similarly, Hydroconsult Engineers Inc is providing modeling services for one task order and has not invoiced anything to date because their work on Task Order 10 started in July 2023.

Hazen-Avila has confirmed that it “is focused on providing work to as many of our LBE team members as possible while providing SFPUC with the skill sets they require for their task orders.” Hazen-Lee is required to make good faith efforts to utilize LBEs for any scope of work, or portions thereof, which can reasonably be subcontracted out throughout the life of the contract. Based on the foregoing Hazen-Lee confirmed that it will remain committed to assigning work that may arise from future task orders to its original listed LBE subconsultants. Hazen-Lee informed the CMD that it anticipates meeting its 18.50% Micro/Small-LBE commitment, as follows:

5 Going forward, SFPUC staff and Hazen-Lee will obtain CMD approval for each subconsultant addition and LBE substitution according to established procedures. Additionally, in order to ensure compliance with the LBE ordinance and requirements, the SFPUC and Hazen-Lee must notify CMD of any changes to the scope of work as well as any changes to information provided to CMD. Contingent on the conditions set forth above, CMD approves the subject modification.
