ATTACHMENT C
- 70 -
Cement shall be applied in dry form.
Cement shall be uniformly spread over the work area. For bidding purposes only the preliminary spread rate is 8.0 pounds/square foot, which is based on an assumed dry soil weight of 134.3 pcf and a mix design of 4% cement. Contractor shall verify dry soil weight and mix design prior to construction.
Spreader speed shall be controlled based on the pan test speed to maintain an application rate of
7.5 to 8.5 pounds/square foot.
The design for the FDR-C subbase shall be between 350psi – 450psi prior to paving with HMA.
The spread area should not exceed the area which can be initially mixed, uniformly moisture conditioned and compacted within 2 hours.
Mixing
The FDR-C material shall be uniformly mixed at least twice to the specified treatment depth. Mix until the mixture is visibly uniform with no streaks or pockets of cement. The mixed material shall have a uniform color reaction with sprayed phenolphthalein alcohol indicator for the full specified treatment depth.
Water must be injected through the mixer. The injection rate of mixing water must be sufficient to produce a workable FDR-C material moisture content that is at least 4% above the optimum moisture content determined by ASTM D1557. A composite sample from 5 random locations shall be taken after initial mixing and tested under ASTM D2216 or D4959 (calibrated to ASTM D2216) to confirm the moisture prior to compaction.
Mixing shall occur in a series of parallel lanes of convenient width and length. Mixing of adjoining lanes shall overlap the previous lane by at least 4 inches, but not more than 1 foot, to provide continuity. Where the mixing drum stops at the end of a lane, the position of the drum shall be marked and a subsequent lane on that longitudinal alignment shall start at least 2 feet behind the mark.
Compaction
Begin compaction within 0.5 hour of initial mixing.
Compact using equipment capable of uniform compaction throughout the thickness of the treated zone. For treatment depths greater than 0.65 feet, use an open hub/ring wheel compactor (e.g. Rex 760). Complete compaction with non-vibrating steel drum rollers or pneumatic-tired rollers. Compact to at least 95% relative compaction.
Use other compaction methods, as necessary, in areas not accessible to heavy equipment (e.g. around manholes or drain inlets).
The total time from final mixing of the pulverized material with cement to completion of compaction shall not exceed 2 hours.
ATTACHMENT C
- 71 -

PERFORMANCE BOND
KNOW ALL PERSONS BY THESE PRESENTS:
THAT WHEREAS, the City of Ceres (hereinafter referred to as “City”) has awarded to United Pavement Maintenance, Inc., (hereinafter referred to as the “Contractor”) an agreement for Richland Avenue Reconstruction (hereinafter referred to as the “Project”).
WHEREAS, the work to be performed by the Contractor is more particularly set forth in the Contract Documents for the Project dated ____/____/______, (hereinafter referred to as “Contract Documents”), the terms and conditions of which are expressly incorporated herein by reference; and
WHEREAS, the Contractor is required by said Contract Documents to perform the terms thereof and to furnish a bond for the faithful performance of said Contract Documents.
NOW, THEREFORE, we, United Pavement Maintenance, Inc., the undersigned Contractor and _____________________________________________ as Surety, a corporation organized and duly authorized to transact business under the laws of the State of California, are held and firmly bound unto the City in the sum of THREE MILLION ONE HUNDRED FIFTY-FIVE
THOUSAND TWO HUNDRED FOURTEEN DOLLARS AND SIXTY-FIVE CENTS ($3,155,214.64), said sum being not less than one hundred percent (100%) of the total amount of the Contract, for which amount well and truly to be made, we bind ourselves, our heirs, executors and administrators, successors and assigns, jointly and severally, firmly by these presents.
THE CONDITION OF THIS OBLIGATION IS SUCH, that, if the Contractor, his or its heirs, executors, administrators, successors or assigns, shall in all things stand to and abide by, and well and truly keep and perform the covenants, conditions and agreements in the Contract Documents and any alteration thereof made as therein provided, on its part, to be kept and performed at the time and in the manner therein specified, and in all respects according to their intent and meaning; and shall faithfully fulfill all obligations including the one-year guarantee of all materials and workmanship; and shall indemnify and save harmless the City, its officers and agents, as stipulated in said Contract Documents, then this obligation shall become null and void; otherwise it shall be and remain in full force and effect.
As a condition precedent to the satisfactory completion of the Contract Documents, unless otherwise provided for in the Contract Documents, the above obligation shall hold good for a period of one (1) year after the acceptance of the work by City, during which time if Contractor shall fail to make full, complete, and satisfactory repair and replacements and totally protect the City from loss or damage resulting from or caused by defective materials or faulty workmanship, Surety shall undertake and faithfully fulfill all such obligations. The obligations of Surety hereunder shall continue so long as any obligation of Contractor remains. Nothing herein shall limit the City’s rights or the Contractor or Surety’s obligations under the Contract, law or equity, including, but not limited to, California Code of Civil Procedure Section 337.15.

