Environmental
Review:

Award of this professional services contract does not constitute a “project” under the California Environmental Quality Act (CEQA) Guidelines section 15378 because work under the contract will consist of engineering design and support services only, and no engineering support during construction and closeout services will be initiated under this contract until CEQA review is complete and until this Commission has reviewed and considered the CEQA determination and has approved the Project. Approval of indivi dual task
orders under this contract for activities such as geotechnical investigations would require compliance with CEQA prior to initiation of ground-disturbing activities.

Award of this professional services contract is not an approval of the proposed P
roject and SFPUC retains discretion to, among other things, modify the proposed project to mitigate significant environmental impacts, require the implementation of specific measures to mitigate any significant environmental impacts of the project, or re
ject the project, following completion of
environmental review.

Good Faith Efforts Requirements

1 The LBE subconsulting requirement is established below 20% for the following reason: The proposed scope of work for the Regional Groundwater Treatment Improvements project requires expertise and proficiency in working with complex groundwater treatment processes and integration with regional system operations. The nature of the work pursued by the SFPUC is highly specialized, which includes development and design of groundwater treatment strategies, conveyance facilities/equipment, and controls/monitoring systems.

KJ-AGS JV utilized Approach A (35% Approach) on CMD Form 2B to meet the Good Faith Efforts (“GFE”) Requirements.

KJ-AGS JV demonstrated that it met the GFE requirements under Approach A by exceeding the LBE subcontracting participation requirement established for this project by at least 35%.

The RFP indicates that a contract will be awarded to the highest ranked proposer. Based on the foregoing, CMD has determined that KJ-AGS JV has complied with the pre-award Chapter 14B requirements.
