SUBJECT: Resolution No. 2024- XXX, Approving the Purchase of New Cubicles for the City Hall Annex from Warden’s Office Furniture RECOMMENDED COUNCIL ACTION:

Staff recommends the City Council approve the purchase of new cubicles for the City Hall Annex from Warden’s Office Furniture.

I. BACKG
ROUND:

The City
Hall Annex urgently requires an upgrade to their current setup. Annex side of City Hall is still using outdated cubicles with inefficient layouts, and both power and network cabling need to be redesigned. Additionally, once the old cubicles are removed, the carpets will be thoroughly cleaned, as they have not been fully addressed since the flooding last year.

II. REASONS FOR RECOMMENDATION:

Enhanc
ing the office environment is crucial for boosting staff morale. The employees in the City Hall Annex are dedicated to advancing development, processing plans, and executing capital improvement projects. Currently, many of these staff members are working in makeshift cubicles that lack sufficient space for efficiently analyzing plans and organizing their work. This upgrade focuses solely on improving conditions for these hardworking team members and does not include upgrades for the Directors. We believe it is essential to prioritize the well -being and productivity of our staff with this enhancement.

III. FISCAL IMPACTS:

There ar
e no additional fiscal impacts for FY 2024-25. The amount of the purchase order will be $108,758.26 and is available in current year appropriations.

SUBJECT: Resolution 2024-XXX, Approving Amendment #2 to the Professional Services Agreement with EMC Planning Group, Inc. for $18,318 to Perform Planning Services Related to the Continued Preparation of the 2024- 2031 Housing Element Update, Including Compliance with the California Environmental Quality Act , Approving a Budget Amendment, and Authorizing the City
Manager to Execute the Contract Amendment
RECOMMENDED COUNCIL ACTION:

Staff recommends the City Council adopt a resolution approving and authorizing the City Manager to execute Amendment #2 to the Professional Services Agreement with EMC Planning Group, Inc. for $18,318 to perform planning services related to the continued preparation of the 2024-2031 Housing Element, including compliance with the California Environmental Quality Act and authorizing a budget amendment.

I. BACKGROUND:

St
ate law requires the City to update its Housing Element by December 31, 2023, to identify programs that can accommodate sufficient housing capacity per the City’s Regional Housing Needs Assessment (RHNA) allocation to the satisfaction of the State Department of Housing and Community Development (HCD) . The City’s draft Housing Element has not received a Letter of Compliance from HCD to date.

Completion of Work to Date
In c
oordination with City staff, EMC Planning Group facilitated and supported City staff in public meetings to inform the community on the preparation and status of the 6th Cycle Housing Element Update. EMC Planning Group facilitated additional outreach efforts including a stakeholder survey and promotional outreach materials.

ITEM 8
{CW137032.1}
On July 17, 2023, EMC Planning Group published the Initial Public Review Draft Housing Element for a 30-day public review period, which ended on August 20, 2023. Throughout this period, EMC Planning Group and City staff reviewed public comments and developed responses.

On August 7 and August 14, 2023, the Planning Commission and City Council, respectively, had the opportunity to review and discuss the direction of the Housing Element. Per the direction of City staff and the City Council, EMC Planning Group revised the draft Housing Element. Revisions addressed public comments and responses to the stakeholder survey. On September 15, 2023, the Initial Draft Housing Element was submitted to HCD for a 90-day review.

City staff and EMC Planning Group attended a mid- cycle review with HCD reviewers on November 15, 2023. Mid-cycle revisions were informally submitted to HCD on December 7, 2023. On December 14, 2023, City staff received a 90-day Findings Letter from HCD.

On December 19, 2023, EMC Planning Group and City staff reviewed the HCD Findings Letter to determine next steps. City staff and EMC Planning Group met with HCD reviewers on January 25, 2024 to gain clarity on specific comments in the December 14, 2023 HCD Findings Letter.

EMC Planning Group staff completed a number of revisions to the draft housing element.

Revisions to the Housing Element were submitted to HCD on July 1, 2024. On August 14, 2024 City staff and the Consultant team met with HCD for a mid- cycle review of the draft document. At th is meeting, HCD indicated that the City would receive a second comment letter on the Housing Element draft. On August 30, 2024, staff received a second Findings Letter from HCD with items that need to be clarified in the current draft.