Whenever Contractor shall be, and is declared by the City to be, in default under the Contract Documents, the Surety shall remedy the default pursuant to the Contract Documents, or shall promptly, at the City’s option:
(1) Take over and complete the Project in accordance with all terms and conditions in the Contract Documents; or
(2) Obtain a bid or bids for completing the Project in accordance with all terms and conditions in the Contract Documents and upon determination by Surety of the lowest responsive and responsible bidder, arrange for a Contract between such bidder, the Surety and the City, and make available as work progresses sufficient funds to pay the cost of completion of the Project, less the balance of the contract price, including other costs and damages for which Surety may be liable. The term “balance of the contract price” as used in this paragraph shall mean the total amount payable to Contractor by the City under the Contract and any modification thereto, less any amount previously paid by the City to the Contractor and any other set offs pursuant to the Contract Documents.
(3) Permit the City to complete the Project in any manner consistent with local, California and federal law and make available as work progresses sufficient funds to pay the cost of completion of the Project, less the balance of the contract price, including other costs and damages for which Surety may be liable. The term “balance of the contract price” as used in this paragraph shall mean the total amount payable to Contractor by the City under the Contract and any modification thereto, less any amount previously paid by the City to the Contractor and any other set offs pursuant to the Contract Documents.
Surety expressly agrees that the City may reject any contractor or subcontractor which may be proposed by Surety in fulfillment of its obligations in the event of default by the Contractor.
Surety shall not utilize Contractor in completing the Project nor shall Surety accept a bid from Contractor for completion of the Project if the City, when declaring the Contractor in default, notifies Surety of the City’s objection to Contractor’s further participation in the completion of the Project.
The Surety, for value received, hereby stipulates and agrees that no change, extension of time, alteration or addition to the terms of the Contract Documents or to the Project to be performed thereunder shall in any way affect its obligations on this bond, and it does hereby waive notice of any such change, extension of time, alteration or addition to the terms of the Contract Documents or to the Project, including but not limited to the provisions of Sections 2819 and 2845 of the California Civil Code.

