Hon. President & fellow Commissioners:
SFPUC contracting needs review. Is there real competitive bidding? Are there insiders? Are change order negotiations assuring the best interests of the ratepayers? The agenda of Nov. 12 contains: 1) a change order nearly three and a half times the original contract (item 11), and 2) an increase of 50% (item 10).
Moreover, not infrequently there is one bidder. Also, the same players keep cropping up, and getting change orders that suggest, to this observer, favoritism.
A public agency may act in the best interests of its ratepayers, or it may make work comfortable for itself while shorting ratepayers. Please review agency contracting to ensure fairness to all would-be contractors and lowest cost for ratepayers.

Subject: End to Moratorium on Water Shutoffs
Date: Monday, November 11, 2024 10:07:50 AM
Dear Commissioners,
My name is Ian James, and I am the Community Engagement Manager at GLIDE's Center for Social Justice. I recently saw that there is an item on the agenda for the PUC Commission tomorrow ending the moratorium on water shutoffs. I am writing to express some concerns ahead of the meeting.
Over a decade ago, California was the 1st state in the country to affirm that water is a human right. Particularly now and in the next few years, it is critical that California and San Francisco stay true to our values and protect our most vulnerable residents from harm. As the PUC considers shutting off people's water, I hope that this remains a priority for the department.
Shutting off a person's water can cause real harm to an individual or family and ending this moratorium must be approached with the utmost care. GLIDE serves many low-income families with small children, seniors on fixed income, and people navigating crises of all kinds. We know that people fall behind on their bills for all types of reasons and that losing access to water only exacerbates those issues.
This moratorium, like many other policies, was put into place because of COVID-19, but I want to remind us that people are still struggling to survive in this city even if the pandemic has ended.
In reviewing the presentation for this policy, I did have some questions for the Commission to consider. I hope to call in for public comment but wanted to send an email in case I'm not able to.
1. I saw a reference to communications in languages other than English (for denial letters).
Many members of our community do not speak English. Will the PUC be informing people of a potential water shutoff, in multiple languages?
2. I also wanted to understand the overall communications plan-- how many times will the PUC reach out to a household before shutting off water? And most importantly, will those notices include clear information about the eligibility requirements for exemptions if they are low-income and in the Customer Assistance Program, or experiencing extenuating circumstances? With information about how to then get an exemption if eligible?
3. I understood that the PUC had ended the practice of late payment charges (LPCs). As departments across San Francisco have prioritized moving away from these kinds of regressive practices, I was very surprised to see that these charges would be reinstated.
These kinds of fees have been shown not to incentive paying, but rather criminalize poverty. Why would the PUC prioritize these fees?
4. Finally, Glide's community benefits from important programs like PUC's Customer Assistance Program, and I was relieved to see that program enrollees would be exempted from the shutoffs. I hope that there can be more robust outreach for this program, as I think it's not widely known that this is a resource and there are many more individuals and families who could benefit. It looks like the last time this program was at the Commission several months ago, there was a lot of discussion about the rate of denials and then the rate of those denials being reversed when individuals appeal. Does this Commission know what those denials are based on and why there is a more than 60% reversal rate when the denial is appealed?
Thank you in advance for considering my questions and comments. Access to water is an important issue for our community and I hope that the PUC thinks of those most vulnerable people when reinstating a shutoff policy.
Best,
Ian James

Subject: Today"s PUC Meeting - water shutoffs
Date: Tuesday, November 12, 2024 8:17:35 AM
Dear PUC Commissioners,
I have been informed that water shutoffs are on the agenda for today's PUC meeting. As fresh clean water is an essential need for every family, I worry about the possibility of people who are in debt and too poor to pay water bills being cut off from this essential element.
Californians know that water is a human right that cannot be denied due to poverty. Being poor should not be a recipe for denying San Franciscans their rights.
I have no problem in the water department seeking payment from those who can well afford it and have used the moratorium on water shutoffs to their advantage. However, when the remedy of a shutoff is thought to be the best way to assure payment, there must be clear guideline:
• an ample number of warnings in languages that all can understand must be provided long before the shutoff commences
• Warnings must include at least one direct personal contact with someone fluent in the language of the resident
• Late Payment charges should be eliminated as these unfairly penalize those folks who live paycheck to paycheck and on occasion cannot meet their financial obligations • residents must be informed of all programs at all levels of government that are available to assist those who cannot make their water payments.
We are on the verge of terrifying times for our country. This is no time for compassion to go out the window in SF.
Sincerely,
Richard Girling

