COUNCIL AGENDA REPORT
City Council
Javier Lopez, Mayor
James Casey, Dist. 1
Rosalinda L. Vierra, Dist. 2
Cerina Otero, Dist. 3
Daniel A. Martinez, Dist. 4
Meeting Date: August 10, 2026
To: Mayor and City Council
From: Steve Williams, Interim City Manager
Contact: Nubia Goldstein, City Attorney, [email protected] Subject: Ordinance – An Ordinance of the City Council of the City of Ceres Adding Chapter 15.18, Electric Vehicle Charging Station Permit Expediting, to Title 15, Buildings and Construction, of the Ceres Municipal Code
Recommended Council Action:

Staff recommends that the City Council introduce Ordinance No. 2026-XXX for first reading by title only, waive further reading, to add Chapter 15.18, Electric Vehicle Charging Station Permit Expediting, to Title 15, Buildings and Construction, of the Ceres Municipal Code.

Background:

In 2015, the State of California adopted Assembly Bill 1236, codified in Government Code section 65850.7, which requires local jurisdictions to adopt an ordinance establishing an expedited and streamlined permitting process for electric vehicle charging stations (“EVCS”). In 2021, the State adopted Assembly Bill 970, codified in Government Code section 65850.71 to establish timelines related to the review and approval of EVCS applications. These bills were passed to facilitate the adoption of electric vehicle use across the state.

The proposed ordinance is intended to bring the Ceres Municipal Code into compliance with state law governing the expedited and streamlined permitting of electric vehicle charging stations.

Reasons for Recommendation:

Government Code section 65850.7 requires the City of Ceres (“City”) to adopt this ordinance that provides the following:
• Establish an expedited and streamlined permitting process for EVCS;

Page 367 of 385 ends

• Adopt and publish a checklist identifying the information required for expedited permit review;
• Allow permit applications, supporting documents, and signatures to be submitted electronically;
• Treat an application satisfying the checklist as complete and promptly issue the necessary nondiscretionary permits;
• Limit permit review to compliance with applicable health and safety requirements; • Provide a written correction notice identifying all deficiencies in an incomplete application;
• Impose only conditions necessary to address a specific adverse impact on public health or safety at the lowest feasible cost;
• Require a use permit or deny an application only when supported by substantial evidence and the required written findings; and
• Allow the Building Official’s decision to be appealed to the Planning Commission.
• Exhibit B contains the City’s proposed permit checklist. Upon the effective date of the ordinance, the City will post the checklist on its website and begin accepting permit applications electronically.

In addition to these requirements, Government Code section 65850.71 establishes mandatory timelines for reviewing electric vehicle charging station applications.

Applications for 1 to 25 charging stations are deemed complete after five business days and deemed approved 20 business days after being deemed complete, unless the City timely takes one of the actions specified by statute. For applications involving more than 25 charging stations, the corresponding deadlines are 10 business days and 40 business days.

Fiscal Impacts:

The cost associated with development of the ordinance consisted of staff time to draft and process the ordinance through the public hearing and adoption process. Ongoing implementation costs will consist of staff time for the Building Division to review and process EVCS permit applications.

Existing Policy / Relationship to the Strategic Plan:

N/A
Policy Alternatives:

1. Introduce the ordinances for first reading;

2. Provide direction to staff related to the ordinance; or

3. Deny the ordinance.

Interdepartmental Coordination

Page 368 of 385 ends

Staff worked with the Stanislaus County Building Official as well as internal departments within the City to review this ordinance.

Public Participation:

N/A
Environmental Review:

The proposed ordinance is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines section 15061(b)(3) because the Ordinance establishes
administrative procedures for the expedited permitting of electric vehicle charging stations and does not authorize any specific development or physical change to the environment.

Therefore, it can be seen with certainty that adoption of the Ordinance will not have a significant effect on the environment.

Steps Following Approval:

The City Council will consider approval of the second reading and adoption of the Ordinance at a later meeting of the City Council.

b. The terms, phrases, and words used in this Ordinance shall be construed in compliance with the definitions set forth by California Government Code Section 65850.7.
c. Building Official means the City of Ceres Building Official or their designee.

15.18.020 Expedited Electric Vehicle Charging Station Permitting.

Electric Vehicle Charging Stations which qualify for expedited permit processing, pursuant to Government Code Section 65850.7, shall be subject to the administrative permitting procedures set forth in this Chapter.

