Summary of
Proposed

Background: The San Francisco Public Utilities Commission (SFPUC ) is responsible for operating O’Shaughnessy D am which is located 140 miles east of San Francisco, in Yosemite National Park, Tuolumne County. Initially constructed in the 1920’s to impound water within the
Hetch Hetchy Reservoir,
O’Shaughnessy Dam is the primary structure of the Hetch Hetchy system which includes the Hetch Hetchy Reservoir, the Canyon Power Tunnel, and the Robert C. Kirkwood Powerhouse. The dam, a concrete curved gravity structure, is located on the Tuolumne River. In 1938, the dam was raised to its present-day height.

The objective of this project is to improve drainage and safe access within the dam.

The contract work consists of:
• Selective concrete demotion, including removal and disposal; • Diversion Tunnel access improvements;
• Ladder well platforms replacements;

• Watertight door replacement.

Funding and Costs: Funding Source: Hetchy Capital Improvement Program Project No. 10032903, O’Shaughnessy Dam Outlet Work Rehabilitation Phase 1

The Contract Monitoring Division (CMD) determined that none of the bidders are eligible for Local Business Enterprise (LBE) bid discount in accordance with Chapter 14B of the San Francisco Administrative Code.

Application of bid preferences in accordance with Chapter 14B of the San Francisco
Administrative Code did not change the final ranking of the low bidder.

Because the SFPUC anticipates that potential unforeseen conditions or other factors outside of the contractor’s control may impact the schedule, S taff included a requirement in the Invitation for Bids for bidders to provide a daily compensable time extensi on rate. At the bid opening, S taff announced that SFPUC would use the value of 10 days to calculate the Compensable Delay bid adjustment amount. Staff used the daily rate from the bids to determine the total Compensable Delay values shown in the table above by multiplying the bidder’s daily rate times 10. The Adjusted Bid value in the table above is the sum of the Base Bid and Compensable Delay less any applicable Local Business Enterprise and Social Impact Partnership Program bid discounts.

Staff used the Adjusted Bid value to compare and rank the bids to determine the lowest bidder. However, the contract award amount is the Base Bid value (not the Adjusted Bid value) and, if the Commission awards the Contract, the bidder’s daily compensable delay rate will become a term of the Contract.

Environmental
Review:

On July 16, 2020 , the San Francisco Planning Department determined the Project to be categorically exempt from environmental review under the Agenda Title: HH-1015 O’Shaughnessy Dam Drainage and Miscellaneous Improvements Commission Meeting Date: August 13, 2024

Page 3 ends

California Environmental Quality Act Guidelines section 15301, Class 1 (Existing Facilities) under Case Number 2020-004917ENV.

On January 24, 2024, the San Francisco Planning Department concurred that minor project revisions entailing potential delivery methods of water supply to the work site, clarifications regarding the methods of drain cleaning and discharge of related water, and use of a new staging area, do not change the conclusions of the categorical exemption.

The exemption determination and Planning Department concurrence can be found here: link.

Local Business
Enterprise
Participation and
Non-Discrimination
in Contracting:

The CMD established a 10% LBE subcontracting requirement for this contract. Sierra Mountain Construction, Inc. committed to a 11.39% LBE subcontractor participation with its bid submittal.

MEMORANDUM

Date: July 8, 2024

To: Jimmy Leong, SFPUC
Rafael Alcaraz, SFPUC

From: Jovi Cuntapay-Vitin, CMD

Subject: CMD Award Memo for HH-1015 O’Shaughnessy Dam Drainage and Miscellaneous Improvements

The Contract Monitoring Division (“CMD”) has reviewed the bids submitted for the above referenced project, applied the appropriate bid discounts, and determined responsiveness to the Chapter 14B pre-award requirements. The LBE subcontracting participation requirement is 10% for this project. The LBE subcontracting participation requirement is less than 20% due to (1) the remote location of the project; (2) the limited number of contractors with experience working in confined spaces like dams; and (3) the specialized scopes of work with limited LBE availability like high-pressure water jet drain cleaning and the watertight door. Below is a summary of CMD’s review.