COUNCIL AGENDA REPORT
City Council
Javier Lopez, Mayor
James Casey, Dist. 1
Rosalinda L. Vierra, Dist. 2
Cerina Otero, Dist. 3
Daniel A. Martinez, Dist. 4
Meeting Date: September 28, 2026
To: Mayor and City Council
From: Steve Williams, Interim City Manager
Contact: Trenton Johnson, Police Chief, [email protected] Subject: Resolution
Approving a Five-Year Fleet 3 Basic In-Car Camera Contract with Axon Enterprise, Inc. in the Amount of $16,434.85. to be Purchased with Traffic Safety Funds, Authorizing the Interim City Manager to Execute the Agreement, and Authorizing the Finance Director to Implement the Budget Amendment
Recommended Council Action:
Staff recommends the City Council approve a five-year Fleet 3 Basic in-car camera contract with Axon Enterprise, Inc. to be purchased with Traffic Safety funds, authorize the Interim City Manager to execute the contract, and authorize the Finance Director to implement the Budget Amendment.
Background:
In August 2016, the Ceres Police Department entered into an agreement with Axon Enterprise, Inc. (Axon) for the implementation of body-worn cameras (BWC) and the Axon Evidence digital evidence management system. Since its implementation, the Axon platform has become an invaluable component of the department's commitment to transparency, accountability, officer safety, and the professional delivery of police services.
Body-worn camera footage has enhanced criminal investigations, improved the quality of evidence presented during prosecutions, resolved citizen complaints more efficiently, and provided a valuable training resource for department personnel. Additionally, Axon's cloud-based evidence management system has eliminated the need for the City to purchase, maintain, and continually expand costly on-site digital storage infrastructure, significantly reducing the workload on Information Technology staff while ensuring secure, CJIS-compliant storage of digital evidence.
Reasons for Recommendation:
To further enhance these capabilities, the Police Department proposes the installation of Axon Fleet 3 Basic in-car camera systems in two newly upfitted patrol vehicles. The Fleet 3 system integrates seamlessly with the department's existing Axon body-worn camera and evidence management platform, creating a unified digital evidence ecosystem that automatically synchronizes and stores all video evidence within Axon Evidence.
Each Fleet 3 Basic system includes two high-definition cameras:
• A forward-facing camera that records activity through the vehicle's windshield, documenting traffic enforcement, vehicle pursuits, pedestrian contacts, collisions, and other incidents occurring in front of the patrol vehicle. • A rear compartment camera that records the prisoner transport area, documenting detainee behavior during transport while protecting both the prisoner and officers from false allegations of misconduct, injury, or property damage.
The addition of in-car cameras provides several operational and risk management benefits that extend beyond those offered by body-worn cameras alone. Because bodyworn cameras may have limited fields of view or become obstructed during dynamic incidents, an in-car camera provides a stable, wide-angle perspective that captures critical events from the patrol vehicle's vantage point. This additional perspective often proves invaluable during investigations involving use of force, vehicle pursuits, officerinvolved collisions, arrests, and citizen complaints.
The purchase of the Axon Fleet 3 Basic systems represents a strategic investment in officer safety, public transparency, digital evidence collection, risk management, and the continued modernization of the Police Department's technology infrastructure. By expanding the department's existing Axon platform, the City will enhance accountability while leveraging an established system that has successfully served the Ceres Police Department for a decade.
Fiscal Impacts:
The total cost for this contract is $16,434.85.
The Traffic Safety Fund (25810) currently has a fund balance of $118,000.00. This fund balance will allow us to pay for the full five-year contract upfront. Paying for the contract in full does not affect the services provided by AXON. This budget amendment can be done with no fiscal impact to the General Fund.
Existing Policy / Relationship to the Strategic Plan:
Approving this contract aligns with one of the goals of the Strategic Plan: to “provide quality services to meet community needs, assuring that the City is helpful, well trained, properly equipped, and sufficient staff who partners with other public agencies to provide efficient services.”
Policy Alternatives:
The City Council could not authorize this contract of $16,434.85. Officers would continue to patrol without this important tool documenting events.

The ACEIP is designed to accelerate Axon’s development of technology, such as building and supporting automated features, aiming to increase safety within communities and efficiency in public safety. Axon may make limited use of Customer Content from participating customers to develop, improve, and support current and future Axon products (collectively, “ACEIP Purposes”). ACEIP has 2 modes of participation, Basic and Custom. Customer is enrolled in ACEIP Basic by default. If Customer does not want to participate in ACEIP Basic, ACEIP Custom, or both, Customer can revoke its consent at any time via email to [email protected].
1. Axon Obligations

When Axon uses Customer Content for ACEIP Purposes, Axon will:
• Use Customer Content only for ACEIP Purposes.
• Prohibit direct human access to Customer Content, including by Axon personnel and subprocessors, except as needed to perform or validate deletion.
• Retain Customer Content only as long as needed to create Transformed Content (defined below) and validate the transformations.
• Apply privacy-preserving transformations that remove identifying information appropriate to the use case (“Transformed Content”). AI model weights and similar insights that do not contain Customer Content are Transformed Content. Transformed Content is not Customer Content. • Retain and permit direct human access to Transformed Content for ACEIP Purposes. • Maintain security, privacy, and data governance programs as described in the Software and Cloud Services Terms of Use Appendix, and apply them to ACEIP.
1.2 Transparency Portal Publication
Before activating a use case, Axon will publish it on the Axon Transparency Portal (https://www.axon.com/aceipenterprise), including the product development purpose, data types involved, and privacy-preserving techniques used.

Rewrite Estimates
Estimated Amounts and Contract Terminations. Any amounts stated as due under existing or terminated contracts — including contract transfer balances carried forward to new or pending contracts — are estimates based on payments received as of the calculation date. These estimates may be adjusted if new contracts are not executed on the anticipated dates or if expected payments are not made.

