Approve Appointment of President Kate Stacy to San Joaquin Tributaries Authority Commission

Summary of Proposed
Commission Action:

Appoint President Kate Stacy to serve as a Commissioner on the San Joaquin Tributaries Authority Commission.

Background: The City and County of San Francisco (San Francisco) , Modesto Irrigation District, South San Joaquin Irrigation District, and the Turlock Irrigati on District are political subdivisions of the State of California that hold various water rights on rivers and streams tributary to the Lower San Joaquin River. On April 24, 2012, by Resolution No. 12-0068, the San Francisco Public Utilities Commission (SF PUC), as the policy body of San Francisco charged with exclusive authority over San Francisco’s water rights and supplies, authorized the President of the SFPUC to execute a Joint Powers Agreement (JPA) to establish the San Joaquin Tributaries Authority (S JTA), a new joint powers authority, with those entities as member agencies.

The purpose s of the SJTA are, among others, to develop and facilitate an environment in which the SJTA’s member agencies are able to provide water service in an efficient manner at a reasonable cost ; to investigate and develop plans for conservation and conjunctive use ; to ensure long term reliability of each SJTA member’s water system; and to work with other governmental and public agencies to promote the common welfare of the landowners and water users served by SJTA members.

In accordance with Article 6 of the JPA, the SJTA is governed by a commission (SJTA Commission) consisting of one c ommissioner (SJTA Commissioner) representing each member agency. Each member agency must appoint as its SJTA Commissioner an individual who sits on the member agency’s governing body. Each member agency’s appointed SJTA Commissioner may continue to serve on the SJTA Commission as long as they are not removed or replaced by their appointing governing body and they continue to sit on that governing body.

On October 1, 2024, the SFPUC’s SJTA Commissioner , appointed by this Commission on May 24, 2022, by Resolution No. 22-0091, ceased being an SFPUC Commissioner and was automatically removed from the SJTA Commission pursuant to Section 6.4 of the JPA, because the Commissioner no longer met the qualifications to serve as an SJTA Commissioner under Section Agenda Title: Public Hearing to Adopt Amendments to Social Impact Partnership Program Rules and Regulations Commission Meeting Date: November 12, 2024

6.2 of the JPA. To fill this vacancy, the SFPUC must appoint one of its current SFPUC Commissioners to serve as the SJTA Commissioner representing the SFPUC.
