SUBJECT: Resolution No. 2024-XXX, Approving the Use of the Remainder of the American Rescue Plan Act (ARPA) Funding
RECOMMENDED COUNCIL ACTION:
Staff recommends the City Council review the American Rescue Plan Act Funding and approve to obligate the remaining ARPA funds.
I. BACKGRO UND:
On March 11, 2021, Congress passed the American Rescue Plan Act of 2021 (ARPA) which established the Coronavirus State and Local Fiscal Recovery Fund (SLFRF). This fund helps local governments, nationwide, with the COVID -19 pandemic recovery assistance and specific types of infrastructure investment.
The City received $11,651,510 through the American Rescue Plan Act . The first installment of $5.8 million was received in July 2021 and the second installment of $5.8 million in July of 2022.
The US Department of Treasury has released its Final Rule with specifics on how the ARPA funds may be utilized. These funds may only be used for the following purposes:
• Repl
acing Lost Public Sector Revenue- The final rule offers a standard allowance for revenue loss of $10 million in lieu of performing a full revenue loss calculation. Ceres elected to take the standard allowance of up to $10 million. Recipients may use that amount for most government services. Government services is defined as services traditionally provided by recipient governments. This expenditure category gives the Council broad latitude to use funds to provide government services with a few restrictions.
• Public Health and Economic Impacts-Recipients can use funds for programs, services or capital expenditures that respond to the public health and negative economic ITEM 12
impact of the pandemic. Funds can be used to address COVID -19 mitigation and prevention.
• Provide Premium Pay for eligible workers performing essential work during the period beginning on January 27, 2020 and lasting until the termination of the national emergency.
• Invest in Water, Sewer and Broadband Infrastructure- Funds may be used to make necessary investments to improve access to clean drinking water, to support vital wastewater and stormwater infrastructure and to expand affordable access to broadband internet.
The US Department of Treasury has also outlined some restrictions to the use of ARPA funds. ARPA funds cannot be used for the following:
• To offset a reduction in net tax revenue resulting from a change in state law. • As a contribution to a pension fund for the purpose of reducing an accrued unfunded liability.
• As payment for debt service and replenishment of rainy day funds.
Treasury established the legal stipulation that ARPA funds can only be utilized for expenses incurred by December 31, 2024, specifying that a cost is deemed incurred if the recipient has taken on an obligation by that date. Treasury defined obligation as an order placed for property and services and entering contracts, subawards, and similar transactions that require payment, which may include certain interagency agreements, including MOUs and under certain circumstances, payroll expense for recipients’ employees.
The Treasury also defined what is not an obligation. The following items are not obligations: an adopted budget or budget amendment, an appropriation of ARPA funds, an executive order, a resolution, a written or oral intention to enter into a contract, a grant or legal authority to enter into a contract, claiming funds under the revenue loss category, moving ARPA funds to the general fund as revenue loss but not further reestablishing an obligation with those funds by December 31, 2024.
On June 18, 2024 the City Council approved the use of $1.5 million in ARPA funds to bridge the funding gap as part of the standard allowance for revenue loss as allowed by the Final Rule of the Treasury. To ensure those funds are fully utilized and to establish an obligation by the December 31, 2024 deadline, staff recommends the items included in the attached budget journal be appropriated for use of ARPA funds . The attached budget journal will allocate expenses for ammunition, grant writer, animal services, graffiti abatement, SR911, security at Smyrna and Riverbluff Park, landscape maintenance, pest control, Civic Rec license, legal, LAFCO, League of CA Cities and Invoice Cloud. All of these costs were previously included in the General Fund budget and will be transferred to the ARPA Fund budget. The revenue transfer to the General Fund that was originally included in the FY25 budget will not occur and staff will enter into contract s, purchase orders, or pay the expenses from the ARPA Fund prior to December 31, 2024.
The purpose of this agenda item is for the Council to provide direction on projects/expenditures and to approve a resolution allocating ARPA funding to those projects.
As of October 2 8, 2024, the City spent a total of $8, 119,502.49 as shown in the table below:
ITEM 12

