Summary of Proposed
Commission Action:

Approve an increase of $350,000 to the cost contingency and an increase of 140 calendar days to the duration contingency for Contract No. WW- 719A, Folsom Area Stormwater Improvements – SOMA and Mission Districts Sewer Replacement , with Mitchell Engineering, for a revised cost limit of up to $8,624,245 and a revised duration limit to 697 consecutive calendar days (approximately one year and ten months), due to a safety work stoppage and investigation after the Contractor damaged the MUNI overhead catenary wires on 11th Street, multiple demobilizations and remobilizations to accommodate Special Event street fair closures on 11th Street, cost overruns on a brick sewer repair, and due to an unforeseen conflict with an unidentified drainage pipe, with no change to the locations or alignments of work.

Background: The low -lying Inner Mission neighborhood surrounding 17 th, 18 th and Folsom Streets historically has been subject to flooding during moderate to heavy storms. The Folsom Area Stormwater Improvements Project will increase collection system capacity and reduce the risk of flooding by constructing and upsizing sewer pipes and boxes, as well as constructing a new stormwater tunnel. The San Francisco Public Utilities Commission (SFPUC) will implement the project through four separate contracts, the first of which is this Contract No. WW-719A, Folsom Area Stormwater Improvements –
SOMA and Mission Districts Sewer
Replacement.

On May 9, 2023, by Resolution No. 23-0096, this Commission awarded the contract to Mitchell Engineering , in the amount of $7,522,041 and with a duration of 365 consecutive calendar days.

On September 26, 2023, by Resolution No. 23-0177, this Commission corrected Resolution No. 23-0096 as to the contract duration to add 60 Agenda Title: WW-719A, Folsom Area Stormwater Improvements – SOMA and Mission Districts Sewer Replacement Commission Meeting Date: January 28, 2025

consecutive calendar days to Final Completion that was accidentally omitted, for a total contract duration of 425 consecutive calendar days.

On May 28, 2024, by Resolution No. 24-0122, this Commission approved an increase of 90 calendar days to the duration contingency, for a total duration limit of up to 557 consecutive calendar days , due to the discovery of unforeseen conflicts in the field.

Scope of Contract: The contract work location(s) are in various locations around the SOMA and Mission Districts in San Francisco, CA, with major work on Folsom Street, 11th Street, Alabama Street, Mistral Street, Erie Street, and 19 th Street.

The contract work consists of:
• Upsizing existing sewers;
• Replacing sewer laterals and associated appurtenances; • Replacing existing sewer manholes; and
• Installing new sewer manholes.

Modifications to the
Contract:

Modification 1 : Effective September 26, 2023, in accordance with Resolution No. 23-0177, the SFPUC issued Modification 1 to include the 60-calendar day duration of Final Completion, which was accidentally omitted from the original contract award resolution , with no change to the contract amount.

Modification 2: Effective May 28, 2024, in accordance with Resolution No. 24-0122, the SFPUC issued Modification 2 to increase the contract duration by 90 consecutive calendar days, due to unforeseen field conditions with a conflicting 3rd party facility and delays in construction submittals/procurement, for a total contract duration of 515 consecutive calendar days.

Recommended Increase to Contract Cost and Duration
Contingency: Staff recommends the Commission approve an increase to the cost contingency by $350,000 and an increase to the duration contingency by 140 calendar days , due to an extended safety work stoppage and investigation after the Contractor damaged the MUNI overhead catenary wires on 11 th Street, multiple demobilizations and remobilizations to accommodate Special Event street fair closures on 11th Street, cost overruns on a brick sewer repair, and due to a n unforeseen conflict with an unidentified drainage pipe , with no change to the locations or alignments of work, for a new cost limit up to $8,624,245 and a new duration limit up to 697 consecutive calendar days.
