Summary of Proposed
Commission Action:
Award Contract No. WW-750, Southeast Water Pollution Control Plant SEP-7 Operations, Engineering, and Maintenance Buildings, a Construction Manager/General construction (CM/GC) services contract to the highest-ranked proposer, Clark Construction Group – CA, LP, in an amount not-to-exceed $97,000,000, and a duration of 1,751 consecutive days (approximately four years and 10 months), to replace Building SEP 850 and the adjacent parking lot at Jerrold and Phelps with two new buildings, SEP 603 and SEP 914.
Background: The San Francisco Public Utilities Commission (SFPUC) is undertaking this project to provide space for mechanical maintenance and trade shops, including shower and locker facilities for the Southeast Treatment Plant (SEP) . The project w ill also provide replacement offices for the engineering division that will be displaced with the demolition of SEP 850. In preparation for the Biosolids project, SFPUC relocated the mechanical maintenance and trade shops to temporary structures on the south campus or overcrowded spaces in existing buildings.
Replacement of SEP 850 has become a priority due to i ts disrepair.
The replacement also provides an opportunity to expand the footprint to include the adjacent parking lot in order to accommodate both the displacement of the maintenance and trade groups and replace the facilities located in SEP 850 . The project is part of an overall strategy to renovate the SEP campus , with the following key objectives:
1. Create a campus environment and plan for future needs;
2. Maximize SFPUC property assets and create new
opportunities for the SFPUC and the community;
3. Connect people, process and place in a safe and healthy environment; and
4. Respond to the surrounding urban fabric and demonstrate the SFPUC’s investment in the community.
Agenda Title: WW-750, Southeast Water Pollution Control Plant SEP-7 Operations, Engineering, and Maintenance Buildings Commission Meeting Date: March 12, 2024
On June 13, 2023, in consideration of the project schedule, cost, and procurement needs , the General Manager determined that the Construction Management/Gene ral Contractor (CM/GC) contract delivery method was necessary and appropriate to achieve schedule efficiencies and cost savings in the public’s best interest.
On August 31, 2023, SFPUC staff advertised a Request for Qualification and Proposals (RFQ&P) using the CM/GC delivery method. On October 18, 2023, SFPUC received four responses from:
(1) Plant Construction Company, L.P., (2) Clark Construction Group – CA, L.P. , (3) Webcor Builders, and (4) Turner Construction Company. Staff invited the firms with the top three scores t o interview. Clark Construction Group received the highest overall score. Staff recommends award of the contract to Clark Construction Group.
Scope of Contract: The Contract work will be located in San Francisco and within the Southeast Treatment Plant (SEP). During the design phase, the CM/GC will perform pre -construction services in collaboration with the Project’s designer and provide input related to constructability, phasing/sequencing of work, procurement planning, and other matters material to the success of the Project.
This collaboration will enhance the Project design and reduce the risk of cost and schedule changes during construction by having the CM/GC, which will be responsible for constructing the project if construction is approved by this Commission, provide input during the Project’s design phase. Under this contract award, the Commission is only authorizing work to commence on pre - construction services.
Only after the Project’s design has progressed, and the Project’s environmental review is complete, will the Commission determine whether to proceed with construction of the Project.
If the Commission approves the Project upon completion of the environmental review and authorizes the Project to proceed with construction, the CM/GC will perform the following services:
demolition of existing building SEP 850 and trailers SEP 850A and 850B, located on the north campus of the SEP ; then, within the footprint of the demolished structures and an adjacent parking lot, construction of two new buildings, approximately 45,000 square feet, for Operations, Engineering and Maintenance employees.

From: Jovi Cuntapay-Vitin, CMD
Subject: WW-750 Southeast Water Pollution Control Plant SEP7 Operations, Engineering, and Maintenance Buildings – CMD Award Memo
The Contract Monitoring Division (“CMD”) has reviewed the consultant proposals and supporting documentation and applied the appropriate rating bonuses submitted for the above referenced CM/GC project. Based on this review, CMD has determined that the proposals were materially compliant with the pre-award Chapter 14B requirements.
Rating Bonus
The CMD rating bonus does not apply because the engineer’s estimate for this contract exceeded $20,000,000.
