Bill Ihrke, City Attorney, stated that i n connection with Item #8A for the Council’s consideration, Councilmember Johnson is an employee of the County of Los Angeles and works for the Sheriff’s Department, thereby potentially having a conflict of interest based on source of income under the State’s Political Reform Act and implementing Fair Political Practices Commission (FPPC) regulations. The City Attorney’s Office, pursuant to available procedures at the FPPC, will be obtaining from the FPPC a de termination on whether Councilmember Johnson has a potential conflict of inte rest for future budget sessions. At this time, consistent with the recommendation that was made at the Council’s prior May 16 and June 6, 2022 Special Meetings, when the Council considered the proposed Fiscal Year 2022-23 Budget, Councilmember Johnson would like to recuse herself from participating in any discussions concerning the budgeting of City funds to the Sheriff’s Department out of an abundance of caution so as to avoid any potential conflict of interest.
The City Attorney further stated that s pecifically, Councilmember Johnson’s recusal request would ap ply to any discussion and vote on funds covered and described on Fiscal Year 2022-23 Preliminary Budget Pages 182 -183, identified under the Activity “Community Safety” and Cost Center Code 451, as this Cost Center is the source for funds that would be for Police and Safety Services contracted through the Sheriff’s Department.
Staff reports were given by Jeff Thielke, Budget Manager and Patricia Leyva, Personnel/Risk Manager. A PowerPoint presentation was displayed.
