Subject: Closeout for WD-2890R – BDPL 3&4 Slip Lining at Lafayette Street – CMD Memo
The Contract Monitoring Division (“CMD”) has determined that Ranger Pipelines Incorporated (“Ranger Pipelines”) has substantially c omplied with the LBE subcontracting requirements associated with this project.
At the time the project was advertised, CMD established an LBE subcontracting requirement of 11%. The Prime’s Document 00 43 36 reflected an LBE s ubcontracting participation of 16.78 %. Ranger Pipelines (the Prime Contractor) was awarded the contract in the amount of $5,662,200.00. The final contract invoiced amount is $5,818,355.75. Ranger Pipelines’ LBE subcontracting participation at closeout is as follows:

CMD Contract Compliance Officer checked with the Prime and SFPUC regarding Crana Trucking , LBE participation shortfall. The Prime provided the following explanations, confirmed by the SFPUC:
“The reuse of native trench spoils for backfill eliminated the need for Crana Trucking to transport and dispose at landfill. During the encroachment permit with the City of Santa Clara required the usage of their debris box service (Mission Trail Waste Systems) which eliminated the need for Crana Trucking to transport and dispose to landfill. The demolished pipe and materials on existing coating on SPPUC’s BDPL4 90” pipe contained polychlorinated biphenyls (PCBs), which required hazardous material handling and reduced the amount of trucking on the project.”
To recover and maximize LBE subcontracting participation on this project, Ranger Pipelines increased the listed subcontractors – Lefevre Welding and Michael O’Shaughnessy Construction Inc., – participation to make up for Crana Trucking shortfall.
Overall, Ranger Pipelines was able to meet and exceed its LBE p articipation commitment at a final closeout percentage of 2 2.47% instead of 16.78% .
Based on the foregoing, CMD concurs with the closeout of this contract. Should you have any questions, or if I can be of further assistance, please do not hesitate to contact me at [email protected]