SUBJECT: Resolution 2024-XXX, Adopting the Updat ed Various User and Regulatory Fees and Charges
RECOMMENDED COUNCIL ACTION:
Staff recommends the City Council approve a resolution adopting updating and establishing various user and regulatory fees and charges, effective 60 days from adoption.
I. BACKG ROUND:
The City commissioned a user and regulatory fee study which was commenced in FY 2023/24 by ClearSource Financial Consulting (ClearSource). The study provides an up- to-date analysis of the City’s current costs of providing fee -related services. This information can be used by the City Council as it considers potential updates to fees.
The proposed fees are set forth in a comprehensive user and regulatory fee schedule for consideration and adoption by Council resolution. User and regulatory fees are set at the direction of the City Council at the conclusion of a public hearing to consider adoption of any new fees or fee increases.
II. RE
ASONS FOR RECOMMENDATIO N:
The services for which a city imposes a user or regulatory fee typically derive from an individual person or entity’s action, request, or behavior. Therefore, except in cases where there is an overwhelming public benefit generated by a city’s involvement in the individual action, a fee for service ensures that the individual bears most, if not all, of the cost incurred by the City to provide that service. When a fee targets “100% or full cost recovery,” the individual bears the entirety of the cost. When a fee targets less than full cost recovery, another City revenue source – in most cases, the General Fund – subsidizes the individualized activity.
ITEM 13
Industry best practices and California statutes are in harmony: User and regulatory fees should be set according to the estimated reasonable cost of service and should bear a fair and reasonable relationship to the payer’s burdens on, or benefits received from the activities and/or services provided by the City. Additionally, ongoing review and adjustment of fees provides multiple benefits, including:
• Increasing the availability of General Fund revenues to be used for services and activities available to all residents and businesses, such as public safety and parks services.
• Keeping pace with general cost inflation.
• Avoiding fee spikes that are more likely to occur when municipalities leave fees unchanged for a multi-year period.
• Providing fee payers, City Staff, and City policymakers with a pattern of consistency that provides information for forecasting and decision -making purposes.
• Helps meet fee -payer service level expectations by collecting fees to fund the existing level of services provided.
• Encouraging generational equity among fee payers by avoiding long- term stagnation of fees followed by significant fee increases.
Attachment A of this report includes the fee schedule proposed for adoption by the City Council.
Attachment B of this report includes the user and regulatory fee study.
The following are primary outcomes and proposals that may be of particular interest to the City Council as it considers fee adjustments:
• B
uilding Fees
o Building plan review, permit processing and field inspection fees have been restructured to enhance the correlation between services provided and fees collected.
o The proposed fee methodology scales to allow for lower fees for less complex projects and higher fees for more complex projects.
o Establish fixed, consolidated fees for the City’s most common minor permits.
This will allow applicants to easily estimate permit fees and allow staff to efficiently administer the fee calculation and collection process. o Full cost recovery is targeted from proposed fees.
• P l
anning Fees
o Due to the nature of development within California, many projects take a significant amount of resources over a multi -month and potentially multi -year timeframe, depending on project complexity and magnitude. o Full cost recovery is targeted from most proposed fees due to the regulatory nature of the fees and the high level of direct benefit resulting from construction activities including enjoyment of property enhancements, increased property values, and the desire to avoid having other Ceres residents and businesses subsidize an individual's private construction activities. o Current cost recovery varies widely depending on the fee examined (10% - 90%).
ITEM 13
• Engineering Fees
o Engineering and encroachment permit fees are collected to recover the costs associated with improvement plan review, permitting, and construction inspection along with review and inspection of work conducted within the City right-of-way.
o Full cost recovery is targeted from proposed fees.
• R eserved Use / Rental of Ceres Buildings and Facilities o Fees are generally proposed to be adjusted by approximately 18%. This represents regional cost inflation over the most recent five-year period. o If fees are left unchanged in an environment of increasing costs, the City’s cost recovery levels deteriorate.
