Amend Contract No. PRO.0164, Engineering Services for the Lower Alemany Area Stormwater Improvement Project

Summary of
Proposed
Commission Action:

Amend Contract No. PRO.0164, Engineering Services for the Lower Alemany Area Stormwater Improvement Project with McMillen Jacobs Associates (dba Delve Underground ) for additional field investigation and engineering services necessary to improve collection system capacity during wet weather months, increasing the Contract amount by $2,000,000, for a new total Contract not -to-exceed amount of $9,500,000, with no change to the Contract duration.

Background: The San Francisco Pub lic Utilities Commission (SFPUC) Lower Alemany Area Stormwater Improvement Project (Project) will improve collection system capacity during wet weather months within the area between Ellsworth Street and Barneveld Avenue in the Lower Alemany area of San Francisco. It will involve constructing a new 120-inch diameter sewer of more than 6,300 linear feet along an alignment south of I-280 and the installation of about 1,000 linear feet of n ew 13-feet by 7- feet box sewer. The Project requires special expertise in tunnel engineering and seismic analysis.

On July 27, 2021, by Resolution No. 21- 0116, this Commission awarded Contract No. PRO.0164, Engineering Service for the Lower Alemany Area Stormwater Improvement Project, to McMillian Jacobs Associates (dba Delve Underground), to provide specialized tunnel engineering, d esign of large underground sewer infrastructure and seismic analysis services for the proposed Project, with a not -to-exceed contract amount of $7,500,000 and a duration of six years.

During the Project’s design development phase, the Project team learned of additional challenges, restrictions and requirements that require additional field investigation and engineering services, which include:

• Need for tunnel re-alignment and extension to avoid freeway off ramp closure discovered by Caltrans’ review;
• Large box sewer infrastructure re- alignment and relocation to reduce utility conflicts and reduce community impacts;

• Modifications to the upstream diversion and downstream connection structures due to the tunnel shaft relocation and large box sewer relocation;
• Addressing u nforeseen defects to existing transport box sewer to accommodate the new downstream connection; and
• Tunnel air ventilation design.

These design modifications necessitated addit ional geotechnical and hazardous material field invest igations, testing and analyses, Soil -Structure Interaction analyses, Computational Fluid Dynamics , advanced hydraulic modeling, air flow analyses, and additional related items of work.

In November 2021, this Project became subject to Clean -Up and Abatement Order R2-2021-0021 issued by the Regional Water Quality Control Board.

The Order requires the Project to deliver final design documents by December 31, 2027. The services listed above are required to comply with the Order and proceed with the Project.

Scope of Contract: The Contract scope includes profess ional services for specialized tunnel engineering and design of large underground sewage infrastructures located in the City and County of San Francisco in the Alemany Boulevard, Bayshore Boulevard, and Industrial Street areas. SFPUC’s contractor must perform the additional work described in the background section for the reasons stated.

The Contract work in this Amendment consists of additional design/engineering services for:
• Developing design documents (drawings and specifications), geotechnical related assessment, structural calculations, soil - structure interaction analyses, advanced CFD/3D hydraulic modeling and analyses, design reports, construction cost estimating and construction schedule; and
• Geotechnical and hazardous material field investigation.

Amendments to the
Contract:

Recommended Amendment No. 1: Staff seeks Commission a ction to increase the Contract by $ 2,000,000 to address additional and unforeseen engineering and field services required for the Project by increasing the total not-to-exceed contract amount of the Contract to $9,500,000, with no change to the Contract duration. Additional design efforts will address traffic impact limitations identified by local and state agencies, unforeseen defects in existing box sewer, changes to the upstream connections.

The SFPUC will not authorize the contractor to commence any geotechnical or hazardous material field investigation work under this contract until the proposed work is reviewed and any appropriate environmental review under the CEQA, if required, has been completed.

Authorization to execute this professional services agreement is not an approval of the proposed Lower Alemany Area Stormwater Improvement Project and SFPUC retains discretion to, among other things, modify the proposed project to mitigate significant environment al impacts, require the implementation of specific measures to mitigate any significant environmental impacts of the projects, or reject the project, following completion of environmental review.

Johanna Wong, SFPUC

From: Michelle Kassatly, CMD

Subject: Modification No. 1 for PRO.0164 Engineering Services for Lower Alemany Area Stormwater Improvements Project (PeopleSoft Contract ID: 1000028719)

SFPUC has requested to modify the above referenced contract by $2,000,000 for a total agreement amount of $9,500,000. Pursuant to communications with the SFPUC, the scope of work for Modification No.1 consists of developing design documents (drawings and specifications), geotechnical related assessment, structural calculations, soil-structure interaction analyses, advanced CFD/3D hydraulic modeling and analyses, design reports, construction cost estimating and construction schedule, and Geotechnical and hazardous material field investigation.

The Micro/Small-LBE subcontracting participation requirement established for this contract is 10%. The LBE subcontracting participation requirement applies to the entire contract including any modifications, change orders and amendments.

The Micro/Small-LBE participation reflected on the Prime Contractor’s, Delve Underground’s (“Delve’s”)
1, Section 00 43 36 at the time of bid is as follows:

Pursuant to communications and documents provided by Delve and the SFPUC, The Thier Group has not yet been utilized because “The Thier Group will support with Public Outreach.

Public Outreach is typically perform[ed] during late design or prior to construction. The project is currently approaching 95% design phase. SFPUC is currently working with the Thier Group to establish a new task order in the near future for their support. We also envision that the Public Outreach support will continue into construction.” Delve is required to make good faith efforts to utilize LBEs for any scopes of work, or portions thereof, which can reasonably be subcontracted throughout the life of the agreement. In light of this requirement, and as part of Delve’s good faith efforts, Delve is increasing its LBE commitments to Divis Consulting Inc and The Thier Group, thereby additionally increasing its overall projecting LBE participation (noted in the table below).

Moreover, Delve confirmed that it will remain committed to assigning work that may arise from future task orders to its original listed LBE subcontractors. Delve informed the CMD that it anticipates meeting its 10% Micro/Small-LBE subcontracting participation requirement, as follows:

Going forward, in order to ensure compliance with the Chapter 14B post-award requirements, SFPUC staff and Delve will continue to notify and obtain CMD approval for any proposed subcontractor additions and/or substitutions throughout the term of this contract as well as any changes to the scope of work and the information provided to CMD. CMD will review this information to determine and facilitate progress towards the project’s LBE subcontracting requirement. Contingent upon the conditions set forth above, CMD approves this modification.
