Summary of
Proposed
Commission Action:
Approve Amendment No. 1 to Contract Nos. PRO.0066 A to C, Natural Resources Specialized and Technical Services, with AECOM Technical Services, Inc (PRO.0066.A), Applied Technology and Science A -T-S (PRO.0066.B), and Avila and Associates Consulting Engineers Inc. (PRO.0066.C), increasing each contract amount by $7,000,000, each for a new total not-to-exceed contract amount of $21,000,000, with no change to the contract durations, subject to Board of Supervisors approval under Charter Section 9.118.
Background: The San Francisco Public Utilities Commission (SF PUC) has retained the services of qualified consultants to assist SFPUC Water Enterprise staff with implementation of permit required WSIP environmental mitigation and other technical and professional services work essential to the continued management and protection of SFPUC watersheds and rights of way. This contract provides technical support for various permit -required programs including the fisheries and aquatic habitat below Calaveras and Lower Crystal Springs Dams, post -construction WSIP footprint revegetation, and the Bioregional Habitat Restoration (BHR) habitat restoration program. This contract also provides ongoing specialized technical support to Natural Resources and Lands Management Division staff for various other land management responsibilities in the watersheds and rights of way.
On August 28, 2018, by Resolution No. 18-0141, this Commission awarded Contract Nos. PRO.0066.A to C, Natural Resources Specialized and Technical Services, each with an amount not to exceed $14,000,000 and a duration of 10 years , to AECOM Technical Services, Inc (PRO.0066.A), Applied Technology and Science A -T-S (PRO.0066.B), and Avila and Associates Consulting Engineers Inc. (PRO.0066.C) . The Board of Supervisors approved the contracts on October 26, 2018, by Resolution No.345-18.
These contractors have provided technical support to various high priority natural resource and land management and protection programs. The workload associated with these programs exceeded initial expectations and so the contract capacity of this contract was used at a higher rate than Agenda Title: Contract Numbers PRO.0066.A-C, Natural Resources Specialized and Technical Services Commission Meeting Date: June 11, 2024
anticipated. This proposed amendment to increase capacity by 50% with no increase to contract duration would allow continued and uninterrupted technical support to the SFPUC staff charged with implementing these programs.
Scope of Contract: The work locations under the contracts include SFPUC watershed and right of way lands, and other locations where the SFPUC water and wastewater systems with an environmental nexus (such as da ms, reservoirs, and any locations where maintenance of or discharges from SFPUC infrastructure may affect the environment).
The work under the contracts consists of specialized and technical services to assist the SFPUC in meeting operational, maintenance, and environmental stewardship goals in a manner compliant with local, state, and federal environmental laws, regulations, permits, and requirements. The work under these agreements will consist of professional and technical tasks in the following service categories, plus fulfillment of the Com munity Benefit Commitments identified in the consultant proposals:
• Ecological Analysis;
• Planning, Permitting, and Environmental Regulatory Compliance; • Land and Natural Resource Management;
• Habitat Restoration and Natural Resource Protection; and • Other Related As-Needed Professional Services.

Contract:
Recommended Amendment No. 1: Staff recommends Commission authorization to increase each contract by $7,000,000, with no change to duration, to continue to provide technical support to the SFPUC’s implementation of permit- required environmental mitigation and natural resource and land protection, increasing the total not -to-exceed amount for each contract to $21,000,000.
Funding and Costs: Funding Source: Funding will primarily come from Water Enterprise Programmatic and Capital Improvement Programs. I ndividual projects will fund different task orders. Examples include the Long-Term Monitoring and Permit Program, Alameda BHR, and Peninsula BHR projects.

Additionally, pursuant to communications and documents provided by Avila, some of its listed LBEs have not yet been utilized because the task orders issued to-date did not require a scope of work that the LBEs at issue were listed to perform. Avila is required to make good faith efforts to utilize LBEs for any scopes of work, or portions thereof, which can reasonably be subcontracted throughout the life of the agreement. In light of this requirement, and as part of Avila’s good faith efforts, Avila is increasing its LBE utilization for ATS. This contract is as needed, and task orders are based on the work requests from SFPUC. The firms with zero participation have not received any work, due to the type of work that has been requested by SFPUC, as confirmed by the SFPUC.
Moreover, Avila confirmed that it will remain committed to assigning work that may arise from future task orders to its original listed LBE subcontractors, except that two of the firms are no longer able or willing to work on this contract, Varney Edits and Cindy Schad. These original commitments are being transferred to ATS, as shown in the table below. Avila informed the CMD that it anticipates meeting its