• F
ire Prevention Fees
o Fire Prevention Fees were most recently adjusted in 2023. The City Council has authorized an annual inflationary adjustment for these fees. No adjustments beyond the pre-authorized annual adjustment are proposed.
• P olice Fees
o Police Fees have been recalibrated to reflect current costs of service and State limits for certain fee -related services. The City’s Police Services are funded predominantly through tax revenues.
• A
dministrative Fees
o Administrative fees have been recalibrated to reflect current costs of service and State limits for certain fee-related services.
• A nnual
Adjustment to Fees
o In order to generally maintain pace with regional cost inflation and/or the City's salary cost inflation, the City should adjust its fees on an annual basis. A commonly used, reasonable inflation index is the annual change in the all - urban Consumer Price Index (CPI) representative of the region.
The proposed fees are intended to comply with applicable federal, state, and local laws including providing confirmation that the proposed fees and charges are not a tax as defined in Article 13C of the California Constitution and that the proposed fees are no more than necessary to cover the reasonable costs of the City’s activities and services addressed in the fees. Additionally, the manner in which the costs are allocated to a payor bear a fair and reasonable relationship to the payor’s burdens on, or benefits received from the activities and services provided by the City.
III. F
ISCAL IMPACTS :
The anticipated General Fund impact of the proposed changes is $200,000 in revenue.
The primary purpose of the adjustments to the City’s fee schedule is to correlate fees to services provided. The City’s current and proposed fees seek to recover the City’s full cost of service for new development within the City and avoid cost recovery deterioration for non-development related fees. Additional revenues expected from proposed changes to fees and charges are intended to offset the cost of providing existing services ITEM 13
associated with those fee -related regulatory functions. Additional fee revenue is not intended to fund new services.
IV. EXI STING POLICY / RELATIONSHIP TO THE STRATEGIC PLAN :
The proposed user and regulatory fees align to the City’s Livable Community Goals:
• Goal: Establish mechanisms and policies which ensure that impacts of development are paid for by the developer (e.g., off -site infrastructure installed at the time of development).
o R
elationship of proposed fees to the stated goal : The proposed fees target full recovery of development-related permitting and plan review.
•
Goal: Pursue programs that ensure the community has adequate police and fire protection.
o R
elationship of proposed fees to the stated goal : Recovering the cost of fee- related services, increases the availability of General Fund revenues to be used for services and activities available to all residents and businesses, such as public safety services.
•
Goal: Encourage development of housing for all economic levels of the community, including affordable, senior and executive housing.
o R
elationship of proposed fees to the stated goal : Recovering the cost of fee- related services helps meet fee-payer service level expectations by collecting fees to fund the existing level of services provided.
V. POLICY ALTERNATIVES:
Council may choose to:
• Leave user and regulatory fees unchanged; however, the goal of the City Council to establish mechanisms and policies which ensure that impacts of development are paid for by the developer will not be achieved.
• Approve any combination of partial implementations of the proposed changes.
VI. I NTERDEPARTMENTAL COORDINATION:
If the updated schedule is adopted by the City Council, it will serve as the primary repository of City user and regulatory fees. The City’s various departments will begin using updated fees and associated outcomes once the updated schedule of fees becomes effective. Values should be included in all official fee schedules used throughout the City (e.g., departmental pamphlets, counter schedules, and online information).
VII. P
UBLIC PARTICIPATION:
In accordance with California Government Code Section 6062(a), notice of this public hearing was published, and the analysis and proposed fees have been made available to the public.
VIII. EN VIRONMENTAL REVIEW :
The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment ITEM 13
or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378. The approval of the resolution meets the above criteria and is not subject to CEQA. No additional environmental review is required.
IX. STEPS FOLLOWING APPROVAL:
In order to comply with legislative requirements outlined in Section 66017 of the California Government Code, staff recommends fees become effective December 1, 2024 (i.e., no sooner than 60 days following adoption of the adjusted fees).

