Approve Amendment No. 1 to Contract No. PRO.0138.C, Engineering Services for Dams and Reservoirs

Summary of Proposed
Commission Action:

Approve Amendment No. 1 to Contract No. PRO.0138.C, Engineering Services for Dams and Reservoirs, with AECOM Technical Services, Inc., increasing the contract amount by $9,000,000, with no change to the contract duration , for a total not- to-exceed contract amount of $20,000,000 and a total contr act duration of 11 years , to continue providing planning, design, and engineering support of improvements to various San Francisco Public Utilities Commission Water Enterprise Dam and Re servoir facilities , subject to Board of Supervisors approval under Charter Section 9.118.

Background: In 2017, the Governor of California ordered the California Division of Safety of Dams (DSOD) to identify spillways in the state associated with large high-hazard dams that could pose significant risk to the public if a spillway incident similar to Oroville were to occur. Accordingly, t he DSOD directed the San Francisco Public Utilities Commission (SFPUC) to conduct condition assessments of the spillways
under DSOD
jurisdictions. State legislation requires the DSOD to update its inspection and reevaluation p rotocols and SFPUC anticipates that the updates to DSOD protocols may trigger additional actions that will require the SFPUC to perform updated stability analyses and/or potential failure mode analyses. SFPUC developed and is implementing projects in its 10- Year C apital Plan to address the DSOD orders. The SFPUC, with the support of this contract, is performing condition assessments and other specialized dam and reservoir engineering services to address potential dam safety issues that have been identified through condition assessments and reevaluation of existing facilities.

On January 14, 2020, by Resolution No. 20 -0008, the Commission awarded Contract No. PRO.0138.C, Engineering Services for Dams and Reservoirs, to AECOM Technical Services, Inc. (AECOM), with a not-to- exceed contract amount of $11,000,000, and with a contract duration of 11 years for the following projects:

• Regional Dam Safety Upgrades
• San Andreas Dam Facility Improvements

• Turner Dam and Reservoir Improvements
• Pilarcitos Dam and Reservoir Improvements
• Local (San Francisco) Tanks/Reservoir Improvements
• College Hill Reservoir Outlet
• Merced Manor Reservoir Facilities Repair
• Stanford Heights Reservoir
• Summit Reservoir
• Sunset South Basin
• University Mound South Basin

The original amount of the contract was based on the 10-Year Water Enterprise Regional and Local Capital Improvement Program, which provided funding for the needs assessment of the various dam and reservoir facilities.

The needs assessment work has helped SFPUC to define project scope s and the SFPUC has significantly increased the latest capital program budgets to reflect the updated needs for the various dam and reservoir facilities. Several of these projects are moving into the engineering design phase; this amendment will provide capacity for a selection of these projects to advance (see Table 1 below). Other projects in the list above that have not progressed through the planning stage may need additional contract capacity after the scopes have been f urther developed, either through this contract by a future amendment or by other means.

Scope of Contract: The primary role of the consultant is to provide planning and engineering services for dam and reservoir improvement projects identified within the Water Enterprise Capital Improvement Program under the direction of the SFPUC Engineering Management Bureau.

The consultant is also providing specialized dam and reservoir engineering services including civil, geomorphology, hydrol ogy, hydraulics, geotechnical, slope stabilization and structural engineering for the design and reconstruction of the dams, reservoirs , and associated
facilities.

The work under this contract consists of professional engineering services with the following tasks:
• Civil Engineering;
• Electrical Engineering;
• Mechanical Engineering;
• Structural Engineering;
• Pipeline Engineering;
• Geotechnical/Geologic Engineering;
• Tunnel Engineering;
• Cost Estimating;
• Utilities Mapping and Coordination;

Environmental
Review:

Amendment of this professional services contract does not constitute a “project” under the California Environmental Quality Act (CEQA) Guidelines section 15378 because work will consist of engineering services only and does not involve a commitment to any specific project that may result in a direct or indirect physical change in the environment.

Staff will not approve any work involving ground disturbance or any other physical changes to the environment , such as for geotechnical investigations, under this contract until the SFPUC has reviewed and considered any required environmental review and authorizes such work.

Amendment of this professional services contract is not an approval of any proposed project and SFPUC retains discretion to, among other things, modify proposed project s to mitigate significant environmental impacts, require the implementation of specific measures to mitigate any significant environmental impacts of the projects, or reject the project, following completion of environmental review.

MEMORANDUM

Date: August 2, 2024

To: Tedman Lee, SFPUC

From: Jovi Cuntapay-Vitin on behalf of Jason Chow, CMD

Subject: CMD Modification No. 1 for PRO.0138.C Engineering Services for Dams and Reservoirs

The San Francisco Public Utilities Commission (“SFPUC”) has requested a modification for the above referenced contract by increasing the contract amount by $9,000,000 for a total agreement amount of $20,000,000. Per the SFPUC, the scope of work for Modification No.1 will provide additional planning, design, and engineering support of improvements to various SFPUC Dam and Reservoir facilities in the Water and Power Enterprises.

LBE Subconsulting Participation

The LBE subconsulting participation requirement established for this contract is 7%. The LBE subconsulting participation commitment of 9.45% applies to the entire contract including any amendments, change orders and/or modifications. The LBE participation commitment reflected on the Proposer’s, AECOM’s, CMD Form 2A at the time of proposal is as follows:

Per phone and email communications with AECOM and as confirmed with SFPUC , KKL Consulting, LLC.’s LBE participation to date is at 0.00% because its listed scope of work has not surfaced, therefore, their service is not needed yet. Additionally, Bello & Associates Structural Engineers already performed work on the project. However, this LBE subconsultant has not invoiced AECOM thus far, which resulted in a 0.00% LBE participation to-date.

AECOM is required to make good faith efforts to utilize LBEs for any scope of work, or portions thereof, which can reasonably be subcontracted out throughout the life of the contract. In light of this requirement, AECOM has performed good faith outreach to LBE firms. As part of its good faith efforts and as noted in the table above, AECOM added SCA Environmental Inc. and Water Resources Engineering, Inc., both are LBE subconsultants, to its team.

Based on the foregoing and taking into consideration the proposed increase and the original contract amount, AECOM confirmed that it will remain committed to assigning work that may arise from future task orders to its original listed LBE subconsultants. AECOM informed the CMD that it anticipates meeting its 9.45% LBE commitment, as follows:
