Subject: Request for Investigation into the Closure of the Pierce Street Outfall Date: Monday, May 12, 2025 9:35:46 AM
Dear Commissioners,
We are a group of residents in the Marina District who have come together out of concern for our neighborhood’s safety and the City’s decision to close the Pierce Street outfall in May 2021. Many in the Marina experienced sewage overflow, property damage, and distress as a result of the closure. Some are now part of ongoing litigation but many are not. All of us share the same goal: a solution for a safer future for our community.

In our recent newsletter, we published information from record requests. There is a full timeline, source documents, and environmental modeling that raise serious questions about how this decision was handled. You can view it here: https://mailchi.mp/8684f12e50b1/city- closes-pierce-st-outfall-14052929
Public records now show that these impacts were not unforeseen. In 2017, the Department of Public Works produced internal modeling warning that closure of the Pierce Street outfall would increase flooding in the Marina, particularly during a basic level of service 5-year storm event. That modeling predicted nearly half a foot of untreated sewage backup and yet, this information was not shared with the public. The project was ultimately approved under a CEQA exemption, with little explanation of these foreseeable risks.

Since the outfall was decommissioned, we’ve witnessed sewage and stormwater flooding homes, garages, and streets in ways that were previously unimaginable. For many, the emotional and financial toll has been immense. And yet, despite the scale of the damage, no senior official from the SFPUC has met with impacted residents. Supervisor Stephen Sherill is the only public official who has taken the time to visit and listen.

As Commissioners, you are charged under the San Francisco Charter with managing the city’s water and wastewater systems and have the authority to hold hearings, take testimony, and investigate failures in infrastructure planning and interagency coordination.

In our opinion, SFPUC leadership had an obligation to coordinate with departments such as Public Works, Planning, Recreation and Parks, and the City Attorney’s Office, Supervisor Office and the Mayor's office, especially in the context of a decision with known public health and environmental impacts.

We are asking that you:

1. Investigate the full decision-making process behind the closure of the Pierce Street outfall;

2. Review the interdepartmental communication between the SFPUC, Rec and Parks, City Attorney's office, DPW, Planning Department, District 2 Supervisor's office and the Mayor’s Office from the date of the first discussions to abandon the Pierce St outfall to present.

3. Examine whether the use of a CEQA exemption was appropriate given the known flooding risks;

4. Hold a public hearing and take testimony from residents. This has not occurred to date.

You have taken an oath to uphold the Constitution and to faithfully discharge your duties. That includes protecting communities from avoidable harm, acting with transparency, and responding when mistakes have been made. To date, residents have not been supported.

Please note: This letter is submitted as part of a public record on behalf of The Marina 94123.

It does not waive any individual legal rights or claims related to current or future litigation.

We ask for your leadership — and for your presence.

Sincerely,
The Marina 94123
A Coalition of Marina Residents.

Commissioners —
Attached is my letter with comments for tomorrow’s (5/13) SFPUC meeting.

This relates to Item 5A on your agenda, the Climate Action Plan update.

Please confirm receipt of this letter

Re: Item 5A – Climate Action Plan Update
Tuesday May 13, 2025 – Regular Meeting SFPUC
Commissioners –
Thank you for your work in helping implement San Francisco’s Climate Action Plan. You have a crucial role to play in this city’s future.

I fully support your ‘Roadmap to net-zero by 2040’, and am encouraged by the breadth of the areas you’re addressing, including:
 Water Supply
 Healthy Ecosystems
 Buildings
 Energy Supply
 Transportation
3 So far, I do not think the City of San Francisco has moved quickly and efficiently enough in addressing climate change. We are not on-track to meet our original goal of cutting GHGs in half by 2030. But your plan not only picks up the pace but sets out a clear timeline for achieving net-zero.

I urge you to continue to assert your agenda and to share your goals with San Franciscans. Public awareness will lead to great public support. And there is no more important work in this city that the climate action plan.

Special thanks to Commissioner Avni Jamdar for her outreach to the climate action advocates.

Regards,
Dave Rhody – 1594 45th Ave., SF, CA 94122

Hi SFPUC Commission,

I wanted to introduce myself and Fonroche Lighting. We’ve been partnering with many neighboring cities to bring autonomous, reliable solar lighting solutions to streets, parking lots, parks, and trails — and I’d love the opportunity to connect with San Francisco as well.

I understand from my recent attendance at the CALSLA conference 4/24 that the city is moving away from PG&E to take back control of your utilities!

I’ll be in the area May 27
th – 29th, meeting with nearby municipalities. If your schedule allows, I’d be happy to stop by and meet with you or someone from your team to explore how solar lighting can support your current and upcoming infrastructure goals.

A bit about Fonroche:

We’re the world’s largest solar lighting manufacturer, known for delivering the most reliable all-night, off-grid lighting systems on the market.

Our systems are maintenance-free for 10–12 years, even in winter climates, and are custom-designed for each site.

Units typically range from $3K–$5K, depending on project requirements.

We’re the only solar lighting solution approved for permanent use in cities like Los Angeles, Fort Worth, San Antonio, and more.

I’d love to share how we can help you reduce energy costs, eliminate trenching and grid dependency, and meet long-term sustainability goals — all with no compromise on performance.

Would you be available to meet on May 27
th-29th? I’m flexible and happy to work around
your schedule.

Looking forward to the conversation!

Best,

Ryan Lortie

Heavily influenced by nature and minerals, the design
of the NEW ART lantern for solar-powered streetlights

technological edge.

10 Inspired by ‘traditional’ lighting, the BELLE EPOQUE lantern is a nod to days gone by. By turning this lantern upside down, we have brought it up to date, giving it a robust and solid appearance while retaining its refined, distinctive shape.

BELLE EPOQUE is a stylish street light that fits in perfectly with traditional urban and architectural spaces, such
as town squares, plazas and roads. The shape of the
mounting arm and the way in which the lantern is
attached gives the impression that the light is suspended in mid-air, which lightens the overall structure.

roads, town squares, parks and trails, etc.

We’re redeveloping the parking lot at 241 Loomis St. and proposing a new water and sewer connection for a new modular building. Water and sewer are available nearby for the connections.

We do not have experience with permitting water and sewer connections in San Francisco, so any requirements or forms unique to the City that are not listed in the 2022 plumbing code that you can direct me to would be greatly appreciated.

Thank you,

Kevin Petri