WHEREAS, the study examined fee- related services provided by the City, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and
WHEREAS, the City Council finds that providing these services is of special benefit to applicants both separate and apart from the general benefit to the public; and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these services from applicants who have sought or require the City 's services by revising its schedule of fees; and
WHEREAS, the City Council hereby finds that the study provides adequate evidence to conclude that the revised fees do not exceed the cost to provide the services for which the fees are charged; and
WHEREAS, the City Council desires that annually the Finance Director may update the fees based on the annual percentage change in the Consumer Price Index All Urban Consumers, San Francisco- Oakland-Hayward, CA (CPI), not to exceed five percent (5%) per year. If the CPI does not change or goes down in a given year, no change shall be made to the fee schedule that year unless an adjustment is made to targeted cost recovery levels or fee study findings indicate that an adjustment is appropriate; and
WHEREAS, in adopting this Resolution, the City Council is taking action only on those fees for the services, programs or products set forth in Exhibit “A” which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect; and
WHEREAS, the updated User and Regulatory Fees and Charges shall go into effect 60 days from the adoption.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Ceres does hereby adopt the updated various User and Regulatory Fees and Charges.

The final building permit valuation shall be set at an amount that allows the City to recover its costs of applicant plan check, permit and inspection activities.

EXECUTIVE SUMMARY
STUDY OVERVIEW
The City of Ceres has completed a User and Regulatory Fee Study. California cities regularly conduct these studies to justify fee amounts imposed and to optimize the overall portfolio of revenues available to the municipality to fund its services.
Industry practice and fiscal conditions in the state have led most cities to link cost recovery for services of individual action, cause, or benefit to that same individual through user fee revenue, relieving the agency’s general revenues as much as possible for use toward services of broader community benefit.
USER AND REGULATORY FEES
Cities derive annual revenue from a number of sources. These include, but are not limited to, property taxes, sales taxes, license fees, franchise fees, fines, rents, and user and regulatory fees. User and regulatory fees are intended to cover all, or a portion of, the costs incurred by the City for providing fee -related services an d ac tivities that are not otherwise provided to those not paying th e fee .
California law provides guidance regarding the amounts the City may charge for fee-related services and activities. Specifically, in order to avoid being considered taxes, the fees ch arged shall not exceed th e estim ated reasonable c ost of providing th e services , activities, or materials for which fees are charged.
At its conclusion, this study proposes for City Council review and consideration at public hearing a new Schedule of User and R egulatory Fees for application in Fiscal Year 2024 -2025 and continued update in subsequent years.
COST RECOVERY POLICY AND PRACTICE
Recovering the costs of providing fee-related services directly influences the City’s fiscal health and increases the City’s ability to meet the service level expectations of fee payers.
The services for which the City imposes a user or regulatory fee typically derive from an individual person or entity’s action, request, or behavior. Therefore, except in cases where there is an overwhelming public benefit generated by the City’s involveme nt in the individual action, a fee for servic e en sures that th e individual bears m ost, if not all, of the cost incurred by the City to provide that servic e . When a fee targets “100% or full cost recovery,” the individual is bearing the entirety of the cost. When a fee targets less than full cost recovery, another City revenue source – in most cases, the General Fund – subsidizes the individualized activity.
Generally, fees for service are targeted to full cost rec overy, inclusive of operating, direct, indirec t, and c apital costs, exc ept in cases wh ere the City Counc il cites a public interest in lower fees . The City may also be influenced by market conditions, comparing to municipalities of similar size and service profile.

EXECUTIVE SUMMARY
FINDINGS AND PROPOSED ACTION
During the course of study, information and analysis was generated and is discussed substantively throughout this report and its technical appendices. However, summarized in the following table by broad fee category and highlighted in the subsequent findings statements, are o utcomes and proposals of particular interest to City leaders and policymakers.
PRIMARY OUTCOMES
BUILDIN G F EES
• Building plan review, permit processing and field inspection fees have been restructured to enhance the correlation between services provided and fees collected. The proposed fee methodology scales to allow for lower fees for less complex projects and higher fees for more complex projects.
• Establish fixed, consolidated fees for the City’s most common minor permits. This will allow applicants to easily estimate permit fees and allow staff to efficiently administer the fee calculation and collection process.
• Full cost recovery is targeted from proposed fees.
PLANNING F EES
• Due to the nature of development within California, many projects take a significant amount of resources over a multi-month and potentially multi-year timeframe, depending on project complexity and magnitude.
• Full cost recovery is targeted from most proposed fees due to the regulatory nature of the fees and the high level of direct benefit resulting from construction activities including enjoyment of property enhancements, increased property values, and the des ire to avoid having other Ceres residents and businesses subsidize an individual's private construction activities.
• Current cost recovery varies widely depending on the fee examined (10% - 90%).
ENGINEERIN G F EES
• Engineering and encroachment permit fees are collected to recover the costs associated with improvement plan review, permitting, and construction inspection along with review and inspection of work conducted within the City right-of-way. • Full cost recovery is targeted from proposed fees.
CERES AM ERICAN LE GION M EM ORIAL BUILDIN G R ENTAL • Fees are generally proposed to be adjusted by approximately 18%. This represents regional cost inflation over the most re cent five y ear perio d. If fees are left unchanged in an environment of increasing costs, the City’s cost recovery levels deteriorate.

