Approve Execution and Submission of an Attestation of Veracity for CleanPowerSF’s 2023 Power Source Disclosure Reports and Power Content Label

Summary of
Proposed
Commission Action:

Approve execution and submission of an attestation of veracity for CleanPowerSF’s 2023 Power Source Disclosure Reports and Power Content Label; approve final submission of the 2023 Power Source Disclosure R eports to th e California Energy Commission (Energy Commission); and approve provision of the Power Content Label to all customers by January 31, 2025.1

The Power C ontent Label provides power mix information to CleanPowerSF’s customers, showing the sources and emissions intensity of CleanPowerSF’s electric generati on and c omparing it to the statewide resource m ix. Under Energy Commission regulations, the SFPUC can attest to the veracit y of the P ower Source Disclosure Report and Power Content Label for all retail p roducts offered by CleanPowerSF.

CleanPowerSF offers three p roducts that require Power S ource Disclosure Report and P ower C ontent Label reporting: Green, SuperGreen and SuperGreen Saver. The 2023 Power Source
Disclosure R eports and Power Content Labels demonstrate that in 2023, CleanPowerSF ’s Green product supply w as 56.5 percent Renewables Portfolio Standard (RPS) eligible renewable, and both its SuperGreen and SuperGreen Saver pro ducts supplies were 100 percent Renewables Portfolio Standar d-eligible rene wable.

CleanPowerSF’s Green product ha d a greenhouse gas emissions intensity of 15 pounds of carbon di oxide equivalent (CO2e) per megawatt-hour (MWh) of generatio n, and both its SuperGreen and SuperGreen Saver products had a greenhouse gas emissions intensity of 0 pounds of CO2e/MWh.

1 This deadline, set by the Energy Commission, was extended from October 1, 2024 due to a software issue impacting the Western Renewable Energy Generation Information System’s ability to issue Renewable Energy Credits to various load- serving entities across the state, which delayed the Energy Commission’s issuance of the Power Content Label template.

Background: Under Public Utilities Code Sections 398.4 and 398.5, retail suppliers of electricity must annually (1) report to th e California Energy Commission the type of gene ration re sources ( for example, hydroelectric, so lar, geothermal, and so on) used to serve their en d use cus tomers in the form of the Power Source Disclosure R eport; and (2) provide this same inf ormation, in the form of a P ower Content Label to their customers.

CleanPowerSF submitted its SuperGreen and SuperGreen Saver Power Source Disclosure Reports to the Energy Commission on June 3, 2024. Staff submitted the Green Product Power Source Disclosure Report to the Energy Commission on August 26, 2024 when final data became available. A summary of the P ower Source Discl osure Reports — including projected Green Prod uct RPS results — was provided to th is Commission as an inf ormational communications item (Item #15(b), Communications) at its May 28, 2024 meeting.

As s hown i n the at tached Power Source Disclosure Reports for calendar year 2023, Cl eanPowerSF provided electricity to its Green product customers from the following sources:

• 56.5 percent renewable energy resources that qualify as eligible renewa ble resources under California ’s Renewab les Portfolio Standard.
• 43.5 percent additional greenhouse gas free hydroelectric generation.
• 0.0 percent California Independent System Operat or
unspecified sources of power.
2 In total, 100 percent of CleanPowerSF’s Green product power supply came from clean and renewable en ergy sources like solar, wind, geothermal, and hydroelectric generation.

CleanPowerSF provided electricity to i ts SuperGre en customers from:

• 100 percent renewable energy resources (solar and wi nd) that qualify as eli gible renewable sources u nder C alifornia’s Renewables Portfolio Standard program.

CleanPowerSF provided electricity to its SuperGreen Saver customers from:

100 percent renewable energy resources (solar) that qualify as eligible rene wable sources u nder California ’s Renewables

2 California Independent System Operator unspecified sources of power means electricity from transactions that are not traceable to specific generation sources.

Portfolio Standard program.

After retail sellers submit their P ower Source Disclosure Reports to the Energy Commission, the agency then compiles them to determine the statewid e mix of electricity resources used to meet Ca lifornia’s electricity demand and provides this information back to retail sellers for inclusion in their Power Content Labels in the form of a Power Content Label template.

CleanPowerSF intends to disclose the electricity sources of its sales to customers for 2023 using the P ower Content Label, a draft of which is attached to this agenda item.3 The Power Content Label is in the format pr escribed by the C alifornia Energy Commission for all retail sellers released on September 26, 2024. The Power Content Label shows, in t abular form, the electricity so urces for CleanPowerSF’s sales and provides additional des criptive information to improve readability and understanding for customers.

As a result of Assembly Bill 1110 (Ting , 2015 ), starting in 2020 , the Power Source Disclosure Reports also calculate greenhouse gas emissions in tensity ( pounds CO
2e/MWh) for e ach of the r eporting
retail selle r’s electricity products included on the Power Content Label.4

The CleanPowerSF Green product’s 2023 greenhouse gas
emissions intensity was 15 pounds CO
2e/MWh. To put this in
context, in 2023, California’ s statewide e missions intensity was 373 p ounds CO 2e/MWh, while in 2022, the latest year for which this data is av ailable, PG&E’s default produc t was 56 pounds CO2e/MWh.

The SuperGreen and SuperGre en Sav er products 2023 emissions intensity was 0 pounds CO
2e/MWh.

Under the Energy Commission’ s regul ations, CleanPowerSF must provide all c ustomers with a copy of the P ower Content Label either as a physical mailer or an elect ronic message (only for those customers billed electronically). T he Power Content Label will also be posted on CleanPowerSF’s website.

Under t he Energy Commission’ s regulations, CleanPow erSF must also either have i ts governing body (t his Commis sion) attest to the veracity of its Power Source Disclosure Reports and Power Content Label or have them verified by a qualified t hird party. The

3 The Power Content Label will be finalized after Commission action on this item and will be distributed to customers by January 31, 2025.
4 This bill amended Section 398.1 and 398.4 of the Public Utilities Code, and tasked the California Energy Commission to adopt guidelines for the reporting and disclosure of greenhouse gas emissions intensity associated with retail electricity sales.

Commission has attested to the veracity of CleanPowerS F’s Power Source Disclosure Report since CleanPowerSF began serving customers in 2016 and file d its first report in 2017 based on 2016 actual electricity sales.

The attached resolution attests to the veracity of the P ower Source Disclosure Reports and Power Content Label. The attest ation of veracity is to be execu ted by t he As sistant Ge neral M anager for Power or t heir designee, who supervised the preparation of the Power Source Disclosure Reports and Power Content Label.

Result of Inaction: If the Commission does n ot approve submission of an at testation of veracity, th e SFPUC will be required to inc ur the time and cost o f having the P ower Source Disclosure Reports and Power Content Label independently verified and may incur fine s if the verification is not completed by the Energy Commission’s January 31st deadline.

Recommendation: SFPUC st aff r ecommends that the Commission adop t the a ttached resolution.
