Approve First Amendment to Agreement Nos. PRO.0183 and PRO.0183(G), Residential Green Infrastructure Grant Program

Summary of
Proposed
Commission Action:

Approve Amendment No. 1 to Professional Services Contract No. PRO.0183, Residential Green Infrastructure Grant Program , with Greenprint Partners, increasing the contract amount by $500,000 for a new total contract amount of $645,000, and
extending the contract duration by three years and nine months for a new total contract duration of five years and nine months , and increasing the scope of work to include additional neighborhoods for outreach and implementation; and approve Amendment No. 1 to the companion Grant Agreement No. PRO.0183(G), Residential Green Infrastructure Grant Program, with Greenprint Partners, increasing t he agreement amount by $700,000, for a new total agreement amount of $855,000, and extending the agreement duration by three years and nine months for a new total agreement duration of five years and nine months.

Background: The Residential Green Infrastructure Grant Program was launched in 2023 to expand the San Francisco Public Utilities Commission’s (SFPUC) city-wide green infrastructure program to residential properties by offering an incentive for residential ratepayers to manage stormwater on their property using green infrastructure. Green infrastructure is a set of engineered, sustainable stormwater management tools that slow down, clean, and route stormwater to keep it from overwhelming the City’s sewer system. Some common types of green infrastructure tools include rain gardens, rainwater harvesting cisterns, infiltration trenches, vegetated roofs, and permeable pavement. In addition to reducing the volume of stormwater entering the City’s sewer system, green infrastructure may also incidentally provide other
benefits, including
neighborhood greening, enhancing urban wildlife habitat, reducing urban heat, and restoring natural hydrologic function to San Francisco’s watersheds.

The Residential Green Infrastructure Grant Program provides funding for the installation of approved stormwater management facilities on residential properties in San Francisco. The scope of this contract includes the launch for the Residential Green Infrastructure Grant Program, the implementation of a variety of green infrastructure facility types at the residential scale, and data collection on information related to the costs
, technical barriers, and
administrative structure to inform the implementation of a future, full- scale, city-wide program.

Agenda Title: PRO.0183, Residential Green Infrastructure Grant Program Commission Meeting Date: November 12, 2024

Page 2 ends

The Residential Green Infrastructure Grant Program has three broad utility- benefit objectives:

1. To motivate residential customers to manage stormwater on their properties using green stormwater infrastructure technologies.

2. To retain, detain, and/or clean stormwater runoff before it enters an SFPUC owned and/or operated sewer system.

3. To educate San Francisco residential rate payers about the City’s sewer system and stormwater management tools.

On December 13, 2022, by Resolution No. 22-0218, this Commission awarded Contract No. PRO.0183(G), Residential Green Infrastructure Grant Program Agreement, to Greenprint Partners, for an amount not-to-exceed $155,000 and with a duration of two years. The General Manager, under the Commission’s delegation of authority under Resolution No. 09-0017, dated January 27, 2009, awarded the Professional Services Contract PRO.0183, Residential Green Infrastructure Grant Program, to Greenprint Partners for an amount not-to-exceed $145,000 and with a duration of two years. The Professional Services Contract includes services beyond those allowable in a grant agreement under San Francisco Administrative Code Ch. 21G.

Scope of Contract: The contractor’s scope for the Residential Green Infrastructure Grant Program includes two parallel agreements: a Professional Services Contract and a Grant Agreement.

The work under the Grant Agreement consists of:

1. Grant Funds: Greenprint Partners will disburse grant funds under the Grant Agreement. Following SFPUC’s approval of each proposed residential green infrastructure project, Greenprint Partners will issue upfront subgrant payments to residential rate payers (either property owners or renters with approval from property owner) to pay for construction services.

2. Final Report and Program Evaluation: Greenprint Partners will complete a final report and presentation each year of the Agreement.

The work under the Professional Services Contract consists of:

1. Outreach, Education, and Marketing: Greenprint Partners will perform public outreach and host workshops to identify, and recruit interested eligible residential ratepayers to participate in the Residential Green Infrastructure Grant Program.

2. Property Assessments and Project Proposals: Greenprint Partners will conduct residential property assessments with prospective program participants and develop recommended green infrastructure concept designs for each participating property. Greenprint Partners will submit recommended project packages to the SFPUC
Wastewater Enterprise for review and approval.

Agenda Title: PRO.0183, Residential Green Infrastructure Grant Program Commission Meeting Date: November 12, 2024

3. Grant Management: Greenprint Partners will provide grant fund management services, including processing payments to participating residential rate payers.

4. Project Management and Program Administration: Greenprint Partners will manage residential construction projects, submit monthly status reports and paid invoices to SFPUC Wastewater Enterprise, provide customer service, collect and manage program data, and coordinate with SFPUC Wastewater Enterprise throughout the duration of the pilot program.

Amendments to the
Contract:

Proposed Amendment No. 1:

Staff recommends Commission authorization to increase the amount of the Professional Services Contract by $500,000 and Grant Agreement by $700,000; and to extend the duration of both the Professional Services Contract and Grant Agreement by three years and nine months for a total duration of five years and nine months, to extend the grant program administrative services and to provide additional grant funding for the construction of additional residential green infrastructure projects. The scope of work is being expanded to allow grants to any neighborhood in the City that SFPUC staff may select, not just the list of specific neig hborhoods in the original scope of work. The proposed amendments to the amount and duration of the Professional Services Contract and Grant Agreement are consistent with the amount and duration outlined in the contract procurement and are provided in the solicited Request for Proposals (RFP) dated June 1, 2022. The RFP states that the SFPUC may choose to
increase the total amount of the

Environmental
Review:

This action does not constitute a "Project" under C alifornia Environmental Quality Act (CEQA) Guidelines section 15378(b)(4) because the Residential Green Infrastructure Grant Program creates a government funding mechanism which does not involve commitment to any specific project that may result in a physical change in the environment. The SFPUC will disburse grant funds for the construction of each individual project only following the SFPUC's review and consideration of the completed review of e ach project under the CEQA; and the SFPUC, in awarding and executing the grant agreement, is not approving any individual project under CEQA.

Local Business
Enterprise
Utilization and Non-
Discrimination in
Contracting:

The Contract Monitoring Division (CMD) established a requirement of 10% Local Business Enterprise ( LBE) subcontractor participation for th e Professional Services Contract . The contractor committed to 33.34% LBE subcontractor participation with its proposal, and this amount remai ns unchanged. Chapter 14B Local Business Enterprise (LBE) subcontractor participation requirement does not apply to the Grant Agreement.
