Subject: Closeout for WW-648 – Oceanside Water Pollution Control Plant Building 042 Primary Clarifier Improvements

The Contract Monitoring Division (“CMD”) has determined that Cal State Constructors , Inc. (“CSC”), the LBE prime contractor, has complied with the LBE subcontracting requirements associated with this project.

At the time the project was advertised, an LBE subcontracting participation requirement of

15.00% was established. CSC was awarded the contract in the amount of $6,490,014.00 . At closeout, the final contract amount is $ 6,681,199.75. CSC’s LBE subcontracting participation is as follows:

* LBE Subcontractors are eligible to receive LBE participation for Specially Manufactured Items (“SMI”) at 5% for the purchase of the SMI and 100% credit for the installation of the SMI. Per US Electric’s CMD Form 6, the LBE subcontractor will purchase $200,000.00 of specially manufactured items from Tesco Control. US Electric is eligible for SMI credit at 5% of $200,000, which is $10,000; plus 100% of the installation cost which is $194,000; making the total LBE participation credit for US Electric $204,000 as reflected above.

The LBE participation for some subcontractors were impacted by, according to the Prime and confirmed by CMD Certification Unit, E. Mitchell went out of business due to the owner’s retirement during the contract term, which impacted E. Mitchell’s overall LBE participation.

In addition, Watertight Restoration’s scope fell short for the following reasons. Per SFPUC staff, the concrete repair was on an as -needed basis, and Watertight Restoration was provided the maximum available amount of work. During the project, City Engineers found more steel corrosion than expected, increasing MC Metal’s workload.

To recover and maximize the LBE subcontracting participation on this project, CSC increased the listed subcontractors - US Electric and MC Metal participation to make up for the individual short fall of the overall project.

As a result, CSC’s made good faith efforts to meet its LBE participation commitment at a final closeout percentage of achieving 29.26% instead of 29.39%.

Based on the foregoing, CMD concurs with the closeout of this contract . Should you have any questions, please do not hesitate to contact me at [email protected].
