Re: Appeal
of Conditional Use Permit 24-09
April 14, 2025 – 6:00pm
Maverik Fueling Station – Ceres
Mayor, Vice
Mayor, and Members of the City Council:

This letter
is submitted on behalf of the Appellant, Mr. Sunny Ghai, and other interested business owners regarding the appeal of the above-referenced Conditional Use Permit (“CUP”) for the Maverik Fueling Station (“Project”). When the Project was approved, the Appellant had hoped to work with the Project Applicant to fashion mitigation to address environmental concerns. In carefully reviewing the relevant plans and approved CEQA documents, it became apparent however, that additional environmental concerns needed to be addressed directly with the City of Ceres (“Ceres”). We submit the following comments.

I. INTRODUCTIO
N
Stated su
ccinctly, the City’s environmental analysis is legally flawed and must be restarted. The California Environmental Quality Act (“CEQA”) (Pub. Resources Code § 21000, et. seq.) imposes upon the City the obligation to adequately evaluate the environmental consequences before approving a Project such as the proposed CUP. As discussed below, the Project’s CEQA documentation incorrectly relies upon earlier CEQA documents which are insufficient, as a matter of law, to support the CUP. This leads to critical information gaps.

Additionally, the traffic analysis critically understates the likely traffic volume and operations.

As a result, neither the public nor the decisionmakers are adequately informed as to the likely

environmental effects, all as mandated by CEQA. The City Council has no choice but to grant the Appeal, deny the CUP and instruct the applicant and staff to start over.

II. ANALYS
IS
A. The City’s Approach
The Project contemplated by the CUP was determined to be consistent with the Mitchell Ranch Center EIR (SCH# 2007092011) and the Ceres Gateway Center MND (SCH# 2019109006) per California Environmental Quality Act (CEQA) section 15168(c)(2).

The Planning Commission findings are similarly worded:

Section 1. The Planning Commission hereby confirms that the CUP is consistent with the original Environmental Impact Report (“EIR”) prepared for the Mitchell Ranch Center and the Mitigated Negative Declaration (“MND”) prepared for the Ceres Gateway Center, pursuant to Section 15168(c)(2) of the California Environmental Quality Act (“CEQA”), and that approval of this CUP entitlement is not subject to further environmental review.

B. The City’s Conclusion and Findings Regarding Section 15168(C)(2) are Flawed

1. The Staff-Prepared Documents Lack Any Meaningful Supporting Analysis The City’s documents simply present the conclusion without any explanation to the decisionmakers or the public as to how it reached that conclusion. For example, there is no explanation for the basis of finding consistency between the Project and the offsite CEQA documents. Likewise, there is no discussion of how the Project conforms to the prior program mitigation measures. When relying upon a prior CEQA document, the lead agency must explain the supporting basis for its conclusions.

2. The City expressly R elies Upon CEQA Guideline Section 15168 This Guideline provision applies to program CEQA documents. The Mitchell Ranch Center EIR is a project EIR, not a program EIR. It does not study multiple sites or related activities. That EIR applies to the Walmart located to the northwest of the CUP site. That EIR does not include any analysis of the CUP site. While the Mitchell Ranch Center EIR could have studied multiple development sites, it did not. Likewise, the Ceres Gateway Center CEQA assessment is a project CEQA document, applying to the property to the west of the CUP. It does not analyze the CUP site. It did not consider a series of related activities as part of its

evaluation. Thus, neither document is a program document. Neither analyzes the CUP site.

Thus the Staff Report’s conclusion regarding CEQA and prior environmental documentation is both procedurally and factually wrong. As there has never been an analysis of the CUP site, the City Council cannot find that the pending CUP is within the scope of the program documents as is required by Guidelines § 15168(c). Thus, it would be prejudicial error and violate CEQA for the City Council to approve the CUP based upon the documents available to the City Council.

3. The Analytic Gaps are Significant
When one examines the prior EIR, the Gateway Center’s MND, and the current Staff Report, one realizes that the City has never studied and disclosed the cumulative effects of traffic operations as it impacts General Plan standards, nor has it considered the cumulative air quality and health risks associated with diesel truck operations serving these three (3) commercial sites.

4. The Project’s Level of Service (“LOS”) Analysis is also Flawed The Fehr & Peer memorandum acknowledges that an LOS study was never conducted in conjunction with the SamBella project and then proceeds to analyze the Project as if such a study had been conducted. As further documented in the peer review of the Fehr & Peers memorandum by Armen Hovanessian Transportation Consulting (attached hereto and incorporated by reference herein as Attachment 1), the Fehr & Peers memorandum materially undercounts traffic operations and does not disclose likely operational conflicts as a function of truck operations and site design.

III. CONCLUSION
In conclusion, the City’s reliance upon other CEQA documents as program CEQA documents is wrong. A review of those documents reflect that those documents were site specific CEQA documents which did not include the CUP site. Simply put, a finding by the Council that the CUP was within the “program” of either document would be a legal fiction.

Since the City has dealt with commercial development in an incremental manner, it has never properly considered cumulative effects such as human health risk, air quality or traffic operations. Additionally, the Fehr & Peers report understates the relevant traffic operations and omits traffic safety conflicts. Individually and collectively, these are prejudicial errors that

Dear Diane G. Kindermann Henderson, Abbott & Kindermann, Inc, 2100 21 st Street, Sacramento, CA 95818
An analysis of the Fehr & Peers Memorandum for the proposed Maverick Gas Station project located in Ceres California shows that the study has several faults and shortcomings. These shortcomings are OLJtlined as follows:

TRIP GENERATION
The study claims that the number of trips that the new project generates is only slightly more than the previously approved project. This is incorrect adding 6 truck fueling positions adds 1,340 daily truck trips to the project, and these truck trips were not converted to passenger car equivalents (PCE). Trucks due to their larger size and slower acceleration are usually counted as two to three passenger car equivalents according to numerous studies, most notably the Federal Highways Administration "Comprehensive Truck Size and Weight Study". This study suggests that trucks should be counted as 2 to 3 passenger cars depending on the horsepower to weight ratio and the length of the vehicles. This was not done in this study for the truck trips generated by the 6 truck fueling positions.

CORRECTED MAVERICK TRIP GENERATION
If you use a conservate passenger car equivalence of 2 per truck trip you will generate 7,520 gross total average daily trips (ADT) instead of 6,180 trips as indicated in the revised Transportation Analysis prepared by Fehr and Peers (An increase of 1,340 ADT trips).

The net new average daily trips generated by this project using the correct analysis are 1,870 trips instead of the indicated 1,540 trips (An increase of 330 ADT trips). These are trips that have the pass-by trip adjustment discount.

The City of Ceres is currently home to two Bingo Halls that are regulated by the Ceres Municipal Code. The regulatory wording in Title 5, Chapter 19 has not been updated since March 23, 2020 (Ord. No. 2020 -1057, §1) and it has never completely aligned with the State and Federal regulations.

After months of intensive investigation and research, along with calls and meetings with IRS and State Regulators, Staff has developed the necessary wording to add to or amended Title 5, Chapter 19 of the Ceres Municipal Code.

These proposed changes to the ordinance will ensure the Police Department will be able to regulate the practices of the two Bingo Halls in the City of Ceres and establishes the parameters for any future Bingo Halls.
