A. Board Member Communications
Committee Chair Dowdin Calvillo reported that the Expansion ad hoc Committee met on September 14, 2022, to receive a presentation of the Impact Studies Report from Pacific Energy Advisors; and discussed the process for bringing the new members on board in 2024.
Chair Dowd in Calvillo also reported her activities with PCWA in support of better forestry management as it relates to effects from wildfires on water storage and hydroelectric generation. As a proactive approach needs to be taken, this will be brought to a policy committee while attending Cap-to-Cap in Washington, D.C.
Director Hidahl reported that as a result of the Caldor fire in El Dorado County, $7 .8 Million in federal funding was received by the water agency; and he will share the contact for more information to any interested Member agencies.
Director Hidahl also reported that he will be remotely attending the October meeting due to participating in the League of California Cities retreat and confirmed that the El Dorado County facility would still be available for the Pioneer Board of Directors, but he will not be there in person.
B. Executive Director Communications
General Counsel Khalsa provided an update as to legislation activities regarding the Brown Act. AB 1944 has been postponed to next year; and AB 2449 was signed by the Governor on September 13, 2022.
Governing Board Minutes
September 15, 2022
As long as we are under the state of emergency declaration, AB 361 determinations will still allow for remote participation as currently in place. However, once the emergency is lifted, the original Brown Act rules would apply in that a Member attending from a different location - accessible to the public and posted on the agenda, there would be no limit to the number of meetings a member is attending remotely.
AB 2449 specifies that a minority of the body could participate remotely; at least a quorum of the members to attend in person. General Counsel Khalsa confirmed that she and Executive Director Eckert are working on the specifics as to a solution for Pioneer Community Energy.
Chair Dowdin Calvillo requested that the language regarding no in person public participation be removed from this Board's agenda, to continue with the hybrid model and allow anyone who is interested in doing so to attend in person.
Director Hidahl commented that at times there are severe weather conditions and would not be able to drive to in person meeting; and inquired if severe weather is consider an emergency.
General Counsel Khalsa confirmed that it would be any emergency situation that prevents in person participation, not only illness.
Executive Director Eckert reported that Pioneer's new Manager of Legislative and Regulatory Affairs will be on board and introduced to the Board at the October meeting; expressed sympathy for the victims of the Mosquito fire; and appreciation for the City of Auburn staff and crew for hosting Pioneer for today's meeting.
