Award Job Order Contract No. JOC-113, Electrical (C -10 License) Construction, San Francisco, San Mateo, Santa Clara, and Alameda Counties

Summary of Proposed
Commission Action:

Award Job Order Contract No. JOC-113, Electrical (C -10 License) Construction, San Francisco, San Mateo, Santa Clara, and Alameda Counties , in the amount not-to-exceed $5,000,000, with a guaranteed minimum task order opportunity amount of $50,000, and a duration of four years, to the responsible bidder that submitted the lowest responsive bid, Liffey Electric, Inc., to perform C-10 licensed electrical construction work on San Francisco Public Utilities Commission systems and operations around the Bay Area.

Background: A Job Order Contract (JOC) is an indefinite quantity contract that enables the San Francisco Public Utilities Commission (SFPUC) to complete tasks quickly and efficiently on an as -
needed basis under a single, competitively bid
construction contract using published pre -set unit price s. The competitive process is based on Adjustment Factors, which are the contractor’s mark-ups (overhead and profit) for when and where the work will be performed (regular time, overtime, and county). For example, a bidder might bid a lower mark-up for regular hours in San Francisco than for counties further away that require additional travel time.

Staff multiplies the Adjustment Factors by each bid line item and adds all the line items together to calculate the Award Criteria Figure. Upon review by the Contract Monitoring Division, the Award Criteria Figure may be modified by application of the Local Business Enterprise (LBE) bid discount. SFPUC staff then uses the Award Criteria Figure, as may be adjusted by the LBE bid discount, to compare the bids and determine the apparent low bidder.

The SFPUC has used Job Order Contracts for a wide range of construction activities including general building construction and general engineering construction, specialized electrical work in power turbines and switchyards, spot sewer repair, marine related services, lighting upgrades, repair of heating, ventilation, and air conditioning systems, and energy efficiency retrofits.

The SFPUC will issue task orders to the selected contractor to perform specific scopes of work during the term of this contract. Each task order is priced based on pre-set unit prices, as published with the Advertisement for Bids, multiplied by the appropriate Adjustment Factor from the contractor’s bid.

3. Anvil Power, Inc. 1.3953 Not Eligible 1.3953 2

Application of bid discount in accordance with Chapter 14B of the San Francisco Administrative Code did not change the final ranking of the low bidder.

The SFPUC rejected the bid submitted by U.S Electric Technologies, Inc., because U.S. Electric is not eligible for award of this JOC contract under San Francisco Administrative Code Chapter 6; U.S. Electric currently holds an active JOC contract with the SFPUC. Administrative Code Section 6.62(j) provides that a contractor who enters into a JOC contract with a particular City department is not eligible during the term of such JOC contract to submit a bid on a subsequent JOC c ontract advertised by the same contracting department, except in the following circumstances: (1) the c ontractor's existing JOC contract will expire in 120 days or fewer; (2) the contracting department has issued task orders valued by the City in an amount equal to or exceeding 90% of the maximum dollar amount of the existing JOC c ontract; or (3) the subsequent JOC contract is funded by a different source of government funds (e.g., Federal, State, Local) than the funding source used for the existing JOC contract. None of the exceptions apply in this circumstance.

After thorough investigation, the SFPUC and CMD determined that the second apparent low bidder, Liffey Electric, Inc., met the minimum qualifications and Chapter 14B of the San Francisco Administrative Code and determined that Liffey Electric , Inc., was the responsible bidder that submitted the lowest responsive bid.

Protest: On July 3, 2025, U.S. Electric Technologies, Inc., submitted a protest letter in response to the City’s non- responsive determination, which found the firm ineligible for award of the JOC contract pursuant to San Francisco Administrative Code Chapter 6.62(j). After reviewing the protest, the Contract Admin
istration Bureau, in consultation with the City Attorney, upheld the determination and issued a final response letter on August 22, 2025.

Environmental
Review:

Award of this Job Order Contract does not constitute a “project” under the California Environmental Quality Act (CEQA) Guidelines s ection 15378 because it does not involve commitment to any specific project that may result in a physical change in the environment. Staff will not authorize the contractor Agenda Title: JOC-113, Electrical (C-10 License) Construction, San Francisco, San Mateo, Santa Clara, and Alameda Counties

to commence any work under this contract until the proposed work is reviewed and any appropriate environmental review under the CEQA, if required, has been completed.

Local Business
Enterprise Utilization
and Non-
Discrimination in
Contracting:

The Contract Monitoring Division (CMD) established a 12% Local Business Enterprise (LBE) subcontracting requirement for this contract. Liffey Electric, Inc., committed to a 12% LBE subcontractor participation in its bid submittal.