EXECUTIVE SUMMARY
FIRE PREVENITON F EES
• Fire Prevention Fees were most recently adjusted in 2023. The City Council has authorized an annual inflationary adjustment for these fees. No adjustments beyond the pre-authorized annual adjustment are proposed.
POL ICE FEES
• Police Fees have been recalibrated to reflect current costs of service and State limits for certain fee-related services. The City’s Police Services are funded predominantly through tax revenues.
ADMINISTR ATIVE F EES
• Administrative fees have been recalibrated to reflect current costs of service and State limits for certain fee-related services.
FISCAL IMPACT
The primary purpose of the adjustments to the City’s fee schedule is to correlate fees to services provided. The City’s current and proposed fees seek to recover the City’s full cost of service for new development within the City and avoid cost recovery deterioration for non-development related fees.
Please continue to the following technical report and appendices for further discussion of this User and Regulatory Fee Study.

PROJECT ORIENTATION
SCOPE OF STUDY
The City of Ceres has completed a User an d Regulatory Fee Study , which represents an external review of prevailing practices and development of a new Schedule of User and Regulatory Fees . ClearSource Financial Consulting has prepared this analysis using FY 2023/24 organizational information and will be available to answer questions as the City proceeds in implementing findings as it chooses.
Key tasks expected by the City from this study included the following:
Review eligible fee -related services Citywide to establish the reasonable relationship between current fees for service and the underlying costs of service. Calculate the full cost of service, including estimated Citywide overhead costs. Recommend fees to be charged for each service.
Recommend cost recovery strategies and best practices in setting fees, while considering the complexities and demands of responsible programs or departments. Identify underlying billable rates for cost recovery opportunities and as the basis for user fees.
DIRECT SERVICES UNDER REVIEW
FEE CATEGORIES
Building – Services include , but are not limited to building plan review, permitting, and inspection for construction and sub-trades.
Engineering – Services include , but are not limited to, Including and development plan review and inspection, and encroachment permitting.
Fire Prevention – Review of construction and operations for compliance with Fire Code. Planning – Services include, but are not limited to, entitlement review, and review for project compliance with the City’s Zoning Code.
Police – Services include, but are not limited to vehicle releases, fingerprinting, and report delivery.
REASON FOR STUDY
Cities derive annual revenue from a number of sources. These include, but are not limited to, property taxes, sales taxes, franchise fees, fines, rents, and user and regulatory fees. PROJECT ORIENTATION
PREVAILING GUIDANCE
The objectives of this study, the methodology used to complete the study, and the formulation of outcomes and recommendations for future consideration were significantly influenced by Article 13C of the California Constitution and Section 66014 of the California Government Code.
Article 13C states that the local government bears the burden of proving by a preponderance of the evidence that a levy, charge, or other exaction is not a tax, that the amount is no more than necessary to cover the reasonable costs of the governmental activity, and that the manner in which those costs are allocated to a payer bear a fair or reasonable relationship to the payer’s burdens on, or benefits received from, the governmental activity. Additionally, Article 13C identifies the following as items that are not defined as taxes:
A charge imposed for a specific benefit conferred or privilege granted directly to the payer that is not provided to those not charged, and which does not exceed the reasonable costs to the local government of conferring the benefit or granting the privilege. A charge imposed for a specific government service or product provided directly to the payer that is not provided to those not charged, and which does not exceed the reasonable costs to the local government of providing the service or product. A charge imposed for the reasonable regulatory costs to a local government for issuing licenses and permits, performing investigations, inspections, and audits, enforcing agricultural marketing orders, and the administrative enforcement and adjudication th ereof. A charge imposed for entrance to or use of local government property, or the purchase, rental, or lease of local government property.
A fine, penalty, or other monetary charge imposed by the judicial branch of government or a local government, as a result of a violation of law.
A charge imposed as a condition of property development. Assessments and property-related fees imposed in accordance with the provisions of Article XIII D.
Section 66014(a) of the California Government Code includes the following, “Notwithstanding any other provision of law, when a local agency charges fees for zoning variances; zoning changes; use permits; building inspections; building permits; …the process ing of maps under the provisions of the Subdivision Map Act…; or planning services…; those fees may not exceed the estimated reasonable cost of providing the service for which the fee is charged, unless a question regarding the amount of the fee charged in excess of the estimated reasonable cost of providing the services or materials is submitted to, and approved by, a popular vote of two-thirds of those electors voting on the issue.
The outcomes and recommendations of the study are intended to comply with applicable federal, state, and local laws including providing confirmation that the proposed fees (“charges”) recommended as a result of this study are not taxes as defined in Articl e 13C of the California Constitution and that the proposed fees are no more than necessary to the cover the reasonable costs of the City’s activities and services addressed in the fees. Additionally, this report is intended to show that the manner in whic h the costs are allocated to a payer bear a fair and reasonable relationship to the payer’s burdens on, or benefits received from the activities and services provided by the City.

