DEPARTMENT Business Services AGENDA NO. 11

Public Hearing: Accept and Expend California Extended Water and Wastewater Arrearage Payment Program Funds for Customer Debt Relief
Project Manager: Erin Corvinova and Clarissa Wan
Summary of
Proposed
Commission
Action:
Accept and expend federal funds sourced from the American Rescue Plan Act of 2021 and administered by the State Water Resources Control Board to provide assistance to eligible residential and commercial customers who accrued water and /or wastewater arrears or received discounts for water and/or wastewater services during the extended COVID-19 pandemic period from June 16, 2021 to December 31, 2022, in the approximate amount of $23.3 million.
Background: As the City and County of San Francisco recovers from the impacts of the COVID-19 pandemic, San Franciscans continue to suffer from Covid-19- related economic hardships arising since March 2020. During the pandemic, residents were forced to shelter -in-place, businesses temporarily or permanently closed, and many individuals lost their jobs.
In response to the pandemic, the San Francisco Public Utilities Commission (SFPUC) implemented several emergency prog rams to assist customers struggling with financial hardship and to maintain access to critical public utilities. First, the agency enacted a collections and shutoff moratorium, which was extended multiple times . Second, the SFPUC administered emergency credits and discounts for customers in all enterprises. In Water and Wastewater, the SFPUC ran emergency discount programs for both residential and commercial/nonprofit customers. These emergency programs were on top of the agency’s existing low -income discount programs, flexible payment plan options, and
other measures to support
customers with their utility bills.
Despite these interventions, many customers fell behind on their bill payments, accruing debt that in many cases has yet to be paid off. The number of delinquent customers and total overdue balances owed across all customer types have increased substantially since March 2020 . As of December 2023, 13,548 residential and 2,812 commercial customers have water and wastewater past due balances over 90 days , with residential arrears totaling $23.6 million and commercial arrears totaling $3.5 million.
Accept and Expend American Rescue Plan Act of 2021 Funds for SFPUC Ratepayer COVID-19 Debt Relief Commission Meeting Date: February 27, 2024
Page: 2
2 For comparison, in 2020, using the three-month period of January to March to represent pre- pandemic data , the SFPUC had an average of 2,010 residential and 602 commercial customers with water and wastewater past due balances over 90 days, with total residential arrears averaging approximately $567,000 and total commercial arrears averaging approximately $222,000.
As pandemic restrictions en d, the SFPUC is committed to supporting customers who are still struggling financially while gradually returning to normal business operations. Eligible customers on the emergency discount program were transitioned to the standard Customer Assistance Program , which also changed its discount structure to increase customer equity (Commission Resolution 23-0074). Starting July 1, 2023, for single-family residential water and wastewater customers enrolled in the Customer Assistance Program, households with incomes equal to or below 30% of Area Median Income receive a 40 percent discount on their utility bills, and households with incomes between 31% and 50% of Area Median Income receive a 25 percent discount on their utility bills.
Per Commission Resolution 22-0157, the agency was authorized to fully begin collections processes on July 1, 2023 for residential and commercial water and wastewater customers. Starting in April 2023, SFPUC’s Customer Service Bureau launched a campaign to facilitate customers’ return to regular payments , use of shutoffs, and use of liens. Once collections processes restarted on July 1, 2023, a strategic approach was adopted to prioritize commercial and multi-family unit customers and limit the number of shutoffs per day. Phasing shutoffs by districts also allowed the agency to minimize impact on San Francisco’s most vulnerable districts. By mid - October 2023, all shutoffs were stop ped due to the
extension of the
California Water and Wastewater Arrearage Payment Program. Per program guidelines, the shutoff moratorium for water and wastewater services customers remains in place until a customer defaults on their payment plan or misses the deadline to enroll in the payment plan.
As a part of its integrated response to help customers still in arrears, the SFPUC championed a legislative strategy to secure significant state and federal funds to pay off customer arrearages. The SFPUC was instrumental in ensuring that the nearly $3.2 billion allocated through the 2021-22 and 2022-23 California State Budgets reflected the agency’s priorities including:
(1) broad distribution of funds to ensure that ratepayers in every region — including low -
income customers in urban areas with high median
incomes—would receive some benefit; (2) ensuring the inclusion of wastewater customers; and (3) securing dedicated funding for customers of publicly-owned electric utilities and community choice aggregators so that both Hetchy Power and CleanPowerSF customers are eligible. The agency Accept and Expend American Rescue Plan Act of 2021 Funds for SFPUC Ratepayer COVID-19 Debt Relief Commission Meeting Date: February 27, 2024
Page: 3
3 has worked extensively internally, with industry associations, and with the administering California State departments to ensure the successful execution of these funding programs. Additionally, the SFPUC is actively advocating at the federal level for more funding and to create a permanent program for water and wastewater bill assistance, similar to the longstanding Low-Income Home Energy Assistance Program in the energy sector.
Through these successful advocacy efforts, the agency has secured funds for arrearages accumulated during the pandemic in all three Enterprises—water, wastewater and power.
In 2022, the California Water and Wastewater Arrearages Payment Program (2021 CWWAPP) granted SFPUC $7.3 million to pay down the accrued arrearages of and provide discounts to 15,198 residential and commercial water accounts and $9.3 million for 13,841 residential and commercial wastewater accounts.
The Extended Arrearages program is the second round of funding for water systems and wastewater treatment providers. On July 10, 2023, Governor Newsom signed Senate Bill No. 122, which expanded the program to cover an extended COVID Relief Period to December 31, 2022. T he state
legislature allocated the approximately $600 million remaining in federal funding for this program. On October 3, 2023, as part of Board Resolution No. 2023- 0038, the State Water Resources Control Board adopted guidelines of the extended program. The current program’s guidelines follow the guidelines of its predecessor, with the difference being the COVID debt relief period being extended to cover June 16, 2021 through December 31, 2022.
In early December 2023, the SFPUC submitted eligible customer arrearage information to the state along with its formal application . The SFPUC has applied for and expects to receive the full amount of its eligible costs under the Extended CWWAPP program: $2
3,368,920.23. The SFPUC cannot
verify the actual amount until receipt of funds, which it expects shortly. Under program guidelines, credits must be applied within 60 days of receiving funds.
Staff is seeking this approval to accept and expend funds before funds are received because the mandatory timeframe of 60 days to apply the funds to customer accounts necessitates commencement of the approval process; subject to approval by this Commission, staff must seek approval by the Board of Supervisors under Administrative Code section 10.170-1(b).
Some accounts originally eligible for relief at the time of application submission will have paid off all or a portion of their arrearages by the time Accept and Expend American Rescue Plan Act of 2021 Funds for SFPUC Ratepayer COVID-19 Debt Relief Commission Meeting Date: February 27, 2024
Page: 4
4 funds are received and applied to accounts . Any allocated amounts not applied to customer accounts must be returned to the state. As a result, it most benefits the agency and customers to apply credits to customer account balances as soon as funding is received.
While we do not know the final amounts that will be applied to accounts once funding is received, the funds requested in the application are as follows:
In addition to the above , the program will reimburse administrative time needed to apply for and administer this program , which we currently estimate at $200,000.
After approval by the Commission, the San Francisco Board of Supervisors must also approve the acceptance and expenditures of these grant funds.