The City did not receive a Letter of Compliance as hoped.

Now that edits are necessary to comprehensively respond to the HCD’s Findings Letter, staff needs to allocate additional budget to the agreement with EMC.

II. RE
ASONS FOR RECOMMENDATION:

The attached Resolution would approve and authorize execution of an amendment to the Professional Services Agreement with EMC Planning Group for the preparation of a revised 2024-2031 Housing Element responsive to HCD’s 60-day Findings Letter. Upon execution of the second contract amendment, the consultant will address the findings made by HCD and submit the revised document in a timely manner.

The original contract budget approved on February 23, 2023 for professional services to be performed by EMC Planning Group was $220,000. The cost of the first contract amendment was for an additional $39,178 to address the first Findings letter from HCD .

The second contract amendment is for $18,318 to address the second Findings letter from HCD.

III. F ISCAL IMPACTS :

To date, the City utilized two grants to fund the contract with EMC Planning Group for the 2023-2031 Housing Element Update. The two grants are:

ITEM 8
{CW137032.1}
1) State Housing and Community Development (HCD) Local Early Action Planning (LEAP) Grant in with an award amount of $150,000 ( City Council Resolution No. 2020-91); and
2) Stanislaus Council of Governments (StanCOG) Regional Early Action Program (REAP) Grant with an initial amount of $35,277.88 (City Council Resolution No. 2022-77)) and a remaining $47,846.03 allocated to the City in Jul y 2024 (City Council Resolution No. 2024-98).

The total grant money available to pay for the Housing Element totals $233,123.91. The current cost of the Housing Element is $249,287.96. There is $10,000 left on the prior contract to complete the CEQA work for the document. With the CEQA funds included, the total contract and first amendment costs are $259,278.96. With the additional $18 , 318, the total cost of the project is $277,596.96.

This leaves $44,473.05 in expenses funded by internal funds without possibility of reimbursement currently. When this project began, the City was expecting to receive a total of $125,746.50 in REAP funding, putting the total grant money at $275,746.50.

However, the funding did not come through as expected, leaving the City with a shortfall in grant money. However, StanCOG is expecting to release a new round of funding , REAP 2.0, for Cities in the near future. Ceres is expected to receive $300,000. Any remaining expenses of the Housing Element could potentially be reimburse through the REAP 2.0 package once StanCOG releases the funds to the City.

Staff is requesting that Amendment #2 be paid for with a budget allocation to the following contract services accounts : 10075.029900, 52775.029900, and 56775.029900. Of the requested $18,318, only $3,663 will come from the General Fund. Other revenue sources will cover the remaining $14,655.

IV. E
XISTING POLICY / RELATIONSHIP TO STRATEGIC PLAN :

Planning for the Future: Ensure the City has plans and policies in place to attract and create desirable development, maintain and improve neighborhoods and annex land to achieve a livable community and support a strong economy.

V. P
OLICY ALTERNATIVES :

The Council could elect not to move forward with an amendment to the Professional Services Agreement with EMC Planning Group to complete the City of Ceres 6 th Cycle 2024-2031 Housing Element Update. If that were to occur, the City would have to spend considerable staff time and resources on the project to get it to its final point.

IX. STEPS FOLLOWING APPROVAL:

Upon Co
uncil approval, staff will have EMC Planning Group sign and return the Professional Services Agreement Contract Amendment #2 for the preparation of a revised 2024-2031 Housing Element responsive to HCD’s Findings Letter, received on August 30, 2024, including compliance with the California Environmental Quality Act.

Re: C eres 6th Cycle Housing Element (2023-2031)
Request for Contract Amendment 23-078
Dear Lea,
This is a request to amend the existing scope and budget for the 6th Cycle Housing Element Update (2023-2031). With this scope and budget amendment, the EMC Planning Group Team will make revisions to the draft housing element in response to Housing and Community Development’s (HCD) 60-day Findings Letter, which the City is slated to receive on August 30, 2024.

Completion of Work to Date
In coordination with City staff, EMC Planning Group facilitated and supported City staff in public meetings to inform the community on the status of the 6th Cycle Housing Element Update. EMC Planning Group facilitated additional outreach efforts including, the development of a dedicated housing element update website (https://engage.emcplanning.com/cereshousingplan), stakeholder survey, and promotional outreach materials.