Score Sheets and Score Tabulations
The Request for Qualifications and Proposal (“RFQ&P”) indicates that only the top three (3) ranked proposers from the written evaluation will be short listed to proceed for oral interview, cost proposal evaluation and SIP proposal evaluation. For the three (3) short listed firms, CMD has reviewed the score sheets submitted by the panelists and the final score tabulations from the SFPUC. Based on this information, the proposers are ranked as follows:
RANK FIRM
1 Clark Construction Group – CA, LP
2 Plant Construction Company, L.P.
3 Webcor
The RFQ&P indicates that the contract will be awarded to the highest ranked proposer. Based on the foregoing, Clark Construction Group – CA, LP (“Clark”) is the highest ranked proposer.
LBE Subconsultant Participation Requirements
For this project, the Micro-Local Business Enterprise (“LBE”) subcontracting requirement is 10%, the Small-LBE subcontracting requirement is 5% and the SBA -LBE subcontracting requirement is 2%. The Micro-LBE subcontracting requirements for this project can only be met by CMD certified San Francisco Micro-LBEs. The Small-LBE subcontracting requirements for this project can only be met by CMD certified San Francisco Micro and/or Small -LBEs. The SBA -LBE subcontracting requirements for this proj ect can only be met by CMD certified San Francisco Micro, Small and/or SBA-LBEs.
At the time of proposal, the Proposer may utilize the LBE types and sizes for the LBE subcontracting requirements for the Pre-Construction Services Phase of the project. The remaining balance of the three (3) LBE subcontracting requirements for the project will apply to the Construction Phase and be met by the cumulative LBE participation through the various trade packages.
Pre-Construction Services Phase – LBE Subcontracting Participation
Micro, Small and/or SBA LBE Participation
At the time of proposal, Clark did not list any Micro, Small or SBA LBEs for the Pre-Construction Services Phase on CMD Form 2A.
Additionally, Clark did not list any non-LBE subconsultants on CMD Form 2A.
Construction Phase – LBE Commitment and Participation
Due to the anticipated time lapse between proposal submission and the submission of the construction trade bid packages, Proposers were required to submit the Certifi cate of LBE Subcontracting Commitment for the 10% Micro- LBE subcontracting requirement, the 5% Small - LBE subcontracting requirement and the 2% SBA -LBE subcontracting requirement, which Clark has submitted. The 10% Micro-LBE subcontracting requirement for the Construction Phase can only be met by CMD certified San Francisco Micro-LBEs. The 5% Small -LBE subcontracting requirement for the Construction Phase can only be met by CMD certified San Francisco Micro and/or Small LBEs. The 2% SBA-LBE subcontracting requirement for the Construction Phase can only be met by CMD certified San Francisco Micro, Small and/or SBA-LBEs.
After award and prior to the advertisement of any trade packages, Clark will consult with the CMD and submit a written plan for achieving the LBE subcontracting participation requirements for the Construction Phase. As mentioned above, the LBE subcontracti ng requirements for the Construction Phase will be met by the cumulative LBE participation through the various trade packages. The written plan will specify the LBE subcontracting participation percentages for each trade package based on the availability of LBEs to perform the work or supply materials and equipment for the subject trade package.
Micro-LBE Trucking Set-Aside Program
In conjunction with the three separate LBE subcontracting requirements, this project is a participant in the Micro-LBE Truck ing Pilot Program. The utilization of Micro-LBE Trucking firms will be credited towards meeting the Micro-LBE Subcontracting requirement established for this contract. CMD’s program intends to provide Micro-LBE Trucking firms with greater access to subcontracting opportunities on CM/GC projects, especially in the City’s most disadvantaged communities. CMD will work with the SFPUC and Clark on implementing this pilot program.
A complete list of all the Micro-LBE Trucking firms certified by CMD at any given time can be found on the CMD website at: https://sfcitypartner.sfgov.org/pages/LBESearch/supplier - search.aspx
The CM/GC Prime Contractor and Trade Package sub-Primes (i.e., first-tier subcontractors under the Prime Contractor) will be assigning trucking and hauling work to Micro-LBE Truckers, if there is availability of trucking work and the availability of CMD -certified SF Micro-LBE truckers that meet the Minimum Qualifications for the advertised Trade Packages that include trucking work.
The amount (or percentage) of the available trucking work will be determined by the CM/GC Prime Contractor, in coordination with the SFPUC and CMD, in bid specifications at the level of Trade Package bidding. If a trucking broker is being utilized, then the trucking broker should also be a CMD-certified Micro-LBE Trucking Firm with first preference for Micro-LBE Truckers.
The RFQ&P indicates that a contract will be awarded to the highest ranked proposer. Based on the foregoing, CMD has determined that Clark have complied with the pre-award Chapter 14B requirements.
