WAIVE FULL READING OF AND ADOPT A RESOLUTION OF THE

CERRITOS CITY COUNCIL AUTHORIZING PARTICIPATION IN

THE LOS ANGELES URBAN COUNTY COMMUNITY DEVELOPMENT
BLOCK GRANT (CDBG) PROGRAM FOR THE PERIOD OF JULY 1,
2027 THROUGH JUNE 30, 2030, PURSUANT TO TERMS OF A

JOINT AGREEMENT WITH THE COUNTY OF LOS ANGELES
Since 1999, the City of Cerritos has successfully partnered with the Los Angeles County Development Authority ("LACDA") to participate in the Los Angeles Urban County Community Development Block Grant Program ("CDBG Program") for receipt of restricted Community Development Block Grant ("CDBG") program funds for the purpose of benefiting low- and moderate-income individuals in the City of Cerritos. The CDBG Program is federally funded, by way of the United States Department of Housing and Urban Development (HUD), and is administered on a local level by LACDA. LACDA receives CDBG funds from HUD on the City's behalf and disburses the funds to the City on an as-needed project basis. By participating in LACDA's local CDBG Program, the City of Cerritos is eligible to receive its allocation of CDBG funds, which can be used to complete various community development and public works projects. Utilization of CDBG funds is strictly regulated by guidelines and national objectives established by HUD. Among these national objectives established by HUD, cities are required to use CDBG funds for activities that benefit low- and moderate-income persons, with the goal of revitalizing neighborhoods, improving community facilities, preventing or eliminating blight, and/or improving accessibility for handicapped or disabled individuals.

In order to participate in the CDBG Program and receive such funds, the City is required to enter into an Agreement with LACDA. Typically, the Agreement covers a three (3) year period. The City's most recent and current Agreement with LACDA was executed in June 2023 under a Cooperation Agreement as authorized by City Council Resolution No. 2023-22 for the 2024-2027 period (see Exhibit 2, City Council Resolution No. 2023-22). On June 2, 2026, the City of Cerritos received a request from LACDA to enter into a new Joint Agreement for the City's continued participation in the CDBG Program for the period of July LYNDA P. 1, 2027 through June 30, 2030 (see Exhibit 3, LACDA Joint Agreement Letter - June 2, 2026). LACDA is requesting the execution of a Joint Agreement, rather than a Cooperation Agreement, because HUD has revised its requirements for the new qualification period. The primary difference between the Joint Agreement and the Cooperation Agreement is how CDBG funds are allocated and used. The Joint Agreement includes the phrase "in and for the benefit of the City," which ensures that the City's CDBG allocation is dedicated to projects and activities that directly benefit the City. In contrast, under the Cooperation Agreement, participating cities' allocations are determined using a funding formula applied across the entire urban county, allowing funds to be distributed on a countywide basis rather than being reserved exclusively for each individual city. Accordingly, HUD no longer permits urban counties to use Cooperation Agreements with participating metropolitan cities. Instead, HUD now requires urban counties and participating metropolitan cities to enter into Joint Agreements for continued participation in the CDBG Program.

This report provides an overview of CDBG Program guidelines and implementation in the City of Cerritos, and also seeks City Council authorization to continue participation in the CDBG program for the period of July 1, 2027 through June 30, 2030.

CDBG PROGRAM GUIDELINES
In 1974, the United States Congress introduced the CDBG Program as part of the Housing and Community Development Act to provide annual grants on a formula basis to cities and counties subject to guidelines, national objectives, and requirements established by HUD.

Among these objectives, cities are required to use CDBG funds for activities that benefit low- and moderate-income persons, with the goal of revitalizing neighborhoods and improving community facilities. Cities may also use funds to carry out activities that facilitate the removal of physical barriers to improve accessibility for persons with disabilities.

USE OF CDBG FUNDS IN THE CITY OF CERRITOS
In accordance with the restrictive guidelines governing the use of CDBG funds, each year the City has utilized its annual CDBG allocation for projects that assist in the removal of existing physical barriers, in an attempt to help improve accessibility for persons with disabilities in compliance with Americans with Disability Act (ADA) requirements. These types of projects are not limited to serving a low- or moderate-income population, but rather, are intended to serve a specific target group that may have potential income limitations. In these cases, the City's disabled population would serve as the target group, as authorized by HUD CDBG guidelines. Over the past decade, the City has developed an award-winning CDBG program, comprised of the following projects that directly serve the City's disabled and/or senior populations:

A. Improved Accessibility at City Parks: To improve accessibility and remove physical barriers for disabled persons at City parks, playgrounds, and fitness areas, surface materials that posed physical barriers, such as sand or wood chips, were replaced with new rubberized surface materials in order for disabled persons to have improved access to these areas. Over the past 13 years, the City has expended approximately $1.4 million in CDBG funds to install approximately 69,000 square feet of new rubberized surface materials at seventeen (17) City parks.

B. COVID-19 Improvements at the Cerritos Senior Center: In response to the 3 CDBG Cooperation Agreement (2027-2030)
July 27, 2026

Page 3 ends

COVID-19 pandemic, HUD allocated supplemental CDBG funds to cities as part of the Federal CARES Act, for cities to prevent, prepare for, and respond to the COVID-19 pandemic. These funds were required to be used to directly serve either disabled residents or senior populations only. As such, approximately $116,000 in CDBG funds were utilized to complete COVID-19 related improvements at the Cerritos Senior Center, including the installation of automatic doors compliant with the Americans with Disabilities Act (ADA), conversion of existing water fountains to touchless bottle refill stations, restroom improvements, and installation of HEPA HVAC filters.

C. Americans with Disabilities Act (ADA) Improvements throughout the City:

In order to improve access for disabled persons utilizing public sidewalks, the City has utilized CDBG funds to make ADA improvements within residential neighborhoods and City-owned properties, including the construction and retrofitting of accessible curb ramps, making necessary sidewalk repairs, and removing and replacing related parkway trees. To date, approximately $1.2 million CDBG funds have been used to construct and/or retrofit a total of one hundred fifty-nine (159) curb ramps/sidewalks/curb gutters, and one hundred twenty-three (123) trees have been removed and replaced in order to improve accessibility for persons with disabilities.

A detailed list of CDBG projects that have been completed, as authorized by past City Council direction, has been attached hereto as Exhibit 4.

CONCLUSION
Through the City's implementation of the CDBG program, by way of a partnership with LACDA for the implementation, management, and oversight of the program, facilitated by a Joint Agreement, the City of Cerritos has expended approximately $2.7 million of these federal CDBG restricted funds to make necessary accessibility improvements to public parks and streets without the utilization of general fund monies for these purposes. On average, the City of Cerritos receives approximately $180,000 each year from LACDA for the implementation of these projects, which directly benefit the City's presumed low- and moderate-income populations, such as persons with disabilities and seniors. In light of the administrative/procedural revision to the Joint Agreement requiring reauthorization by the City Council to continue participation, and due to the benefits received from the implementation of the CDBG Program in the City of Cerritos, it is recommended that the City Council authorize continued participation in LACDA's CDBG Program for the period of July 1, 2027 through June 30, 2030 pursuant to terms of a Joint Agreement with the County of Los Angeles (see Exhibit 5, LACDA CDBG Joint Agreement).