15.18.030 Expedited Review Process
Consistent with Government Code Section 65850.7, the Building Official shall implement an expedited administrative permit review process for electric vehicle charging stations, and adopt a checklist of all requirements with which electric vehicle charging stations shall comply to be eligible for expedited review. The expedited administrative permit review process and checklist may refer to the recommendations in the checklist prescribed by the most current version of the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission Vehicles in California: Community Readiness Guidebook” published by the Governor’s Office of Planning and Research. The City’s adopted checklist shall be published on the City’s website.

15.18.040 Electronic Submittals.

Consistent with Government Code Section 65850.7, the Building Official shall allow for electronic submittal of permit applications covered by this Chapter and associated supporting documentations. In accepting such permit applications, the Building Official shall also accept electronic signatures on all forms, applications, and other documentation in lieu of a wet signature by any applicant.

15.18.050 Association Approval.

Consistent with Government Code Section 65850.7, the Building Official shall not condition the approval for any electric vehicle charging station permit on the approval of such a system by an association, as that term is defined by Civil Code Section 4080.

15.18.060 Permit Application Processing.

A permit application that satisfies the information requirements in the City’s adopted checklist shall be deemed complete and be promptly processed in accordance with the timelines provided by Government Code section 65850.71. Upon confirmation by the Building Official that the permit application and supporting documents meet the requirements of the City adopted checklist, and is consistent with all applicable laws, the Building Official shall, consistent with Government Code Section 65850.7, approve the application and issue all necessary permits. Such approval does not authorize an applicant to energize or utilize the electric vehicle charging station until approval is granted by the City. If the Building Official determines that the permit application is

incomplete, they shall issue a written correction notice to the applicant, detailing all deficiencies in the application and any additional information required to be eligible for expedited permit issuance.

15.18.070 Technical Review.

It is the intent of this Ordinance to encourage the installation of electric vehicle charging stations by removing obstacles to permitting for charging stations so long as the action does not supersede the Building Official’s authority to address higher priority life-safety situations. If the Building Official makes a finding based on substantial evidence that the electric vehicle charging station could have a specific adverse impact upon the public health or safety, as defined in Government Code 65850.7, the City may require the applicant to apply for a use permit.

15.18.080 Electric Vehicle Charging Station Installation Requirements. a. Electric vehicle charging station equipment shall comply with all applicable requirements of the California Electrical Code; standards established by the Society of Automotive Engineers, the National Electrical Manufacturers Association, and accredited testing laboratories, such as Underwriters Laboratories; and, where applicable, rules of the California Public Utilities Commission or a municipal electric utility concerning safety and reliability. b. The installation of electric vehicle charging stations and associated wiring, bonding, disconnecting means, and overcurrent protective devices shall comply with Article 625 and all other applicable provisions of the California Electrical Code. c. Electric vehicle charging stations shall be incorporated into the load calculations for new or existing electrical services and shall comply with the California Electrical Code. Electric vehicle charging equipment shall be considered a continuous load. d. Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations shall meet the requirements of the California Building or Residential Code as applicable per occupancy, and the provisions of the manufacturer’s installation instructions. Mounting of charging stations shall not adversely affect building elements.

15.18.090 Appeal.

Decisions of a Building Official made pursuant to this chapter may be appealed to the Planning Commission in accordance with the procedures set forth in chapter 18.34.

SECTION 2. REPEAL OF INCONSISTENT PROVISIONS. Any provision of the City of Ceres Municipal Code or appendices thereto, inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance.

SECTION 3. SEVERABILITY. If any section, subdivision, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and

independent provision, and such holding shall not affect the validity of the remaining portions thereof.

SECTION 4. CEQA. This project is exempt under CEQA Guidelines section 15061(b)(3) in that it can be seen with certainty that there is no possibility that these amendments of and additions to the Ceres Municipal Code will have a significant impact on the environment.

SECTION 5. PUBLICATION AND EFFECTIVE DATE. This ordinance shall become effective thirty (30) days from and after its final passage and adoption, provided it is published in a newspaper of a general circulation at least within fifteen (15) days after its passage or a summary of the Ordinance is published in a newspaper of general circulation at least five (5) days prior to adoption and again at least fifteen (15) days after its passage.

CITY OF CERES

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council of the City of Ceres will conduct a public hearing to receive and consider all evidence, reports, and testimony on Monday, August 24, 2026, at 6:00 p.m., or as soon thereafter as the matters may be heard, in the City Council Chambers located at 2701 Fourth Street, Ceres, CA on the second reading and approval of an Ordinance adding Chapter 15.18, Electric Vehicle Charging Station Permit Expediting, to Title 15, Buildings and Construction, of the Ceres Municipal Code.