Per the direction of City staff and the City Council, EMC Planning Group revised the draft housing

element. Revisions to the draft addressed public comments and responses to the stakeholder survey. On September 15, 2023, the Initial Draft Housing Element was submitted to HCD for a 90-day review.

City staff and EMC Planning Group attended a mid-cycle review with HCD reviewers on November 15, 2023.

On July 1, 2024, the City submitted a Revised Draft Housing Element to HCD for a 60-day review period. On August 14, 2024, City staff and EMC Planning Group attended a check-in review with HCD reviewers, which revealed additional revisions are necessary. The City is slated to receive a 60-day Findings Letter from HCD on August 30,2024.

EMC Planning Group has worked concertedly to develop a comprehensive draft that is inclusive of new information discovered through ongoing meetings with HCD reviewers.

That said, our goal has remained to provide the City of Ceres a ready to certify housing element.

HCD Requested Revisions for the Housing Element Update
EMC Planning Group will continue to work with City staff, and community stakeholders in making the necessary revisions responsive to the anticipated HCD August 30, 2024 60-Day findings letter. This effort includes one (1) set of revisions and follows the Revised Draft Housing Element submitted to HCD on July 1, 2024.

Scope
Amendments to the current scope are intended to address existing Task 4. The following outlines the proposed revised scope of work according to task. Please note, the scope and budget included with this contract amendment is based on the following assumptions:
 Items identified in the HCD 60-Day Findings Letter for further revision will likely require City staff knowledge and access to resources. EMC Planning Group staff will work in partnership with City staff in order to avoid redundancies and expedite revisions;
 No more than ten (10) written public comment letters would be received during the seven-day public review period for the HCD Revised Draft Housing Element, and these letters would not raise new issues that require additional analysis. Any additional written public comments may require a contract amendment;

EXHIBIT A
ITEM 8
Lea Simvoulakis, Community Development Director
City of Ceres
August 22, 2024, Page 3
 City staff would conduct all required distribution, publication, and noticing tasks associated with release of the Revised Draft Housing Element, publication of notices in a local newspaper, public hearing notices;
 City staff will provide all internal comments on the Revised Draft Housing Element in one consolidated set of comments (electronically); and
 City staff will coordinate with EMC Planning Group to permit EMC staff to submit the Revised Draft Housing Element to HCD.

Task 4 – Revisions to the Housing Element Per HCD 60-Day Findings Letter To complete this task, EMC Planning Group will revise the draft housing element in response to the HCD 60-Day Findings Letter.

Deliverables:
 Attendance at up to two (2) one-hour meetings with HCD reviewers including meeting preparation;
 Attendance at up to three (3) one-hour meetings with City staff, including meeting preparation;
 Coordination with City staff, HCD reviewers, and EMC Planning Group internal team;  Prepare content for City staff to post on City’s Housing Element Update webpage1 to comply with AB 215 seven-day public noticing requirement for revisions to the draft housing element;
 One (1) revision based on comments received during the seven-day public review period (assuming up to 10 written comments);
 One (1) Revised Draft Housing Element – clean version in electronic PDF format and one (1) hard copy;
 One (1) Revised Draft Housing Element – track changes version in electronic PDF format and one (1) hard copy;
 One (1) Revised HCD Site Inventory Table in electronic Excel format (if necessary); and
 One (1) Revisions Matrix detailing responses to HCD comments; and  Management and coordination of the submittal of the Final Housing Element Draft to HCD, both hard copy and electronically.

Optional Tasks
The following tasks are included in the budget as “Optional Tasks.” These tasks are not included in the total budget, but with City staff approval can be added.

Staff Reports and Resolutions

Prohousing Designation Application
EMC Planning Group proposes to add this task, if the City would like to continue efforts toward obtaining a Prohousing designation.

To complete this service EMC Planning Group would update the existing application as necessary to prepare for submittal to HCD. This application is closely tied to policies and programs identified in the Housing Element, and therefore may be subject to revisions in accordance with the Housing Element. Once finalized, the application would require a signed resolution and application by the City Council and City Staff prior to submittal to HCD.

Deliverables:
 One (1) Administrative Draft Prohousing Designation Application for City staff review;  One (1) revised application responsive to City staff comments;  One (1) staff report and one (1) resolution for Planning Commission recommendation of the Prohousing Designation to the City Council;
