Background: A Job Order Contract (JOC) is an indefinite quantity contract that enables the San Francisco Public Utilities Commission (SFPUC) to complete tasks quickly and efficiently on an as -needed basis under a single, competitively bid construction contract using published pre-set unit prices.

The SFPUC has used Job Order Contracts for a wide range of construction activities including general building construction and general engineering construction, specialized electrical work in power turbines and switchyards, spot sewer repair, marine related services, lighting upgrades, repair of heating, ventilation, air conditioning systems, and energy efficiency retrofits.

The current not -to-exceed amount of this contract is $5,000,000.

Under San Francisco Administrative Code section 6.62, the Commission may increase the maximum value for JOC contracts by up to 150% of the original contract value (an additional $2,500,000) for a total potential maximum contract amount of up to $7,500,000.

The original duration of this contract is two years . Under San Francisco Administrative Code section 6.62, the Commission may extend the term of JOC contracts up to five years. The SFPUC may not issue any new task orders under this contract after four years from the date the Controller certifies this contract.

On June 25, 2024 , by Resolution No. 24 -0142, the Commission awarded Job Order Contract No. JOC -105, General Building (B License) Construction, San Francisco, San Mateo, Santa Clara, Agenda Title: JOC-105, General Building (B License) Construction, San Francisco, San Mateo, Santa Clara, and Alameda Counties

Per Rubecon’s submissions and communications, and as confirmed by SFPUC, the following LBEs show 0.00% participation to date because their listed scopes of work have not yet been issued or released by SFPUC: Baird Trucking Inc., BBJ Electric Inc., San Francisco Power, Value Fire Protection Inc., and Watertight Restoration Inc.

Further, Rubecon was informed that Total Traffic Control, Inc. (TTCI) has ceased business operations. As a result, Rubecon must either substitute TTCI with another LBE firm certified to perform traffic control work or increase the participation of an existing LBE to offset the potential shortfall and demonstrate good faith efforts. Accordingly, Rubecon is increasing ABCO Mechanical Contractors Inc.’s participation to 2.00% to account for the 1% commitment previously allocated to TTCI.

Furthermore, the other LBE subcontractors — Ground Control Inc, Priority Architectural Graphics, and San Francisco Roofing Services Inc — were given all available work as of date.

In a letter dated June 17, 2025, Larratt Bros. Plumbing, Inc. (“Larratt”) declined to perform work under Task Order No. 3 for JOC‑105 due to the proximity of the project location. Rubecon is required to make good‑faith efforts to utilize LBEs for any scopes of work, or portions thereof, that can reasonably be subcontracted throughout the life of the agreement. In line with this requirement, and as part of its good‑faith efforts, Rubecon substituted Larratt with another LBE plumbing subcontractor, Bacon Plumbing Co., Inc., to ensure that the work performed under Task Order No. 3 would continue to receive LBE credit. Additionally, Rubecon added two more LBE subcontractors—Anco Iron & Construction and Arborist Now, Inc. — to perform new scopes of work on this contract, as noted in the table above.

Moreover, Rubecon confirmed that it will remain committed to assigning work that may arise from future task orders to its original listed LBE subcontractors. Rubecon informed the CMD that it anticipates meeting its 38.60% LBE subcontracting participation requirement SFPUC releases sufficient task orders to support all projected LBE participation, as follows:

Going forward, in order to ensure compliance with the Chapter 14B post-award requirements, SFPUC staff and Rubecon will continue to notify and obtain CMD approval for any proposed subcontractor additions and/or substitutions throughout the term of this contract as well as any changes to the scope of work and the information provided to CMD. CMD will review this information to determine and facilitate progress towards the project’s LBE subcontracting commitment. Contingent upon the conditions set forth above, CMD approves this modification.

Should you have any questions and/or concerns regarding the above, I can be reached at [email protected].