The proposed ordinance would establish a streamlined administrative permitting process for electric vehicle charging stations, as required by Government Code section 65850.7 (Assembly Bill 1236). The ordinance provides for the expedited review and approval of permit applications, including the use of an online permitting checklist and electronic application submission. Consistent with state law, the ordinance limits the City’s review to whether a proposed installation complies with applicable health and safety requirements and requires ministerial approval of compliant applications without discretionary review.

All interested parties are invited to attend the public hearing and provide comments on the proposed Ordinance. Public comments may be submitted by emailing [email protected] by 4:00 p.m. on the date of the hearing or verbally at the hearing.

Further information on the above hearing may be obtained or viewed at the office of the City Clerk, City Hall, 2220 Magnolia Street, Ceres, CA 95307 during regular business hours or by telephone at (209) 538-5731.

If a citizen wishes to challenge the nature of the above actions in court, they may be limited to raising only those issues they or someone else raised at the public hearing described in the notice, or in written correspondence delivered to the City of Ceres at, or prior to, the public hearing.

COUNCIL AGENDA REPORT

Rosalinda L. Vierra, Dist. 2
Cerina Otero, Dist. 3
Daniel A. Martinez, Dist. 4
Meeting Date: August 10, 2026
To: Mayor and City Council
From: Steve Williams, Interim City Manager
Contact: Nubia Goldstein, City Attorney, [email protected] Subject: Report on Planning Commission Recommendation for Interim Urgency Ordinances Imposing Temporary Moratoria on New
Fueling Stations and Car Washes
Recommended Council Action:

Information only, no action required.

Background:

At its regular meeting on July 13, 2026, the City Council discussed allocating staff time to study potential moratoria on new fueling stations and car washes, but did not reach consensus. Accordingly, this item is intended to inform the Council of the Planning Commission’s recommendation and has been agendized for informational purposes only. The Council may discuss the recommendation, but staff did not agendize the item for action because the Council did not authorize additional staff time on the matter.

In recognition of the Planning Commission’s responsibilities under Ceres Municipal Code section 2.05.040, staff placed the proposed moratoria on the Commission’s July 20, 2026, regular meeting agenda. After receiving extensive public comment, the Commission recommended that the City Council adopt:

1. An interim urgency ordinance establishing a temporary moratorium on new fueling stations within the City; and

2. An interim urgency ordinance establishing a temporary moratorium on new car washes within the City.

The proposed moratoria have generated additional public discussion since the Planning Commission made its recommendations. This report presents the Planning Commission recommendations to the City Council and provides an opportunity for the Council to discuss the matter and address public concerns. No action is required at this time, although the Council may, by consensus, direct staff to take further action.

Page 378 of 385 ends

Reasons for Recommendation:

A. Fueling Stations and Car Washes in the City.

Attachment A contains the information staff presented to the Planning Commission regarding the current status of fueling stations and car washes within the City. During its discussion, the Planning Commission identified four additional fueling locations for staff to verify:

1. SC Fuels – Whitmore (Modesto)

2. 76 Station – Joyce Avenue (Stanislaus County)

3. Triple R – Former fueling station (currently inactive)

4. George's – Central Avenue
Staff confirmed that the SC Fuels and 76 station locations are outside the City of Ceres and that the former Triple R site is no longer an active fueling station; accordingly, all three were properly excluded from the inventory. George’s Gas Station is active and should be included in any fuel station totals.

B. Interim Urgency Temporary Moratorium Ordinance.

Government Code section 65858 authorizes the City Council to adopt interim urgency ordinances establishing temporary moratoria. The Council may temporarily prohibit land uses that conflict with regulations the City is studying, upon findings of (1) a current and immediate threat to public health, safety, or welfare, and (2) that additional entitlements would result in that threat. Adoption requires a 4/5 vote; the ordinance takes effect immediately for 45 days and may be extended up to two years.

MEETING DATE: July 20, 2026
PROJECT NAME: Moratorium on New Car Wash and Fueling Station Entitlements
RECOMMENDATION:

Staff recommends that the Planning Commission not refer an item to the City Council recommending that the City Council adopt an interim urgency ordinance establishing a temporary moratorium on new car wash and fueling station entitlements within the City of Ceres.

BACKGROUND
The Planning Commission has expressed concern that additional fuel stations and car washes may contribute to market saturation and may be inconsistent with the City’s longterm economic development and quality-of-life goals.

On June 15, 2026, following discussion on the number and concentration of these uses, the Commission directed staff to return with an action item regarding a potential recommendation that the City Council adopt a temporary moratorium on new fuel station and car wash entitlements while the City evaluates its zoning regulations.