For Customers with expiring agreements that include TAP refresh rights, Axon may, in its discretion, ship refresh hardware under the existing contract while renewal or replacement agreements are in progress. Any such shipments will be deemed made under the terms of the existing contract until the new contract is fully executed, after which any applicable updates, fees, or adjustments will apply.
Shipment Timing
Shipment Variance . Estimated shipment dates are provided for planning purposes only and are not guarantees. Axon may ship hardware before or after the estimated shipment date, and failure to meet an estimated shipment date will not, by itself, constitute a breach, provided Axon uses commercially reasonable efforts to meet estimated shipment dates.

COUNCIL AGENDA REPORT
City Council
Javier Lopez, Mayor
James Casey, Dist. 1
Rosalinda L. Vierra, Dist. 2
Cerina Otero, Dist. 3
Daniel A. Martinez, Dist. 4
Meeting Date: September 28, 2026
To: Mayor and City Council
From: Steve Williams, Interim City Manager
Contact: Trenton Johnson, Police Chief, [email protected] Subject: Resolution
Approving a Five-Year Statement of Work with Cotality, a CoreLogic Company in the Amount of $506.38 Per Month, Subject to the Existing Master Services Agreement and Licensing Addendum from 2022 for Access to their Property Intelligence Product using the Araya Platform for Aerial Street and Parcel Maps; and Authorizing the Interim City Manager to Execute the Statement of Work
Recommended Council Action:
Staff recommends the City Council adopt the resolution authorizing the Interim City Manager to approve a five-year Statement of Work with Cotality, a CoreLogic Company in the amount of $506.38 per month, subject to the existing Master Services Agreement and Licensing addendum from 2022 for access to their Property Intelligence Product using the Araya Platform for aerial street and parcel maps.
Background:
CoreLogic is a California-based company that has been providing real estate data and property analytics software to the public since 2010. City of Ceres staff have been using CoreLogic software since 2020. This software allows Staff in Code Enforcement, Finance and Community Development to access aerial street and parcel maps during the course of their work.
In 2022, CoreLogic’s software changed from MetroScan to RealQuest. In 2026, CoreLogic rebranded themselves to Cotality, a CoreLogic Company. The old product, MetroScan, was disbanded and replaced with a new product, Property Intelligence using the Araya Platform. To gain access to the new platform requires the City of Ceres to enter into a new contract with Cotality, a CoreLogic Company.
Reasons for Recommendation:
Property Intelligence now incorporates AI technology into the product search engine.
Users can look up individual property details (building permits, hazard risks, property research and parcel verification) using an address, owner’s name or Assessor’s Parcel Number (APN). This information is vital to the work done by our Code Enforcement, Finance, and Community Development departments.
Staff was able to review the new platform and provide feedback. The overall assessment was positive, and they are confident the new product will add greater value to their work.
Fiscal Impacts:
The funding to pay the monthly charge is included in the FY2026/27 Budget in the following accounts:
• Code Enforcement: 10013.029900
• Finance: 52773.029900, 56773.029900 and 58773.029900
• Community Development: 10075.029900
The average monthly cost that is billed to the City by CoreLogic is $506.38. This amount is split between the accounts listed above and is based on the usage by each department. The percentage split between accounts changes each month.
While CoreLogic has been rebranded to Cotality, a CoreLogic Company, there will be no change to the processing of the monthly payments — they will continue to be made payable and submitted to CoreLogic.
Wording has been added to the SOW to allow for cancellation at any time with a 30-day written notice should sufficient funds not be appropriated or otherwise made available to continue the Services.
Existing Policy / Relationship to the Strategic Plan:
Approval of this new contract aligns with the City’s Strategic Plan to “Provide quality services to meet community needs, assuring that the City has helpful, well trained, properly equipped and sufficient staff who partners with other public agencies to provide efficient services.”
Policy Alternatives:
Council could choose not to approve this new contract. Staff would be required to look for a new product and platform to meet their needs.
Interdepartmental Coordination
Staff in Code Enforcement, Finance and Community Development were notified of the product change and given the opportunity to review the new product and offer feedback.
Public Participation:

Environmental Review:

Steps Following Approval:
Upon City Council approval, the Statement of Work will be routed through the City Clerk’s office for the appropriate signatures.

