Approve Execution and Submission of an Attestation of Veracity for Hetch Hetchy Power’s 2023 Power Source Disclosure Reports and Power Content Label
Summary of
Proposed
Commission Action:
Approve execution and submission of an attestation of veracity for Hetch Hetchy Power’ s 2023 Power Source Disclosure Report s and Power Content Label; approve final submission of the 2023 Power Source Disclosure Report s to the California Energy Commission (Energy Commission); and approve provision of the Power C ontent Label to all customers by January 31, 20251.
The Power Content Label provides power mix information to Hetch Hetchy Power ’s customers, showing the sources and emissions intensity of Hetch Hetchy Power’s electric generation and comparing it to the statewide resour ce mix. Under Energy Commission regulations, the SFPUC can attest to the veracity of the Power Source Disclosure Report s and Power C ontent Label for all retail products offered by Hetch Hetchy Power.
Hetch Hetchy Power offers two products which require this reporting: General Service and Premium S ervice. The 2023 Power Source Disclosure Report s and Power C ontent Label demonstrate that in 2023, Hetch Hetchy Power ’s General Service provided its customers w ith an energy product that was 100% greenhouse gas (GHG)-free, sourced almost entirely from the Hetch Hetchy hydroelectric system. Hetch Hetchy Power’s Premium Service provided its customers with an en ergy product that was also 100% GHG-free, with 52% of t his energy also meeting California’s Renewable Portfolio Standard 2 (RPS) requirements during the reporting year. Hetch Hetchy Power’s General a nd Premium S ervice offerings both have a GHG emissions intensity of 0 pounds of carbon dioxide equivalent (CO2e) per megawatt-hour (MWh) of generation.
Background: Under Public Utilities Code Sections 398.4 and 398.5, retail suppliers
1 This deadline, set by the Energy Commission, was extended from October 1, 2024 due to a software issue impacting the Western Renewable Energy Generation Information System’s ability to issue Renewable Energy Credits to various load- serving entities across the state, which delayed the Energy Commission’s issuance of the Power Content Label template. 2 RPS-eligible renewable resources include wind, solar, biomass and biowaste, small hydroelectric and geothermal facilities.
Agenda Title: Approve submission of Hetch Hetchy Power’s 2023 Power Source Disclosure Reports/Power Content Label Commission Meeting Date: October 22, 2024
of electricity must annually: (1) report to the Energy Commission the type of generation resources ( e.g., hydroelectric, solar, wind) used to serve their end use customers in the form of the Power Source Disclosure Report; and (2) provide this same information, in the fo rm of a Power Content Label, to their customers.
Hetch Hetchy Power submitted its Power Source Disclosure Report s to the Energy Commission on May 31, 2024 with non-substantive revisions submitted on July 31, 2024. A summary of the Power Source Disclosure Report s was provided to this C ommission as an informational communications ite m (Item # 15(b), Communications) at its May 28, 2024 meeting.
As shown in the attached Power Source Disclosure Report s for calendar year 2023, Hetch Hetchy Power provided electricity to its General Service customers that was 1 00% G HG-free hydroelectric energy. Ninety- nine percent of this ene rgy was generated by the Hetch Hetchy system and the remaining one percent from hydroelectric facilities of the Western Area Power Administration (WAPA) which is the sourc e of the electric e nergy Hetch Hetchy Power provides to Treasure Island. 3 Hetch Hetch y Power also had surplus energy above its retail needs from its Kirkwood generating units, solar facilities, and the Southeast Cogen power plant. This energy, all of which meets California’s Renewable Portfolio Standard eligibility standards, was r e-sold w ith Hetch Hetc hy Power kee ping the associated renewable energy credits (RECs). These RECs can be used for Hetch Hetchy Power to meet its future Renewable Portfolio Standard compliance obligations.
Hetch Hetchy’s Premium Service provided electricit y that w as 100% GHG-free (hydroelectric) with 52% coming from Renewable Portfolio Standard (RPS)-eligible (hydroelectric) resources for calendar year 2023. It is important to note that the 52% eligi ble renewable percentage does not reflect RPS compliance u nder California’s RPS program, which is determined us ing a differ ent methodology. The Energy Commission permits only energy deliveries that physically occurred during the calendar year to be included in the Power Content Label. For RPS compliance, by contr ast, the Energy Commission permits eligible electricity generated up to three years before (and in some cases even longer) to meet RPS requirements.