Before the Planning Commission considered the matter further, the City Manager presented the issue to the City Council at its July 14, 2026, meeting. The City Council did not reach consensus to pursue a moratorium or direct staff to devote additional resources to evaluating related regulatory options.

Accordingly, staff recommends that the Planning Commission refrain from making a recommendation at this time because the City Council did not express interest in pursuing a moratorium, and further action would require the commitment of additional staff and City Council resources.

OVERVIEW
Car Wash Facilities
The City of Ceres currently contains the following car wash facilities within City limits:
• Four franchise car washes
• One locally owned car wash
• Two self-service car washes at two gas stations
City of Ceres Planning Commission

AGENDA REPORT

Page 381 of 385 ends

ATTACHMENT A
• One 24-hour self-service car wash
• Two additional car washes currently in development
If all approved projects are constructed, Ceres would contain seven full-service car washes and three self-service car washes serving a population of approximately 49,000 residents.

The U.S. Census provides an estimated number of about two to four commercial car washes per 10,000 residents. Currently, the City has approximately one car wash for every 4,900 residents.

Fuel Stations
The City of Ceres currently contains seventeen fuel stations with three approved for a potential total of twenty fueling stations.

Ceres currently averages approximately one fuel station per 2900 residents. Statewide data indicates that California averages approximately 3.5 to 4.5 fuel stations per 10,000 residents. Although this figure indicates a higher concentration of fuel stations than the statewide population-based average, most of the City’s fuel stations are located along major transportation and commercial corridors, as shown in Figure 2.

Market Conditions
The City’s concentrations of car washes and fuel stations are higher than national averages. However, those averages may not accurately reflect market conditions in a community such as Ceres, which is located along major highway, commercial, and transportation corridors and experiences substantial commuter, commercial, and passthrough traffic.

Thousands of vehicles travel through and around Ceres each day. State Route 99 carries significant daily traffic through the City, while Mitchell Road and Service Road serve as major truck routes. Accordingly, the potential customer base for car washes and fuel stations includes not only City residents, but also commuters, employees, visitors, delivery vehicles, commercial fleets, and other motorists traveling through the City.

Car washes and fuel stations are also primarily concentrated along the City’s major commercial and transportation corridors. This development pattern suggests that these businesses are intended, at least in part, to serve regional and pass-through traffic rather than relying exclusively on the City’s resident population. Accordingly, population-based comparisons alone may not accurately establish whether either use has reached market saturation in Ceres.

On the other hand, the City’s higher-than-average concentration of car washes and fuel stations may indicate that these uses are approaching market saturation, even after accounting for demand generated by commuter, commercial, and pass-through traffic.

The available concentration does not, by itself, establish whether the existing concentration reflects sustainable market demand or an oversupply of these uses.

majority of fueling stations are along Highway 99 interchanges and major commercial corridors.

Moratorium
The Commission requested an action item to bring a recommendation to the City Council to adopt a temporary moratorium in order for the City to study and propose new regulations on car washes and fuel stations.

A. Planning Commission Authority to Make Recommendation.

Pursuant to Ceres Municipal Code section 2.05.040(F), the Planning Commission may make recommendations to the City Council concerning development within the City. A recommendation that the City Council consider adopting a temporary moratorium on a particular land use is within the Planning Commission’s authority.

B. City Council Authority to Adopt a Moratorium.

Government Code section 65858 authorizes the City Council to adopt an interim urgency ordinance temporarily prohibiting otherwise permitted land uses that may conflict with land use regulations the City is considering, studying, or intends to study within a reasonable time.

An interim ordinance may remain effective for an initial period of 45 days and may thereafter be extended in accordance with the procedures and time limits established by Government Code section 65858, for a maximum total duration of two years. Adoption of the interim ordinance and any extension require a four-fifths vote of the City Council.

C. Required Findings.

A temporary moratorium must be supported by specific findings. Accordingly, if the Planning Commission recommends that the City Council adopt a moratorium, the Commission should identify proposed findings and the evidence supporting them for the City Council’s consideration. To adopt a moratorium, the City Council must find that:

1. There is a current and immediate threat to public health, safety, or welfare; and

2. Approval of additional entitlements for the affected uses would result in that threat.

The Planning Commission would therefore need to identify the specific current and immediate threat associated with additional fueling stations or car washes. Although public health, safety, and welfare are broad concepts that may encompass traffic, environmental, infrastructure, public-safety, land-use, or other community impacts, the identified threat must be concrete and supported by evidence.

The Planning Commission would also need to explain how the approval of additional fueling stations or car washes would cause, contribute to, or exacerbate the identified threat.