COUNCIL AGENDA REPORT

Rosalinda L. Vierra, Dist. 2
Cerina Otero, Dist. 3
Daniel A. Martinez, Dist. 4
Meeting Date: September 28, 2026
To: Mayor and City Council
From: Steve Williams, Interim City Manager
Contact: Trenton Johnson, Police Chief, [email protected] Subject: Resolution
Authorizing the Interim City Manager to Approve the Purchase of Ten (10) Department Firearms, Lights and Holsters in the Amount of $14,530.45 and Approving a Fiscal Year 2026-27 Budget Amendment to Appropriate COPS (SLESF) Funds
Recommended Council Action:
Staff recommends the City Council authorize the Interim City Manager to approve the purchase of ten (10) department firearms, lights and holsters in the amount of $14,530.45 and a Fiscal Year 2026-27 Budget Amendment to appropriate COPS (SLESF) funds to pay for these purchases.
Background:
The Ceres Police Department maintains department-issued firearms for sworn personnel. As part of the Department's ongoing equipment upgrade and standardization efforts, staff have identified the need to purchase ten (10) additional department firearms.
The proposed firearms are Smith & Wesson M&P 9mm pistols with 4.25-inch barrels.
The M&P platform provides the Department with a standardized duty firearm that is appropriate for law enforcement service and is compatible with existing training and operational requirements. This firearm also comes with a red dot optic which comes from the manufacturer.
To ensure the firearms are properly equipped for duty use, each firearm will also be outfitted with a weapon-mounted flashlight and a Level III retention duty holster. Both items will help with the overall safety of the officers and community.
Reasons for Recommendation:
The purchase will provide the department with ten (10) standardized duty firearms and the necessary supporting equipment to place the firearms into service. The purchase of these ten firearms adds to the firearms purchased during FY 2025-26, bringing us to twenty (20) updated firearms for the department. This allows twenty (20) out of our fortyseven (47) sworn officers to have updated, standardized firearms.
The Streamlight TLR-1 HL-X weapon-mounted flashlight provides officers with an integrated illumination capability while maintaining the officer's ability to operate the firearm with both hands. The weapon-mounted lights will be paired with Safariland Level III retention holsters, providing an appropriate level of retention for patrol operations and reducing the risk of an officer's firearm being taken during an encounter.
Standardizing the firearm, flashlight, and holster platforms also provides operational and training benefits by allowing officers to train and work with consistent equipment.
Fiscal Impacts:
Funding for the purchase of these firearms, weapon mounted flashlights, and holsters will be provided through the COPS (SLESF) Fund which currently has a fund balance of $120,000.00. Approval of this item will require a budget amendment to appropriate $14,530.45 to account 29610.039900. Sufficient fund balance is available in the COPS (SLESF) Fund to support this amendment. No General Fund monies will be required.
The total cost of the proposed purchase is $14,530.45, broken down as follows:
• $10,736.72 for ten Smith & Wesson M&P 9mm department firearms including red dot optic and tax.
• $3,793.73 for ten Streamlight TLR-1 HL-X weapon-mounted flashlights and ten Safariland Level III holsters, including tax and shipping.
Existing Policy / Relationship to the Strategic Plan:
Approval of the purchase of these firearms, weapon mounted lights, and holsters fulfills the strategic plan for Government Operations: “Provide quality services to meet community needs, assuring that the City has…properly equipped…staff.” Policy Alternatives:
Council could choose not to approve the purchase of these firearms and additional equipment. Some of the staff would not have the newest department issued firearms.