Premium Service provides customers an electricity portfolio that meets the requirements of the Cal ifornia Air Resources Board’s Low Carbon Fuel Standard (LCFS) program. This allow s the San Francisco Mun icipal Transp ortation Agency, the San Francisco International Airport, and t he Port of San Francisco t o rec eive additional credits under the program which rewar ds entit ies using
3 A small proportion of this WAPA power (346 MWh) also met the definition of RPS-eligible energy.
Agenda Title: Approve submission of Hetch Hetchy Power’s 2023 Power Source Disclosure Reports/Power Content Label Commission Meeting Date: October 22, 2024
clean energy rather than fossil fuels for transportation -related uses .
Similarly, to RPS rules, electricity generated in the previous year may be used to meet LCFS program requirements.
After retail sellers submit their Power So urce Disclosure Reports to the Energy Commission, the agency then compiles them to determine the statewide mix of electricity resources used to m eet Californ ia’s electricity demand and provides this information back to retail sellers for inclusion in their Power Content Labels in the form of a Power Content Label template.
Hetch Hetchy Power intends to disclose the electricity sources of its sales to customers for 2023 using the Power Content Label, a draft of which is attached to this agenda item.
4 The Power Content Label is in
the format prescribed by the Energy Commission for all retail sellers released on September 26, 2024. The Power Content Label shows, in tabular form, the electricity sources for Het ch Hetchy Power’s sales and provi des additional descriptiv e information to improve readability and understanding for customers.
As a result of Assembly Bill 1110 (Ting, 2015),
5 starting in 2020, the
Power Source Disclosure Report s also calculate greenhouse gas emissions intensity ( pounds CO2e /MWh) for ea ch of the reporting retail seller ’s electricity products included on the Power C ontent Label.
Both Hetch Hetchy Power’s General Service and Premium S ervice had a 2023 greenhouse gas emissions intensity of 0 pounds CO2e/MWh. To put this in context, in 2023, California’s statewide emissions intensity was 373 pounds CO2e/MWh, while in 2022, the latest year for which this data is available, PG&E’s default product was 56 pounds CO2e/MWh.
Under Energy Commiss ion regulations, Hetch Hetchy Power must provide all customers with a copy of the Power C ontent Label either as a physical mailer or an electronic message (only for those customers billed electronically). The Power C ontent Label will also be posted on the SFPUC’s website.
In addition, under Energy Commi ssion regulations, Hetch Hetchy Power must also either have its governing body (this Commission) attest to the veracity of its Power Source Disclosure Report s and Power Content Label or have them verified by a qualified third party.
The Commission has atte sted to t he veraci ty of Hetch Hetchy
4 The Power Content Label will be finalized after Commission action on this item and will be distributed to customers by January 31, 2025.
5 This bill amended Section 398.1 and 398.4 of the Public Utilities Code, and tasked the Energy Commission to adopt guidelines for the reporting and disclosure of greenhouse gas emissions intensity associated with retail electricity sales.
Agenda Title: Approve submission of Hetch Hetchy Power’s 2023 Power Source Disclosure Reports/Power Content Label Commission Meeting Date: October 22, 2024
Power’s Power Source Disclosure Reports since Hetch Hetchy started its reporting in 2011.
The attached resolution attests to the veracity of the Power Source Disclosure Reports and Power C ontent Label. The attestation of veracity is to be executed by the Assistan t General Manager for Power or their designee, who supervised the preparation of the Power Source Disclosure Reports and Power Content Label.
Result of Inaction: If the Commission does n ot approve submissio n of an at testation of veracity, the SFPUC will be required to incur the time and cost of having the Power Source Disclosure Report s and Power C ontent Label independently verified and may incur fines if the verification is not completed by the Energy Commission’s January 31st deadline.
Recommendation: SFPUC staff recommends that the Commission adopt the attached resolution.
