RE: Written demand under California Government Code § 54960.1 to cure or correct action concerning the chairmanship of the Power Subcommittee of the SFPUC Citizens' Advisory Committee.
─────────────────────────────────────────────────────────────── ───────
1. THIS IS A DEMAND UNDER GOVERNMENT CODE § 54960.1.
This letter is a written demand, pursuant to California Government Code 2 § 54960.1, that the San Francisco Public Utilities Commission Citizens' Advisory Committee cure or correct the action described below, which I allege was taken in violation of the Ralph M. Brown Act, California Government Code §§ 54950–54963.
Government Code § 54960.1(a) provides that "any interested person may commence an action by mandamus or injunction for the purpose of obtaining a judicial determination that an action taken by a legislative body of a local agency in violation of Section 54953, 54954.2, 54954.5, 54954.6, 54956, or 54956.5 is null and void." Government Code § 54960.1(b) requires that the demand "be in writing and clearly describe the challenged action of the legislative body and nature of the alleged violation." This letter satisfies that requirement.
The Committee is a "legislative body" within the meaning of Government Code § 54952(b), which defines that term to include "a commission, committee, board, or other body of a local agency, whether permanent or temporary, decisionmaking or advisory, created by charter, ordinance, resolution, or formal action of a legislative body." The Committee was created by ordinance — San Francisco Administrative Code, Article XV, §§ 5.140–5.142 — and its subcommittees are likewise subject to the Brown Act.
2. THE CHALLENGED ACTION.
I am the District 6 appointee to the Committee. As reflected in the Committee's published Power Subcommittee agenda for April 14, 2026, I served as Chair of the Committee's Power Subcommittee.
The Committee held a special meeting of the full Committee on April 28, 2026; the published agenda for that meeting is captioned "Special Meeting Agenda." That agenda listed, under Item 4 ("Report from the Chair"), a sub-item captioned "Subcommittee Chair Appointments." The draft minutes of that meeting record that, under that item, the Committee Chair announced the appointment of Erin Roach as Wastewater Subcommittee Chair and of Aaron Hebert as Water Subcommittee Chair. I was absent from that meeting; the draft minutes list me by name among the absent members.
I have since been removed as Chair of the Power Subcommittee.
To the extent the Committee, acting as a legislative body, took action at or in connection with its April 28, 2026 special meeting — or at any other time — to remove, replace, vacate, or reassign the Chair of the Power Subcommittee, that action is the action I challenge by this demand.
3. THE BROWN ACT VIOLATION.
The April 28, 2026 meeting was a SPECIAL meeting of the Committee.
Special meetings of a legislative body are governed by California 3 Government Code § 54956, which provides that "[t]he call and notice shall specify the time and place of the special meeting and the business to be transacted or discussed," and that "[n]o other business shall be considered at these meetings by the legislative body."
The notice for the April 28, 2026 special meeting described the relevant item only as "Subcommittee Chair Appointments," a sub-bullet of "Report from the Chair." That description did not specify that a sitting subcommittee chair would be removed, and did not identify the Power Subcommittee. A member of the public reading that notice could not reasonably have understood that the chairmanship of the Power Subcommittee was a subject of business at the meeting.
Accordingly, to the extent the Committee removed, replaced, vacated, or reassigned the Power Subcommittee Chair at the April 28, 2026 special meeting, it did so on business not specified in the call and notice as § 54956 requires, and/or it considered "other business" that § 54956 forbids — in either case in violation of Government Code § 54956.
In the alternative, to the extent any such action was instead taken at a REGULAR meeting of the Committee, California Government Code § 54954.2(a) required that the posted agenda contain "a brief general description of each item of business to be transacted or discussed at the meeting," and provides that "[n]o action or discussion shall be undertaken on any item not appearing on the posted agenda." The description "Subcommittee Chair Appointments" did not adequately describe the removal of a sitting subcommittee chair, and any such action would therefore violate § 54954.2.
In the further alternative, to the extent any such action was taken outside of a properly noticed open meeting of the Committee, it was taken in violation of California Government Code § 54953(a), which provides that "[a]ll meetings of the legislative body of a local agency shall be open and public, and all persons shall be permitted to attend any meeting of the legislative body of a local agency," and of §§ 54954.2 and 54956, which bar action on business not noticed to the public.
