Staff Report – Item 4.2
--------------------------------------------------------------------------------------------------------------------- To: Orange County Power Authority Board of Directors
From: Joe Mosca, Chief Executive Officer
Subject: UPDATES TO POLICY NO. 23, CHANGES TO DEFAULT RATE PRODUCT
POLICY, AND APPROVAL OF CHANGES TO POWER SUPPLY
OPTIONS/DEFAULT RATE PRODUCTS RELATING TO OCPA ENERGY
PROCUREMENT STRATEGY CHANGES
Date: December 6, 2024
---------------------------------------------------------------------------------------------------------------------
RECOMMENDED ACTIONS
1. Approve the reduction of renewable energy content in Smart Choice from 72% to 55% for 2025 and increase it to 60% for 2026, plus 40% carbon-free energy content.
2. Approve revisions to Policy No. 23, Changes to Default Rate Product Policy, relating to power supply options and default rate products; and
3. Pursuant to updated Policy No. 23, authorize the Chief Executive Officer to implement a temporary opt-down for City of Buena Park default rate product customers to Smart Choice for 2025 and 2026.
BACKGROUND
Under OCPA’s Joint Powers Agreement, the Board of Directors has the authority to establish power supply options for OCPA, which must include an option that contains the minimum renewable and GHG-free content required by law. In addition, the Joint Powers Agreement provides that member agencies may select a default rate product for the ratepayers in its jurisdiction. The OCPA Implementation Plan, certified by the California Public Utilities Commission in March 2021, further clarifies that member agencies select a default option into which customers are enrolled at the time service begins.
Under the Joint Powers Agreement, the OCPA Board establishes power supply options for the agency. The Board as the governing body also has authority over all rate-setting. The Joint Powers Agreement does not, however, contain specific requirements for which OCPA power supply options are required to be available as default rate products, other specific terms and conditions for power supply options or default rate products, or a process for changing a default rate product.
In light of this, in March 2023, the OCPA Board of Directors adopted Policy No. 23, Changes to Default Rate Product Policy, to establish procedures, timing, notification, and certain other details related to changes in default rate products.
As discussed with the Board at its special meeting on November 25, 2024, OCPA has followed trends in system energy, resource adequacy (RA), and renewable energy markets that are anticipated to impact OCPA’s strategies for energy risk management, power procurement, rate structure, and customer rate stabilization for 2025 and 2026. Since 2022, the cost of eligible renewable energy (PCC1) has surged by nearly 400%, and RA prices have more than tripled over three years, reflecting unprecedented market volatility. Actual energy costs have increased from $99/MWh in FY22/23 to $121/MWh in FY23/24, with projections reaching $134/MWh in 2025.
These escalating costs have a significant impact on OCPA’s procurement cost budget, requiring strategic adjustments and mitigation measures to ensure compliance and maintain financial stability in the coming years.
Following the presentation at the November 25th special meeting, the Board directed OCPA staff to pursue the “Ideal Scenario,” under which the default rate product for those agencies currently at 100% Renewable Choice would be opted down to Smart Choice for 2025 and 2026 and the renewable energy content in Smart Choice would be reduced to 55% for 2025 and 60% for 2026, plus 40% carbon-free energy content.
DISCUSSION/FISCAL IMPACT
OCPA staff recommends that the Board of Directors approve a reduction of renewable energy content in the Smart Choice plan from 72% to 55% for 2025 and then increasing it to 60% for 2026, plus 40% carbon-free energy content. This change would apply to all customers enrolled in Smart Choice in 2025 and 2026, either through the OCPA member agency having selected that plan as the default rate option or because the individual customer opted into the plan itself.
In addition, OCPA staff recommends the Board of Directors adopt the proposed updates to Policy No. 23. The proposed updates aim to provide fiscal, energy procurement, and operational flexibility, as well as meet customer rate stabilization and energy risk management objectives. The updated policy would authorize the OCPA Board of Directors to change power supply options available as default rate products for one or more member agencies on a temporary basis. This authority would allow OCPA flexibility to, among other things: (1) generally retain its existing offering of power supply options for customers choices, especially for those customers wishing to specifically opt-up or opt-down to any power supply options; (2) reduce or minimize potential changes to OCPA’s rate design, reinforcing our commitment to affordability; (3) respond effectively to energy procurement, rate stabilization, energy risk management, or other operational needs; (4) maintain the Board-approved reserve target level of 30% or higher to ensure long-term financial planning and risk mitigation; and (5) balance fiscal sustainability with the achievement of both OCPA’s and member agencies’ climate action goals.
If the proposed revisions to Policy No. 23 are approved, staff also recommends that the Board of Directors authorize the Chief Executive Officer to temporary opt-down the City of Buena Park’s default option from 100% Renewable Choice to the Smart Choice plan for 2025 and 2026, except for those Buena Park customers that individually or voluntarily choose to opt into the 100% Renewable Choice. It is anticipated that the City of Buena Park’s default option customers would revert to 100% Renewable Choice in 2027 depending on market conditions and other OCPA objectives. Customers currently enrolled in Basic Choice, which costs 3% less than SCE’s equivalent generation rate, would remain on Basic Choice. Those wishing to remain on 100% Renewable Choice or opt down to Basic Choice could do so at any time. OCPA plans to notify Buena Park customers of the default rate product change via direct mail in January and February 2025, with the transition to Smart Choice taking effect by March 1, 2025. OCPA staff will also collaborate with Buena Park management to present the temporary change to the Buena Park City Council.
On November 26, 2024, during an item agendized by Director Kathleen Treseder, the Irvine City Council discussed potential changes to its customer enrollment in the 100% Renewable Choice default option, among other OCPA-related matters. The Irvine City Council expressed a desire to continue discussions in December regarding the default option for Irvine customer accounts.
OCPA staff has provided the City with all of the specific data and information on this issue, and will continue to meet with Irvine staff to clarify issues and answer questions. For the City’s municipal accounts, the Council has requested a transition from 100% Renewable Choice to the Basic Choice option (currently 44% renewable energy). OCPA staff is working with Irvine’s staff to facilitate this request and will provide an update to the Board on the City of Irvine’s discussions and actions taken by the City Council at a future meeting.
