MEMORANDUM

To: Alisha Reinhardt, SFPUC

From: Jason Chow, CMD

Subject: Closeout for WD-2871 Aqua Ammonia Structural Repairs and Tank Replacement CMD’s Closeout Review

The Contract Monitoring Division (“CMD”) has determined that Cal State Constructors (“Cal State”), the prime contractor for this project, has complied with the Chapter 14B LBE subcontracting requirements associated with this project.

At the time the project was advertised, an LBE subcontracting requirement of 9% was established.

Cal State’s Subcontractor List (Document 00 43 36) reflected an LBE subcontractor participation commitment of

19.01%. Cal State was awarded the contract in the amount of $1,773,514. After six (6) change orders, the final contract amount is $2,045,523.18 At closeout, the LBE subcontracting participation is as follows:

In good faith, Cal State added two (2) LBE firms; Bay Tech and McGill (referenced above). By doing so, Cal State exceeded its original overall LBE commitment percentage from time of bid.

Based on the foregoing, CMD concurs with the closeout of this contract.

1 Bay Tech, an LBE firm, was added onto Cal State’s team after contract award. 2 McGill, an LBE firm, was added onto Cal State’s team after contract award.