PROJECT ORIENTATION
METHODOLOGY AND DATA SOURCES
This study calculated the estimated reasonable cost of providing various fee -related services across the City organization. Generally, the estimated reasonable cost of providing the fee-related services and activities examined in this study can be calculated as the product of the composite fully-burdened hourly labor rate of the division responsible for providin g services and the estimated labor time required to process a typical request for service.
The composite fully-burdened hourly rates calculated in this study are based on the estimated annual hours spent providing fee related services, and estimated labor, services and supplies, and Citywide overhead expenditures, sourced as follows:
Labor expenditures for in -house personnel were based on budgeted salary and benefits expenditures.
Contract service personnel and other services and supplies related costs were based on current industry market rates for service.
Citywide overhead cost allocations were developed to assign a reasonable share of central service support to the City’s direct service units.
Estimated labor time spent providing fee related services were developed based on interviews with City staff and are in-line with typical direct service ratios experienced by the consultant via studies of similar municipalities throughout California. Commonly used industry data also aided in the development of time estimates and proposed fee structures.
Once cost of service levels are identified, the City may use this information to inform targeted cost recovery from fees. Fees set at the cost of service target full cost recovery. Fees set at any amount less than the cost of service target less than full cost recovery.
An illustration of the methods used in this analysis is shown in Exhibit 1.

IMPLEMENTATION
CONSIDERATIONS FOR IMPLEMENTATION
If the City decides to adopt or otherwise utilize outcomes generated through this study, it should:
Update Systems for Fee Outcom es - Ensure that City staff begin using updated fees and associated outcomes once the updated schedule of fees becomes effective. Values should be included in all official fee schedules used throughout the City (e.g., departmental pamphlets, counter schedules, and online information). Additionally, ensure collections processes are updated, which may include coding in billing systems and training for personnel who handle fees directly with the public.
Actively M onitor th e Use of F ees - In order to recover accurate and eligible amounts expected, the City should be diligent about tracking time to projects for time and materials billings and ensuring fees are applied in the correct amount and using the correct and intended basis for fixed fee billings.
Monitor F eedback and Perm it Statistics - Monitor permit and application volume and applicant feedback to determine if fee modifications are resulting in any unanticipated changes in project frequency and to increase the level of detail available for revenue forecasting.
Annually R eview an d Adjust F ee Values - In order to generally maintain pace with regional cost inflation and/or the City's salary cost inflation, the City should adjust its fees on an annual basis. A commonly used, reasonable inflation index is the annual change in the all-urban Consumer Price Index (CPI) representative of the region. Periodic ally Perform Comprehen sive An alysis - A comprehensive fee study should be conducted periodically (e.g., every three to five years) to ensure fee levels remain at or below legal limits and are consistent with evolving service practices and local conditions.

[c] Expedited Plan Review request is subject to City Engineer approval. It is dependent on staff availability and workload. [d] In addition to the fees identified in this schedule, the City will pass-through to the applicant any discrete costs incurred from the use of outside service providers or other agencies required to process the specific application. [e] Each deposit and/or fee listed in this schedule is based on the estimated number of hours required to perform a standard service request and the typical cost of services/materials required to perform the requested service. For service requests that are anticipated to require efforts, services, or materials, materially different than those typically required, the Department reserves the right to modify the initial deposit amount and/or use a time and materials billing methodology rather than a fixed fee for service.

The final building permit valuation shall be set at an amount that allows the City to recover its costs of applicant plan check, permit and inspection activities.