4. THE CURE OR CORRECTION DEMANDED.
I demand that the Committee cure or correct the challenged action by taking all of the following steps:
(a) Rescind, and declare null and void, any action removing, replacing, vacating, or reassigning the Chair of the Power Subcommittee that was taken at or in connection with the April 28, 2026 special meeting, or otherwise taken outside a properly noticed open meeting of the Committee;
(b) Restore the status quo as to the Power Subcommittee chairmanship pending any properly noticed action;
4 (c) If the Committee wishes to make any change to the Power Subcommittee chairmanship, place that specific matter on the agenda of a future meeting of the full Committee with a description that specifically identifies (i) the Power Subcommittee, (ii) that a change in its chairmanship is proposed, and (iii) the nature of the proposed action — so that the public and the affected member receive the notice that § 54956 (for a special meeting) or § 54954.2 (for a regular meeting) requires; and
(d) Take any such action only in open session, on the noticed agenda, with the affected member afforded notice and a meaningful opportunity to be heard.
5. TIMELINESS AND STATUTORY DEADLINES.
This demand is timely. Government Code § 54960.1(c) provides that the written demand "shall be made within 90 days from the date the action was taken unless the action was taken in an open session but in violation of Section 54954.2, in which case the written demand shall be made within 30 days from the date the action was taken." Because the April 28, 2026 meeting was a SPECIAL meeting governed by § 54956, the 90-day period applies. To the extent any portion of the challenged action is instead characterized as having occurred at a regular meeting in violation of § 54954.2, this demand is also made within the 30-day period. It is therefore timely under either characterization.
Under Government Code § 54960.1(e), the Committee has 30 days from its receipt of this demand within which to cure or correct the challenged action, or to inform me in writing that it will not do so. If the Committee fails to cure or correct, and fails to so inform me, within that 30-day period, I may commence an action under § 54960.1 for a judicial determination that the challenged action is null and void.
6. IF THE COMMITTEE CONTENDS NO BODY ACTION OCCURRED.
If the Committee's position is that no action removing, replacing, or reassigning the Power Subcommittee Chair was taken by the Committee as a legislative body — and that any change resulted solely from a unilateral act of the Committee Chair under San Francisco Administrative Code § 5.141(e) — I request that the Committee state that position in writing and identify (i) the date of the change, (ii) the form of the change, and (iii) the document or communication that effected it. I reserve all rights to address any such unilateral action under the San Francisco Sunshine Ordinance (San Francisco Administrative Code, Chapter 67) and under any other applicable authority.
7. RESERVATION OF RIGHTS.
5 This demand is submitted to preserve the statutory deadlines under § 54960.1(c). It is made without prejudice to, and does not waive, any other remedy available to me, including any complaint to the San Francisco Sunshine Ordinance Task Force and the public-records request currently pending as NextRequest 26-4414. Nothing in this demand concedes that the challenged action was lawful or that any particular factual account is complete. I reserve the right to supplement or amend this demand as records are produced.
8. DELIVERY AND ACKNOWLEDGMENT.
Please direct all correspondence regarding this demand to me at the email address above ([email protected]). I request written acknowledgment of the date on which this demand was received by the Committee.
Respectfully submitted,
Barklee Sanders

SUBJECT: Projected Wholesale Customer Water Purchases from the San Francisco Regional Water System in Compliance with Section 4.05 of the 2021 Amended and Restated Water Supply Agreement between San Francisco and its Wholesale Customers
Dear President Arce,
Section 4.05 of the 2021 Amended and Restated Water Supply Agreement between the City and County of San Francisco and its Wholesale Customers (Agreement) requires the San Francisco Public Utilities Commission (SFPUC) to annually prepare a Water Supply Development Report (Report) for consideration by the Commission each December. The need to report is in effect through December 31, 2028.
The Agreement stipulates that the Bay Area Water Supply and Conservation Agency (BAWSCA) provide the SFPUC with water purchase projections for the Wholesale Customers to be utilized in the Report. These projections are to be submitted by BAWSCA to the Commission in June of each year.
Based on information provided to BAWSCA by its member agencies, the aggregate Wholesale Customer Water Purchases in FY 2027-2028 are currently projected to be 132 MGD.
The enclosed Table 1 summarizes the projected purchases from San Francisco for each Wholesale Customer in FY 2027-2028. This table was prepared using information provided by BAWSCA member agencies.
BAWSCA looks forward to working with your staff as the Report is prepared for the Commission’s consideration this coming December. If you have any questions, please contact Tom Francis, BAWSCA Water Resources Manager, at 510-944-4392 (cell).
Sincerely,
Tom Smegal
