CEO Girish Balachandran spoke to two items: 1) resource adequacy compliance for the year 2023, and 2) NEM

3.0 proposed decision.

CEO Balachandran commented SVCE was unable to purchase sufficient capacity for 2023 and would be subject to penalties. CEO Balachandran noted staff would continue to close the compliance gap, and responded to committee member questions on the penalty and if there had been any discussion on if there would be any extensions or fee waivers.

CEO Balachandran provided information on the NEM 3.0 proposed decision, noting this second version of NEM

3.0 aligns with SVCE’s position, and responded to committee member questions on the specifics of the proposed decision and background of the previous proposal. Don Bray, Director of Strategic Development, provided brief information on the new electrification rate in comparison to the standard time of use rates.

Staff presented a recommendation to utilize Cupertino Community Hall as the primary physical meeting location for Board of Director meetings and the SVCE office as the primary physical location for Brown Act committee meetings, and with advance notice, assisting board members in setting up alternative public meeting locations to participate remotely if desired.

Deputy Director of Administrative Services Armstrong and Bena Chang, Senior Government Affairs Manager, responded to committee member questions regarding specifics of the requirements for use of AB 2449.

The committee discussed the differences between traditional Brown Act rules and AB 2449.

The presentation included a budget update, timeline for setting 2023 rates and discounts, 2023 discount options, information on the electrification discount, information on the multifamily direct-install program, and various scenarios for how the staff recommendation to increase SVCE’s overall discount rate for 2023 and provide a new ‘electrification discount’ and expand the multifamily direct-install program would be funded.

Item 1 2 Draft Minutes: 11/14/22 Executive Committee Meeting

SILICON VALLEY

CLEAN ENERGY
Staff recommended a hybrid approach for 2023 rate setting and discounts to include:
1) increase SVCE’s general 2023 discount to 4% ($11M);
2a) allocate $9.5M to fund an ongoing electrification discount of ~10+% for the ‘Electric Home’ rate, beginning in early 2023, and
2b) add $9.5M to the Multifamily Direct-Install program budget, enabling further electrification and energy efficiency in lower-income communities.

The committee reviewed and discussed the various discount scenario alternatives and staff responded to questions.

CEO Balachandran summarized committee member comments:
- There was support for the staff recommendation of alternative three, with a second choice of alternative two;
- There was desire for flexibility in funding; and
- Learning would be a big part of the program, as this is the first time it will be done, and staff would come back with changes as needed. For example, if there is more money in reserves, staff can come back for approval to expand funding for the electrification rate or multifamily direct-install program.

Chair Tyson opened public comment.

Bryan Mekechuk made the following comments: 1) when looking at the average monthly bill comparison, consider how it will change with more people having electric vehicles and the rates they will pay for the electricity for those electric vehicles, and 2) if you are dealing with a multiyear program, think about the next series of reach codes and what is going to happen as electrification increases.

Chair Tyson closed public comment.
6) Program Snapshot: GridShift: FutureFit Homes (Presentation) Justin Zagunis, Director of Decarbonization Programs and Policy, and Jessamyn Allen, Program Manager, provided a presentation on the FutureFit Homes Program, which expands SVCE’s residential building electrification incentives by providing up to $8,000 in rebates for HPWH, HP HVAC, panel upgrades, pre-wiring for future electric appliances, and removal of the gas meter.

Chair Tyson opened public comment.

No speakers.

Item 3: Elect Chair and Vice Chair of the 2023 SVCE Executive Committee From: Girish Balachandran, CEO
Prepared by: Andrea Pizano, Board Clerk/Executive Assistant Date: 1/27/2023

RECOMMENDATION
Elect a Chair and Vice Chair of the Executive Committee to preside over committee meetings.

BACKGROUND
As an appointed ongoing committee of the SVCE Board of Directors, Executive Committee meetings are public meetings subject to the Ralph M. Brown Act. Since inception the Chair of the Executive Committee has been the Chair or Vice Chair of the SVCE Board.

ANALYSIS & DISCUSSION
With Executive Committee appointments made at the January 11, 2023 Board meeting, staff recommends the Committee appoint a Chair and Vice Chair to preside over its meetings for 2023. Any member of the Committee may serve as Chair or Vice Chair, and there are no term limits.

The 2022 positions were held by Director George Tyson as Chair, and Director Neysa Fligor as Vice Chair; Director Fligor is no longer on the SVCE Board of Directors.

Item 4: Select a Regular Meeting Schedule for 2023 Executive Committee Meetings From: Girish Balachandran, CEO
Prepared by: Andrea Pizano, Board Clerk/Executive Assistant Date: 1/27/2023

RECOMMENDATION
Approve an ongoing meeting date and time for 2023 Executive Committee meetings.

BACKGROUND
In June 2016, the SVCE Board approved the formation of the Executive Committee with the role of advising the CEO and Board on matters pertaining to the operations of SVCE. The approved role of the Executive Committee is advisory to the Board unless the Board directs or delegates specific decision-making authority to the Committee, such as delegating final approval of a professional services agreement to the Committee.

The 2022 Executive Committee members approved to hold meetings every fourth Friday of the month at 10:00am, with April and October’s meetings beginning at 11:30 a.m.

ANALYSIS & DISCUSSION
Regular Board meetings are held during the second Wednesday of each month. Since inception, the Executive Committee has met on the fourth Friday of the month, with meetings starting in the morning, except for one year when meetings started on Friday afternoon. New members of the 2023 Executive Committee were selected at the January 11, 2023 Board of Directors meeting. The dates and times for the Executive Committee meetings need to be agreed to and approved.

All meetings will be held virtually on Zoom until the termination of the governor’s emergency order; following that termination, meetings will be hybrid with the option for committee members to participate in person at the SVCE office or remotely from a noticed location. Members of the public will be able to attend in person or remotely.

STRATEGIC PLAN
Not applicable.

ALTERNATIVE
This item is for discussion; staff is open to suggestions from the committee.

FISCAL IMPACT
No fiscal impact as a result of selecting a regular meeting schedule.

Staff Report – Item 5
Item 5: 2023 Board and Executive Committee Meeting Schedules – Recommendation of Summer Recess
From: Girish Balachandran, CEO
Prepared by: Andrea Pizano, Board Clerk/Executive Assistant Date: 1/27/2023

RECOMMENDATION
Staff recommends that the Executive Committee:
1) Approve a one-month summer hiatus in July for the SVCE Executive Committee meeting, and 2) Recommend the Board approve a July hiatus for the Board of Directors meeting.

BACKGROUND
Since 2018, the Board of Directors approved a one-month summer hiatus from meetings; in 2018 it was August, and, based on feedback from the Board that a July recess would be preferable, a summer recess was taken in July in 2019, 2020, 2021, and 2022.

ANALYSIS & DISCUSSION
Given the positive feedback received for a summer recess, staff would like to propose this be continued. Staff suggests July be selected for the summer hiatus, as this has worked well in the past. If the need for Board action or an Executive Committee meeting arises in the off month, a special meeting will be called.

If the Executive Committee votes to recommend a July hiatus to the Board of Directors, the item will be placed on the Consent Calendar for approval at the February Board meeting.

STRATEGIC PLAN
Not applicable.

FISCAL IMPACT
No fiscal impact as a result of providing feedback on the meeting schedule.
