MEMORANDUM
Date: October 13, 2023
To: Brian Barry, SFPUC
From: Jovi Cuntapay-Vitin, CMD
Subject: Closeout for WD -2616: 8-Inch Ductile Iron Water Main Replacement on Baker Street from Geary Boulevard to Broadway Street and on Sutter Street from Divisadero Street to Presidio Avenue
The Contract Monitoring Division ( “CMD”) has determined that M Squared Construction Inc. (“MSCI”) the LBE prime contractor, has made a good faith effort to substantially comply with the LBE subcontracting requirements associated with this project.
At the time the project was advertised, a LBE subcontracting participation requirement of 20% was established. MSCI’s Section 00 43 36 reflected a LBE subcontracting participation commitment of 20.26%. MSCI was awarded the contract in the amount of $3,701,180.00. After eight (8) change orders, the final contract amount is $3,881,257.72. MSCI ’s LBE subcontracting participation is as follows:

*Reliance Engineering Inc. (“Reliance”) was added to the contract . At project closeout, Reliance was paid a total subcontract amount of $112,850. CMD applied LBE credit for Reliance’s participation as an LBE subcontractor.
Pursuant to communications with SFPUC and as confirmed by MSCI, Ronan fell short of its participation because the actual sawcutting work performed was less than the anticipated sawcutting work at the time of bid.
Overall, MSCI met its commitment. Based on the foregoi ng, CMD concurs with the closeout of this contract. If you have any questions, please contact me at [email protected].
