SUBJECT:

Discussion Regarding Planning Commission s’ Request for City Council to Adopt an Interim Urgency Ordinance Establishing a Temporary Moratorium on New Gas Stations and Car Wash
Facilities within the City of Ceres
RECOMMENDED COUNCIL ACTION:

Staff request the City Council discuss and provide direction on whether additional staff time should be committed to pursue future agenda action items for an interim urgency ordinance establishing a temporary moratorium on new gas stations and car wash facilities within the City of Ceres.

I. BACKGROUND:

Recent Planning Commission discussions have raised concerns regarding the concentration and continued entitlement of car wash facilities and fueling stations within the City. The Planning Commission expressed concern that these uses may be approaching market saturation and may not align with long-term community goals related to economic development, employment generation, sales tax production and quality of life improvements.

The Commission made a motion of 5-0 requesting staff provide further information on the number of car wash facilities and gas stations within the City. Following a review of this information, the Planning Commission , by consensus, requested staff bring back an action item for the Planning Commission to consider recommending that the City Council adopt a n interim urgency ordinance establishing a temporary moratorium on new car wash and fueling station applications within the City.

Additionally, during the May 11, 2026, City Council meeting, Councilmember Otero requested a referral item related to the Planning Commission’s discussion. That request for noted and identified for potential future discussion. With both the Planning Commission’s continuing discussion and the Councilmember referral demonstrating an ITEM 11
interest in this topic , and to reduce duplicative staff time and resources, this item is intended to bring the matter directly to the City Council instruction on any further action.

Overview:

Pursuant to Government Code Section 65858, the City Council may adopt an interim urgency ordinance establishing a temporary moratorium on specific land uses if it finds that there is a current and immediate threat to the public health, safety, or welfare, and that the approval of additional permits, entitlements, or land use approvals would result in that threat becoming more severe. Interim urgency ordinances are temporary in nature and are commonly used to preserve the status quo while additional study or policy analysis is conducted.

An interim urgency ordinance is temporary in nature and does not permanently prohibit a land use. Rather, it temporarily pauses the acceptance or approval of specified applications while additional study, policy analysis, or ordinance amendments are completed. Pursuant to Government Code Section 65858, an interim urgency ordinance may initially be adopted for a period of 45 days. The total duration of the ordinance itself cannot exceed 24 months, while the maximum duration of the additional extension periods combined cannot exceed 22 months and 15 days.

II. REASONS FOR RECOMMENDATION:

Should the City Council wish to proceed additional staff time and resources will be required to evaluate potential next steps to bring back action items to City Council , including possible contracts for consultant services and studies necessary to support the findings required for any future moratorium or related land use regulation.

III. FISCAL IMPACTS:

Should the City Council direct staff to pursue additional analysis, staff time will be required to determine what items to bring back to Council for action. Future expenses could include consultant service to conduct a market saturation study, fiscal impact analysis, and economic development assessment. Funding for such services would need to be identified through the City's budget process or existing professional services appropriations.

Implementation of a temporary moratorium may also result in indirect fiscal impacts, including the postponement or loss of potential development impact fees, permit revenue, sales tax generation, property tax growth, and employment opportunities. These impacts have not yet been quantified and would be evaluated through the recommended study.
