Approve increases of $1,578,919 to the cost contingency and 542 days to the duration contingency for Contract No. WD -2868R, San Francisco Local Water As-Needed Paving (FY 21-24), with A. Ruiz Construction Company & Associates, Inc., for a revised cost limit of $20,785,500 and a revised duration of 1,825 consecutive calendar days , due to an ongoing need for as -needed paving services until SFPUC issues a replacement (new) contract.
Background: The work performed through this contract is necessary to restore roadways and sidewalks after installation of water infrastructure, repair of main breaks, and replacement of meter boxes.
Due to delays in procuring a new as -needed paving contract to replace this contract, Staff recommends an extension of the duration of this existing contract and an increase in contract amount to provide capacity for critical street repair services following unanticipated main breaks and leaks and to support new water service installations and meter maintenance. Staff anticipates that SFPUC will be able to obtain a new as-needed paving contract by January 2026.
Scope of Contract: The contract work locations are located primarily within the City and County of San Francisco, including Y erba Buena Island, Treasure Island and occasionally in San Francisco Public Utilities Commission ( SFPUC) easements or properties on the Peninsula and in the East Bay.
The contract work consists of as-needed street and pavement restoration on short notice at locations to be determined within the City and County of San Francisco, and occasionally on easements or properties on the Peninsula or East Bay, including as-needed pavement restoration for excavations in the public right-of way and replacement of existing pavement adjacent to excavations performed under DPW Order No. 18005. Excavations in the public right-of-way include those associated with water service installation, meter and meter box installation/adjustment, curb ramp construction, pipe leaks, and main breaks.

As-Needed Paving (FY 21-24), to A. Ruiz Construction Co. & Assoc., Inc., in the amount of $13,857,000 and with a contract duration of 1,095 consecutive calendar days.
Modification Nos. 1- 2: Staff issued Modification Nos. 1- 2 increasing the contract amount by $1,385,700 and increasing the contract duration by 109 calendar days, within the original 10% contract cost and duration contingencies, for work exceeding the original projected estimated quantities for a total revised contract amount of $15,242,700 and a revised contract duration of 1,204 consecutive calendar days.
Modification No. 3: On June 25, 2024, by Resolution No. 24- 0145, this Commission approved an increase of $3,963,881 to the existing cost contingency and an increase of 79 calendar days to duration contingency, for a total revised cost limit of $19,206,581 and a total revised duration limit of 1,283 calendar days, and staff issued Modification No. 3 increasing the contract consistent with the contingency limits.
Recommended Increase to Cost and Duration Contingency: Staff recommends the Commission approve an increase of $1,578,919 to the existing cost contingency and an increase of 542 calendar days to the existing duration contingency, for a revised contract cost limit of $20,785,500 and a revised duration contingency of 1,825 calendar days.

WHEREAS, On May 11, 2021, by Resolution No. 21- 0079, this Commission awarded Contract No. WD-2868R, San Francisco Local Water As -Needed Paving (FY 21- 24) to A. Ruiz Construction Company & Associates, Inc.; and
WHEREAS, The original contract amount was for $13,857,000 and the original contract duration was 1,095 consecutive calendar days with a Notice-to-Proceed date of June 22, 2021; and
WHEREAS, Staff issued Modification Nos. 1 and 2, increasing the contract amount by $1,385,700 and increasing the contract duration by 109 calendar days, within the original 10% contract cost and duration contingencies, for a total revised contract amount of $15,242,700 and a revised contract duration of 1,204 consecutive calendar days; and
WHEREAS, On June 25, 2024, by Resolution No. 24-0145, this Commission approved an increase of $3,963,881 to the existing cost contingency and an increase of 79 calendar days to duration contingency, for a total revised cost limit of $19,206,581 and a total revised duration limit of 1,283 calendar days; and
WHEREAS; The contract is essential to repairing streets and sidewalks following main breaks, leaks and ongoing maintenance work; and
WHEREAS, Staff recommends an increase of $1,578,919 to the contract cost contingency and an increase of 542 calendar days to the contract duration contingency to allow the as-needed paving work to continue for the San Francisco Water Department until the SFPUC procures a new as-needed paving contract; and
WHEREAS, Contract Monitoring Division established a Local Business Enterprise (LBE) subcontracting participation of 5% for this contract, and the contractor’s bid committed to 15.86% LBE participation, and this remains unchanged; and