For service requests that are anticipated to require efforts, services, or materials, materially different than those typically required, the Department reserves the right to modify the initial deposit amount and/or use a time and materials billing methodology rather than a fixed fee for service. Javier Lopez, Mayor

MEETING DATE: November 12, 2024
TO: Mayor and City Council
FROM: Douglas D. Dunford City Manager
CONTACT: Michael R. Beltran II, P.E., Director of Engineering [email protected], (209) 538-5623
SUBJECT: Resolution No. 2024-XXX, Approving of the Five-Year (2024-2028) Capital Improvement Program (CIP) and Integration into the FY25 Budget
RECOMMENDED COUNCIL ACTION:
Staff recommends the City Council to adopt a resolution to approve the Five- Year (2024-2028) Capital Improvement Program (CIP) and integrate the CIP into the FY25 Budget.
I. BACKG ROUND:
Each year as part of the budgetary process, the City Council should adopt a five- year Capital Improvement Plan (CIP) pursuant to the California Government Code. Adoption of the CIP requires the City Council to hold a public hearing and adopt a resolution.
As part of this staff report, the resolution with the Five- Year CIP Project List have been attached for the City Council’s approval. During the presentation, a full overview of projects by funding source will be provided. Some of the projects identified and listed in the plan are projects which will be constructed with restricted funds such as development impact fees.
The Planning Commission, on a 3- 1 vote with one commissioner absent, recommended approval of the Five-Year CIP to the City Council. The Planning Commission’s role is to determine whether the individual projects are consistent with the General Plan goals, policies, and principles.
What is a Capital Improvement Program (CIP)?
The CIP is a list of physical improvements that the department heads and City Manager believe the City should fund and build during the five-year period covered by the program.
Projects are considered in light of the General Plan, Public Facility Financing Plan, the City’s overall priorities, the expressed needs of citizens, the merits of each specific ITEM 14
project, financial constraints, and Federal and State restrictions on the use of inter - governmental funds.
Department heads try to minimize expenditures by prioritizing and coordinating multiple projects whenever possible. Also, City Staff tries to minimize the City’s share of construction costs whenever feasible through Federal, State, or County participation.
The CIP is one of the best devices for implementing the General Plan and other goals and policies of the City of Ceres. It can be effective for guiding development, particularly in relation to urban expansion policies.
Benefits of Capital Improvement Programming
• Implements the City’s General Plan (particularly the circulation, land use, and public facilities elements)
• Encourages early review of priorities
• Provides opportunities for coordination among projects with respect to location, function, and timing
• Utilizes public input to assist with sites for needed projects and where advance acquisition should occur
• Provides for long-range financial planning
Ultimately, the City Council is responsible for selection of the Capital Improvement Program projects and their prioritization.
Five Y
ear Capital Improvement Plan FY2024-2028
Attached is the proposed CIP for Fiscal Year 2024-2028 for City Council’s approval. The project list continues to provide a balance of projects city -wide including street improvements, public safety, quality of life, facility maintenance and wastewater system improvements based on the priorities of the City Council. Projects are categorized by funding source, some of which are restricted funds that must be used to increase capacity of infrastructure and for purposes consistent with the specified impact fee.
Below is an overview of several key project categories.
Street Improvement Projects
Several street improvement projects are included with a variety of funding sources such as Measure L, Measure L Regional, SB1, CDBG, HSIP, CMAQ and Impact Fees. City Council approved multiple street rehabilitation and slurry seal projects in this and previous fiscal years, which will be funded through the above-mentioned funds. Funds have been allocated this fiscal year to perform necessary traffic studies as well as associated improvements to address traffic congestion, circulation capacity and public safety. CDBG funds have been programmed to enhance the Morrow Village Subdivision area in the City.
ITEM 14
Public Safety Projects
The Fire Department Training Facility will be receiving a new Fire Training Tower that will benefit the entire region.
Quality of Life Projects
Various funds will be used in upgrading certain portions of parks. Currently, Smyrna Park will be receiving some additional playground equipment and Ochoa Park has new amenities that were paid for with funds in this CIP.
Water System
The Water Master Plan is currently underway and will provide a list of system improvements which will be incorporated into future CIPs. A workshop presenting the Water Master Plan to the City Council is anticipated in the first quarter of the 2025 calendar Year, with an integrated CIP between the Water Wells, Surface Water, and the distribution system. Funds have been programmed over several fiscal years to address these types of projects.
Also included is the design and construction of the 18- inch Surface Water Transmission Main extension on Hatch Road. The design portion of this project is nearly complete, and construction costs are estimated at $5 to $6 million. These projects have been added to the CIP.
Wastewater System
The Wastewater Master Plan is currently underway and will provide a list of system improvements which will be incorporated into future CIPs. A workshop presenting the Wastewater Master Plan to the City Council is anticipated in the first quarter of the 2025 calendar year, with an integrated CIP between the lift stations, collection system and the wastewater treatment plant. The most critical component of the WWTP is the tertiary improvements to the plant that will allow the City to treat all of its wastewater. Currently, the City depend on neighboring cities to treat 1.5 - 2 million gallons per day. Funds have been programmed over several fiscal years to address this issue. These projects have been added to the CIP.
II.
REASONS FOR RECOMMENDATION:
The City has not approved a Five - Year CIP since 2020. The Five – Year CIP should be presented annually to the planning commission for conformance to the General Plan and adopted by the City Council with each City Fiscal Year budget. Additionally, there are statutory requirements that must be met by the City which require the adoption of the CIP.
III. F ISCAL IMPACTS :
The Finance Department has reviewed both the Five-Year CIP. All projects in the 2022 - 2023, 2023 – 2024, and 2024 - 2025 are funded to a certain extent or awaiting grant dollars for construction. For Fiscal Years 2026 and beyond, the numbers provided are estimates and could change.
ITEM 14
IV. EXISTING POLICY / RELATIONSHIP TO THE STRATEGIC PLAN:
This CIP is in conformance with the Ceres 2035 General Plan and the G oals of the Strategic Plan
V. PO LICY ALTERNATIVES:
City Council can choose to direct staff add, delete, or modify projects within the CIP or reject the CIP in its entirety.
VI. I NTERDEPARTMENTAL COORDINATION:
The Engineering Department has coordinated with the Public Works and Finance Departments.
VII. P UBLIC PARTICIPATION:
There are no committees, public participation events needed or anticipated for this project.
VIII. EN VIRONMENTAL REVIEW :
N/A
IX. STEPS FOLLOWING APPROVAL:
Following approval of this item, the Five- Year CIP, will be integrated into the budget document. The Finance Director will make the appropriate accounting entries.

