Award Contract No. PW-008R Moscone West Solar

Summary of Proposed
Commission Action:

Award Contract No. PW-008R Moscone West Solar to the responsible bidder that submitted the lowest responsive bid, Albion Power Company, Inc., in the amount of $4,293,002 and with a duration of 240 consecutive calendar days (approximately eight months) t o construct a rooftop solar electric system (837 kW/DC) located at 800 Howard Street, San Francisco, 94103. This action constitutes the Approval Action for the Project for the purposes of the California Environmental Quality Act (CEQA), pursuant to San Francisco Administrative Code Section 31.04(h). The Sa n Francisco
Planning Department has determined that the Project is exempt from the CEQA. The Commission will rely on the determination to make its decision on this action.

Background: The San Francisco Public Utilities Commission ( SFPUC) Power Enterprise currently owns and operates a portfolio of renewable energy generation assets with 30 project locations and a capacity of 3.5 MW. Power has identified a new solar electric project opportunity at the Moscone West Convention Center and will construct an 837 kW/DC photovoltaic (PV) System. The PV system will be owned and operated by the SFPUC Power Enterprise and will support San Francisco’s ongoing climate action priorities by providing additional in-city renewable power generation.

Scope of Contract: The contract work location is M oscone West Convention Center – 800 Howard Street, San Francisco, CA 94103.

The contract work consists of constructing a turnkey rooftop 837 kW/DC c PV system at Moscone West Convention Center to be owned and operated by the SFPUC Power Enterprise. The contractor will provide all material and labor to construct a fully operational solar electric system , in conformance with the plans and specifications provided by the SFPUC.

Because the SFPUC anticipates that potential unforeseen conditions or other factors outside of the contractor’s control may impact the schedule, Staff included a requirement in the Advertisement for Bids for bidders to provide a daily compensable time extension rate. At the bid opening, Staff announced that SFPUC would use the value of 10 days to calculate the Compensable Delay bid adjustment amount. Staff used the daily rate from the bids to determine the total Compensable Delay values shown in the table a bove by multiplying the bidder’s daily rate times 10. The Adjusted Bid value in the table above is the sum of the Base Bid and Compensable Delay less any applicable LBE bid discounts. Staff used the Adjusted Bid value to compare and rank the bids to determine the lowest bidder. However, the contract award amount is the Base Bid value (not the Adjusted Bid value) and, if the Commission awards the contract, the bidder’s daily compensable delay rate will become a term of the contract.

Application of bid preferences in accordance with Chapter 14B of the San Francisco Administrative Code did not change the final ranking of the low bidder.

Protest and Rejection of Bid : On December 9, 2025, Albion Power Company, Inc., protested the bid submitted by Acosta and Daughters LLC.

The basis for the protest was Acosta and Daughters’ failure to submit a proper Agenda Title: PW-008R Moscone West Solar

bid bond which, under applicable law, is a nonwaivable bid defect. The SFPUC provided Acosta and Daughters an opportunity to respond to the protest and Acosta and Daughters did not do so within the time prescribed or at all. SFPUC staff reviewed the relevant documentation and determined that the Acosta and Daughters’ bid bond was defective because it was issued to a different corporate entity. On January 13, 2026, the SFPUC rejected as nonresponsive the bid submitted by Acosta and Daughters. Following that determination, staff determined that Albion Power Company is the responsible bidder that submitted the lowest responsive bid.
