Approve Increase to Duration Contingency for Contract No. WW-628, Southeast Water Pollution Control Plant New Headworks Facility

Summary of Proposed
Commission Action:

Approve an increase of 212 cal endar days to the duration contingency for Contract No. WW-628, Southeast Water Pollution Control Plant New Headworks Facility , with Sundt-Walsh Joint Venture (Construction Manager/General Contractor or CM/GC) , for a revised duration limit of up to 3,516 consecutive calendar days, with no change to the contract amount of $570,380,175, to complete the remaining contract work, and add new scope to demolish the existing all -weather Headworks (SEP 012) , which is no longer needed, as the New Headworks Facility is fully operational.

Background: The San Francisco Public Utilities Commission (SFPUC) Wastewater Enterprise Headworks facility is one of the most odorous treatment processes in the wastewater stream. It contains critical solids removal equipment, such as fine screens, grit removal, and o
dor control systems. The existing fine
screening and grit removal processes are inefficient and significantly impact the performance of downstream processes at Southeast Water Pollution Control Plant (SEP). Upgrading these systems with a new Headworks facility will improve the downstream treatment processes and protect the existing and new equipment from damage caused by debris such as rags, sand, and abrasive grit.

On May 24, 2016, by Resolution No. 16- 0099, this Commission awarded Construction Manager/General Contractor (CM/GC) Contract No. WW-628, Southeast Water Pollution Control Plant New Headworks Facility. The original contract amount was $244,562,224, and the original contract duration was 2,658 consecutive calendar days.

On February 28, 2017, by Resolution No. 17-0043, this Commission adopted the CEQA Findings, including the Final Mitigated Negative Declaration (FMND), and the Mitigation Monitoring and Reporting Program, and approved the Headworks Project and authorized th e General Manager to proceed with construction of the project under Contract No. WW -628; and approved Modification No. 1 increasing the contract amount by $11,600,000 for a total contract amount of $256,162,224, with no change to the contract duration.

On December 11, 2018, by Resolution No. 18 -0208, this Commission Agenda Title: WW-628, Southeast Water Pollution Control Plant New Headworks Facility Commission Meeting Date: May 13, 2025

approved Modification No. 2 increasing the contract amount by $36,017,960 for a total contract amount of $292,180,184, with no change to the contract duration, and increasing the cost contingency by $18,630,619, for a total cost limit of up to $335,267,025 and increasing the duration contingency by 75 calendar days, for a revised duration limit of up to 2,936 consecutive calendar days.

On December 22, 2020, by Resolution No. 20-0249, this Commission approved Modification No. 3 increasing the contract amount by $106,321,923, for a total c ontract amount of $ 398,502,107, and increasing the contract duration by 111 consecutive calendar days, for a total contract duration of 2,769 consecutive calendar days.

On March 9, 2021, by Resolution No. 21-0041, this Commission approved Modification No. 4 increasing the contract amount by $91,749,642, for a total contract amount of $490,251,749, with no change to the contract duration.

On October 24, 2022, by Resolution No. 22-0184, this Commission approved Modification No. 5 increasing the contract amount by $58,572,067, for a total contract amount of $548,823,816, with no change to the contract duration, and decreasing the cost contingency by $40,530,482, for a total cost limit of up to $555,380,175.

On March 26, 2024, by Resolution No. 24-0078, this Commission approved Modification No. 6 increasing the contract amount by $7,158,234 for a total contract amount of $555,982,050, with no change to the contract duration, and increasing the cost contingency by $7,841,766 for a total cost contingency of $14,398,125 and a total cost limit of up to $570,380,175 and increasing the duration contingency by 257 calendar days, for a total revised duration limit of up to 3,304 consecutive calendar days.

The CM/GC has accomplished the following milestones:

• Scope I – Site Preparation (100% complete)
• Scope II – Bruce Flynn Pump Station Improvements (100% complete)

Modifications to the
Contract:

Modification Nos. 1 -6: This Commission approved Modifications 1 -6, in accordance with Resolution Nos. 17-0043, 18-0208, 20-0249, 21-0041, 22- 0184, 24-0078, increasing the contract amount by $311,419,826, for a total contract amount of $555,982,050, and increasing the contract duration by 553 consecutive calendar says, for a total contract duration of 3,211 consecutive calendar days.

Modification N
o. 7: Effective August 20, 2024, the SFPUC modified the Contract within the approved contingency and increased the contract amount by $14,398,125 for a total contract amount of $570,380,175.

Recommended Increase to Duration Contingency: S taff recommends the Commission approve an additional duration contingency of 212 calendar days, for a new total c ontract duration limit of 3,516 consecutive calendar days, with no change in c ontract amount of $570,380,175, to complete the remaining contract work, and add new scope to demolish the existing all - weather Headworks (SEP 012), which is no longer needed, as the New Headworks Facility is fully operational as of August 5, 2024. The cost associated with demolition of existing all-weather Headworks is estimated to be $6,900,000 including contingency. The remaining contract amount to-date from approved Modification No. 7 is $5,470,000. The delta of $1,430,000 is anticipated to be funded from unused allowances from approved trade packages of Scope III. Therefore, no contract amount increase is needed as the existing $570,380,175 that was previously approved by the Commission under Resolution No. 24-0078 is sufficient to complete all work.