COUNCIL AGENDA REPORT
CITY COUNCIL
Javier Lopez, Mayor
James Casey, Dist.1
Rosalinda L. Vierra, Dist. 2
Bret Silveira, Dist. 3
Daniel A. Martinez, Dist. 4
MEETING DATE: November 12, 2024
TO: Mayor and City Council
FROM: Douglas D. Dunford, City Manager
CONTACT: Michael R. Beltran II, P.E., Director of Engineering Services/City Engineer [email protected], (209) 538-5775 SUBJECT: Discussion on the Status of the SR99 Service/Mitchell Road Interchange Design Review and Conceptual Alternatives
RECOMMENDED COUNCIL ACTION:
Discussion only, no action required.
I. BACKGROUND:
NV5, Inc. (formerly known as Nolte Associates) has been involved with the SR99 Service Road/Mitchell Road Interchange from project initiation. Their current Contract with the City was originally executed in 2006 and was intended to move the Interchange pr oject to the next step. The agreement has been amended thirteen (13) times to include additional work items associated with project changed conditions and progress towards final design. Recent amendments included: Amendment No. 9 (Resolution No. 2018-065) for the preparation of the 65% Plans, Specifications, and Estimates (PS&E); Amendment No. 10 (Resolution No. 2019- 10) for preparation of the Project Approval/Environmental Document (PAED); Amendment No. 11 (Resolution No. 2021- 11) for the preparation of the 95% PS&E; Amendment No. 12 (Resolution No. 2022 -115) for increase the 95% PS&E budget; and Amendment No. 13 for design modifications and environmental assessment. The total cost of the contract plus amendments is approximately $11,500,000
The cost of th e subject project was approximately $103,000,000. Due to the extended project timeline, the cost has ballooned to approximately $220,000,000 - $250,000,000 according to NV5 estimates. Dokken served as an independent review to the NV5 design.
In analyzing the existing design Dokken estimated that the City could save approximately $25,000,000. Unfortunately, that does not bring the project to a cost that could feasibly be constructed.

Dokken provided a conceptual alternative that has an approximate cost of $86,000,000 to $105,000,000, excluding right of way acquisitions which is estimated to be $10,000,000 - $15,000,000.