Meeting Date: September 28, 2026

From: Steve Williams, Interim City Manager
Contact: Steve Williams, Interim City Manager, [email protected] Subject: Resolution
Approving the City of Ceres Donation Acceptance Policy and Authorizing the Interim City Manager to Implement and
Administer the Policy
Recommended Council Action:
Adopt a resolution approving the City of Ceres Donation Acceptance Policy and authorizing the Interim City Manager to implement and administer the policy.
Background:
The City periodically receives offers of donations from individuals, businesses, nonprofit organizations, contractors, vendors, developers, and other entities. Donations may include cash, equipment, materials, property, services, labor, sponsorships, or other items of value.
A citywide policy provides a consistent framework for determining when donations may be accepted administratively and when City Council approval is appropriate. The proposed policy is intended to support legitimate public purposes while protecting the integrity and independence of City operations and decision-making.
Reasons for Recommendation:
The proposed Donation Acceptance Policy establishes standards for the review, acceptance, administration, documentation, and acknowledgment of donations made to the City. The policy allows donations that serve a legitimate public purpose, are consistent with City goals and operational needs, do not create an actual or perceived conflict of interest, do not improperly obligate the City to future expenditures, and do not compromise procurement, contracting, regulatory, or enforcement responsibilities.
Acceptance authority.
The policy authorizes the City Manager to accept donations valued at up to $10,000 when the donation does not require a budget amendment, does not create ongoing expenditures beyond available appropriations, is not subject to significant restrictions or conditions, and otherwise complies with the policy. Donations exceeding $10,000, involving real property, requiring a donation agreement, creating substantial ongoing costs, containing significant restrictions, or otherwise warranting Council consideration require City Council approval.
Donations involving entities doing business with the City.
The policy establishes heightened scrutiny for donations from current or prospective contractors and vendors, developers with active applications, regulated businesses, and persons or entities seeking discretionary City approval. In addition, a donation from a donor with a pending bid, proposal, contract, application, claim, permit, regulatory review, enforcement matter, or other proceeding before the City requires City Council approval. The policy further provides that such donations may not affect or appear to affect a City decision, result in preferential treatment, or be conditioned on a contract, permit, entitlement, or other approval.
Documentation and transparency.
Donations valued above $500 must be documented in writing and include, when practical, the donor, description and estimated value of the donation, intended purpose, restrictions or conditions, and a statement that the donation creates no obligation on the part of the City. The City Manager must periodically report administratively accepted donations to the City Council and provide an annual summary of donations accepted under the policy.
City control of donated property.
Unless otherwise authorized by the City Council, accepted property becomes City property. The City retains authority to use, relocate, modify, maintain, dispose of, or discontinue use of donated property in the City's best interests. Donor recognition may be provided, but recognition may not constitute advertising, endorsement, or preferential treatment.
The proposed policy also expressly preserves the City's discretion to decline any donation that creates legal liability or operational burdens, exceeds available resources, interferes with City authority or operations, promotes commercial products, political positions, or religious activity, creates an appearance of undue influence, or is otherwise contrary to the public interest.
Fiscal Impacts:
There is no direct fiscal impact associated with adoption of the policy. Individual donations may provide financial or operational benefits to the City. The policy is designed to identify and avoid donations that would create unapproved expenditures, substantial ongoing costs, or other financial obligations. Any donation requiring a budget amendment or City Council appropriation would be presented to the City Council as required.
Existing Policy / Relationship to the Strategic Plan:
N/A
Policy Alternatives:
The Council could decide on one of the options below:
1) Adopt the resolution approving the Donation Acceptance Policy as proposed. 2) Adopt the resolution with modifications to the proposed policy. 3) Direct staff to return with revisions or additional information. 4) Take no action
Interdepartmental Coordination
Staff collaborated with the City Attorney and Finance in developing this resolution.

Public notice of this item has been provided in accordance with the Brown Act.
Members of the public will have an opportunity to address the City Council during the meeting.
Environmental Review:

