RE: 2023 Water Supply Development Report

I. B

ACKGROUND
Section 4.05 of the Water Supply Agreement between the City and County of San Francisco and the Wholesale Customers requires the SFPUC to prepare an annual Water Supply Development Report detailing progress made toward (1) meeting the Interim Supply Limitation by June 30, 2018 and (2) developing additional water supplies that will allow the Commission to designate San Jose and Santa Clara as permanent Wholesale Customers of the Regional Water System with a combined Individual Supply Guarantee of up to 9 MGD by the end of the Term on June 30, 2034.

Per Section 4.05.C, if the Commission finds that the projections in the Water Supply Development Report show that the Wholesale Customers will exceed the 184 mgd Interim Supply Limitation, the Commission may issue a conditional 10-year notice of interruption or reduction in supply of water to San Jose and Santa Clara.

“Interim Supply Limitation” refers to the 265 mgd annual average limitation on water deliveries from Regional Water System watersheds imposed by the SFPUC in its approval of the WSIP in Resolution Number 08-0200 dated October 30, 2008. Of the 265 mgd, 184 was allocated collectively to the Wholesale Customers (including San Jose and Santa Clara), and 81 was allocated to Retail customers. Unlike the other Wholesale Customers of the SFPUC, the cities of San Jose and Santa Clara are Interruptible Customers, which means the SFPUC could stop serving them in the case of drought or insufficient supplies. San Jose and Santa Clara were included in the total Interim Supply Limitation, but they do not have Individual Supply Guarantees.

In the Water Supply Development Reports presented to the Commission between 2010 and 2022, staff has not recommended that the Commission issue a notice of interruption or reduction to San Jose and Santa Clara. Staff continues to recommend that the Commission not issue such a notice at this time.

II. PROGRESS MADE
Staff continue to pursue water supply planning efforts to meet the Interim Supply Limitation and to provide adequate supply to designate San Jose and Santa Clara permanent customers. As of 2020, these efforts are now captured in the Alternative Water Supply Planning initiative. Progress on Alternative Water Supply efforts was most recently reported to the Commission in June 2023 and will be provided to the Commission annually hereafter.
