The substance of that case challenges the validity of Senate Bill 9 (stats. 2021, ch. 162), mandating lot -splits or duplexes in certain single -family residential zones if certain conditions are met. MOTION: It was moved by Vo, and seconded by Johnson, to authorize the City Attorney’s Office to request of the court and to apply to participate as an amicus curiae in the existing case, AIDS Healthcare Foundation & City of Redondo Beach v. Bonta, in his capacity as California Attorney General, California Second District Court of Appeal Case No. B321875. The substance of that case challenges the validity of Senate Bill 10 (stats. 2021, ch. 163), which allows but does not require city councils, by supermajority, to adopt ordinances enabling a process to zone parcels for up to ten units of residential density per parcel for “transit -rich areas” or “u rban infill site,” as defined. The legal challenge alleges Senate Bill 10 violates a city -electorate’s voter initiative rights by enabling a city council to override land use limitations adopted by a voter-initiative ordinance. The trial court ruled in favor of Respondent Bonta, in his capacity as the California Attorney General. Petitioners have noticed an appeal (COUNCIL).