Subject: End to Moratorium on Water Shutoffs

Dear Commissioners,
My name is Alisha Zhao, and I am the Policy and Organizing Manager at Compass Family Services. I am writing to express some concerns regarding the end to the moratorium on water shutoffs.
Compass serves many low-income families with small children navigating crises of all kinds. We know that people fall behind on their bills for all types of reasons and that losing access to water only exacerbates those issues.
This moratorium, like many other policies, was put into place because of COVID-19, but I want to remind us that people are still struggling to survive in this city even if the pandemic has ended.
Thank you in advance for considering my concerns. Access to water is an important issue for our community, and I hope that the PUC thinks of those most vulnerable people when reinstating a shutoff policy.
Best,
Alisha

Requesting records and information from SFPUC is unnecessarily onerous. It should be reformed.
Requests made directly, even when invited, are ignored. (My request to [email protected]— ignored.) A request must be made in proper form through NextRequest, an organization that won't help the requester. Forms are ambiguous; the requester does not know when or if a request in proper form has been made. Requester is not instructed on when a response will be forthcoming, or how. (I believe one must register, sign in, and then may get access to what, if anything, has been supplied.)
All this process certainly deters requests--the point. But open records law requires the agency, indeed the employee, to assist the requester in finding the information sought. There should be no process, much less a midwestern separate company acting as a filter and barrier.
Please investigate the records request, and information processes, and reform them to conform with the intent and letter of the law, all in proper pursuit of agency transparency.

Subject: Preparing for drought

Hon. President and Commissioners:
Last Spring a court upheld the state's plan for Tuolumne River water against a strong challenge by BASWSCA and SFPUC. The latter claims that under the state's regime it will lack sufficient water during drought, and that the Bay Area will be severely impacted. Stringent rationing will be required, and incalculable economic impacts will befall.
Please read the court's opinion, which provides a much better statement of positions and likely future, especially at page 52 and beyond.

What are SFPUC's plans? Surely a "where do we go from here" has been outlined. Drought is inevitable. We think it'll be devastating. Making sure that we are prepared, as best possible, and do not stick head in sand or procrastinate, is key. It's your responsibility.

Re: Governance: Commissioners Aren’t Given Real Choices Dear Commissioners,
Key SFPUC prac7g8ffjces are structured such that commissioners aren’t given real choices when asked to approve. Water rates and the financial plan are important examples. Water rates are typically reviewed in the spring, months a7g$$2er commissioners approve the financial plan even though the financial plan is a primary driver of rates. The approval is a approve/not approve choice as opposed to commissioners being able to provide guidance and direc7g8ffjon.
The financial planning process has the same problem. A primary concern of your
2.7 million cons7g8ffjtuents is water rates. The biggest drivers of water rates are financial plans and demand. However commissioners first see the financial plan a7g$$2er staff has completed their months of internal processes. Today you have no idea of the scale of the financial plans that will be submi7g82jed for your approval and no idea of the impact they might have on water rates. Will it be a con7g8ffjnua7g8ffjon of the massive $11.8 billion dollar 10 year capital plan that shot up projected water rates and affordability risk? Today you don’t know.

January: Plan First presented to commissioners
February: Approved by commissioners
March: Provided to mayor

Internal Plan Development is a Black Box:
No Commission Guidance on Water Rate Impacts
No Commission Guidance on Demand Assumptions
No Commission Guidance on Use of Debt
No Information on How Major Factors Affect Rates
Time absorbed with the
City’s Approval Process
And when you do learn about the financial plans in January, it will be too late for making major changes. And your only choice will be to approve or not approve. If you choose to not approve, for other than minor tweaks staff doesn’t have enough 7g8ffjme to make changes and provide a revised plan without missing the City’s approval 7g8ffjmeline. Hence it is difficult for commissioners to not approve the financial plans.
Commissioners not being given real choices may have contributed to former Commissioner Maxwell resigning a7g$$2er commissioners had to approve last year’s financial plans, which caused projected 2040’s wholesale water rates to jump $400 from the prior year’s projec7g8ffjon
1. Commissioner Maxwell held seat 2 which
covered ratepayer or consumer advocacy.
A be7g82jer process would be for staff to have a planning and goals discussion with commissioners at the start of the process. The discussion could set goals and targets for water rates, use of debt, underlying demand assump7g8ffjons, infrastructure investment and spending targets. The materials could include a review of how these key items relate to each other, such as how an addi7g8ffjonal $1 billion invested in infrastructure would cause rates to increase by x or y depending on the level of debt used.
