DEPARTMENT Infrastructure Division AGENDA NO. 12
MEETING DATE December 10, 2024

AGENDA ITEM
Public Utilities Commission
City and County of San Francisco
Calendar: Regular Calendar
Project Manager: Aileen Caylao
Approve Increase to Construction Duration Contingency for Contract No. WW-697, As- Needed Main Sewer Replacement No. 8
Summary of
Proposed
Commission Action:

Approve an increase of 316 calendar days to the duration contingency for Contract No. WW-697, As-Needed Main Sewer Replacement No. 8, with JDB & Sons Construction, Inc., for a revised duration limit of up to 1,811 consecutive calendar days (approximately five years), with no change to contract amount, to allow the contractor additional time to complete contract service orders previously issued.

Background: The San Francisco Public Utilities Commission ( SFPUC) requires contract work to perform as -needed manhole -to-manhole segment main sewer replacements on short notice at locations throughout the City and County of San Francisco, to be determined by SFPUC Wastewater Enterprise staff. The locations of work to be performed and the replacement work itself is determined on an as-needed basis during the contract duration to address any urgently needed main sewer replacement work.

Under San Francisco Administrative Code section 6.64, an as -needed construction contract may be modified up to a five-year total duration and up to 150% of the original contract amount ; no contract service orders may be issued after four years from the date of Controller certification; and no individual contract service order may exceed the Threshold Amount as set by the Controller.

For Contract No. WW -697, the recommended increase to the construction duration contingency would allow for an extension of the contract time to five years, as allowed under Administrative Code section 6.64. The additional time is required to complete work under contract service orders already issued, including time required for coordination with Pacific Gas & Electric in one work location. As four years has passed from the date of Controller certification, no new contract service orders will be issued.

On
August 25, 2020, by Resolution No. 20- 0179, this Commission awarded Contract No. WW-697, As-Needed Main Sewer Replacement No. 8, to JDB & Sons Construction, Inc. The original contract amount was $7,373,000 and the original contract duration was 400 consecutive calendar days.

Environmental
Review:

Increasing the duration of this as -needed contract does not constitute a “project” under the California Environmental Quality Act (CEQA) Guidelines Section 15378
because it does not involve any commitment to any specific project that may result in a physical change in the environment. The SFPUC will not issue any task orders for work to be performed under this contract until the proposed work is reviewed and any appropriate environmental review under the CEQA, if required, has been completed.

Local Business
Enterprise
Utilization and Non-
Discrimination in
Contracting:

The Contract Monitoring Division established a 14% Local Business Enterprise (LBE) subcontracting requirement for this contract. The contractor committed to a 21.47% LBE subcontractor participation with its bid submittal, and this amount remains unchanged.