Approving Amendment No. 1 to the Agreement for Construction or Services with Environment Control for Custodial Services at the City of Ceres Community Center and Authorizing the Interim City Manager to Execute the Amendment
Recommended Council Action:
Staff recommends that the City Council approve the First Amendment to the Agreement For Construction or Services with Environment Control for Custodial Services at the City of Ceres Community Center.
Background:
The Ceres Community Center is a 27,000-square-foot multi-use facility constructed in 2009. It features a variety of spaces including assembly halls, classrooms, meeting rooms, and a commercial kitchen. These areas accommodate a wide range of uses such as seminars, recreation programs, and private rentals for weddings, birthdays, anniversaries, large meetings, and other special events. Since August 2015, Environment Control has been contracted to provide custodial services for the Community Center, supporting the upkeep and cleanliness of the facility to ensure it remains welcoming and functional for all users.
Reasons for Recommendation:
Environment Control has provided custodial services at the Ceres Community Center since the beginning of the current Agreement for Construction or Services dated September 8, 2025 (the "Agreement"), and has continued to perform the required services throughout the contract term. Staff recommends continuing the existing Agreement to maintain consistency in custodial services and avoid an interruption in service at the Community Center.
The current Agreement provides the City with the option to extend the Agreement for two additional one-year terms. The proposed amendment represents the first one-year extension of the Agreement. Exercising the available extension allows the City to continue utilizing Environment Control's services without conducting a new competitive bidding process at this time.
Staff recommends approval of the First Amendment to the Agreement with Environment Control for custodial services at the Ceres Community Center and authorization for the Interim City Manager to execute the amendment.
Fiscal Impacts:
Funding for custodial services at the Ceres Community Center has been included in the adopted FY 2026/27 Recreation budget. The allocated amount, listed under account 27555.029900, is $75,000.00, which is sufficient to cover the recommended contract cost.
Existing Policy / Relationship to the Strategic Plan:
To ensure the community has access to well-maintained public facilities and infrastructure. Providing ongoing custodial services at the Ceres Community Center helps maintain the quality, cleanliness, and usability of the facility, consistent with the City’s commitment to delivering safe, welcoming, and functional spaces for residents and visitors.
Policy Alternatives:
City Council may direct staff not to extend the current Agreement. This action would leave the Ceres Community Center without contracted custodial services, which may impact the facility’s operations, cleanliness, and availability for public use.
City Council could choose to direct staff to issue a new RFP in an effort to solicit additional proposals, which may delay securing custodial services and potentially disrupt scheduled events and programs.
Interdepartmental Coordination
Public Participation:
There was coordination between the Public Works and Recreation Departments.
Environmental Review:
Steps Following Approval:
Following City Council approval, the Interim City Manager will execute the amendment with Environment Control, and the contractor will continue services on October 1, 2026.

Subject: Discussion of First Time Homebuyer Assistance Program (FTHB) Recommended Council Action:
Staff recommend the City Council discuss the potential of implementing the First Time Homebuyer Assistance Program.
Background:
The First Time Homebuyers Program (FTHB) is to assist low-and moderate-income first-time homebuyers with the purchase of a home. The home buying process can be overwhelming, especially to the inexperienced first-time homebuyer.
To maximize the effectiveness of the FTHB program as a vehicle for enhancing affordability, borrowers pay no current principal or interest on the City's mortgage during the deferment period, also known as a silent second mortgage.
To be eligible to receive HOME funds, individual households shall be low-income households when considering the gross annual income of all household residents 18 years old or older. (income equal to or less than 80% of area median income as adjusted for household size)
In the past, we have had several FTHB programs that have been able to assist several residents. Two specific HOME programs were in 2007 and 2010 that helped support individuals in new housing units.
The City held the program in-house with staff administering the program and was responsible for maintaining records and completing quarterly and annual reports.
Reasons for Recommendation:
The First Time Home Buyer Assistance (FTHB) program is designed to seek new and creative ways to make home ownership a reality for income-eligible households. The FTHB would be either a partnership with the City of Turlock or the reuse of funds from previous programs the City has held.
Most income-eligible households would not qualify for a mortgage large enough to purchase a house. The FTHB program would provide funds to help make up the difference between the value of the primary loan, for which an income-eligible applicant qualifies, and the purchase price. Essentially, the funds are used to boost the applicant's down payment and are recorded as a silent second mortgage with a very low interest rate.
Fiscal Impacts:
in 1999, the Urban County entitlement jurisdiction for the purpose of the Community Development Block Grant (CDBG) entered into an intergovernmental agreement for the Federal Home Investment Partnerships (HOME) program. HOME is one of several funding sources providing assistance to eligible borrowers under this program.
Currently, the city of Turlock has HOME funding for FTHB, and an MOU or subrecipient agreement would need to be established for service areas and to comply with all applicable HOME program requirements.
With limited staffing, the program would require one full-time clerical support staff member who would be responsible for processing applications, data entry, and providing quarterly and annual reports.
The city does not have a loan officer on site, and therefore the underwriting process would need to be contracted out to a 3rd party agency.
The Urban County representative who monitors HOME would reimburse the city up to $4,000 in support services for work linked to FTHB. The city may be able to use the reuse funds and allocate approximately 10% towards administrative costs.
Existing Policy / Relationship to the Strategic Plan:
Establish strong relationships with all sectors of the community, recognizing its cultural diversity, and increase community involvement.
Policy Alternatives:
The City Council could choose not to participate.
If the Council chooses to participate, the city would need to adopt policies and procedures created by the City of Turlock, create a loan committee, and establish an MOU with the City of Turlock.
