Wireless Telecommunications Permit 2026-1
August 24, 2026
BACKGROUND
On August 5, 2026, the Planning Commission voted 4-0, with one Commissioner absent, to recommend that the City Council approve Wireless Telecommunication Permit 2026-1, a request by Applicant Eukon Group, on behalf of AT&T Mobility, for approval of Wireless Telecommunication Permit 2026-1 to construct a new 75-foot-high monopine (faux pine tree) wireless telecommunication facility on an existing industrial property located at 16708 Parkside Avenue, Cerritos, California, 90703. As proposed, the monopine wireless telecommunication facility will contain twelve (12) panel antennas, sixteen (16) remote radio units, and eight (8) surge suppressors. Also proposed are two (2) global positioning antennas, one (1) surge suppressor, one (1) walk up cabinet, one (1) backup generator, two (2) utility trenches, one (1) ciena panel, one (1) telco box, one (1) electrical panel, and one (1) electrical meter, all to be located beneath the proposed monopine wireless telecommunication facility within a new equipment enclosure.
Location, Zoning and Surrounding Land Uses
The subject property is located within a larger industrial park, which was originally developed in 1969 and approved via Precise Plan 68-8. There is one industrial building on the subject property used for administrative office and warehousing purposes. The subject property is a 26,001-square-foot rectangular lot located within an existing industrial park, generally located west of Norwalk Boulevard and south of 166th Street. The property is zoned Industrial (M) and is surrounded by existing industrial properties zoned M to the north, west, south, and east. To the west of the subject property is Parkside Avenue, an existing 64-foot-wide street, across which are other industrial properties zoned M (see Exhibit 2, Zoning and Location Map). The closest residential land uses are single-family residential properties located within the City of Artesia over 390 feet to the west, and over 380 feet to the north, of the proposed location for the wireless telecommunication facility.
The subject property is buffered from major arterial streets by existing industrial buildings.
Existing Conditions
The site is currently developed with an existing 13,440-square-foot concrete tilt-up industrial building located along the southern property line. The northern portion of the site is improved with a surface parking lot containing 26 parking spaces, which serves the existing administrative office and warehousing use. Vehicular access is provided by a 32- foot-wide driveway from Parkside Avenue. The remainder of the property is enclosed by perimeter fencing and adjacent industrial buildings, with a vehicular access gate located approximately 20 feet off of the Parkside Avenue frontage (see Exhibits 4 through 7, Existing Property Conditions).
A review of the subject property has found there are existing conditions that do not currently meet the requirements of the Cerritos Municipal Code. Specifically, the existing perimeter fence and vehicular access gate currently include barbed wire, which is not permitted under the Cerritos Municipal Code. Therefore, Project-Specific Condition of Approval 77 has been included to require all barbed wire to be removed. In addition, the existing parking lot is in a deteriorated condition, with worn asphalt, numerous cracks, and faded parking stall striping. To improve the appearance of the site and bring it into compliance with the City's property maintenance standards, Project-Specific Condition of Approval 78 requires the parking lot to be slurry sealed and restriped prior to final 2 3

inspection of the proposed wireless telecommunications facility. Lastly, staff observed outdoor storage of materials throughout the parking lot and in the vicinity of the existing trash enclosure on the property. Outdoor storage is not permitted in these locations, and therefore Project-Specific Condition of Approval 79 has been included to require the removal of all outdoor storage of materials and equipment and to maintain the site in compliance with the Cerritos Municipal Code.
ANALYSIS
Physical Characteristics
Wireless Telecommunication Permit 2026-1 (WTP 2026-1) is a request by Eukon Group, on behalf of AT&T Mobility, to construct a new 75'-0"-high monopine (faux pine tree) wireless telecommunication facility on an existing industrial property. The proposed facility will contain wireless antennas and related equipment on a structure designed to resemble a mature pine tree in an effort to blend the new facility within the existing environment as encouraged by the Cerritos Municipal Code.
The proposed wireless telecommunication facility is located within the existing parking lot at the northeastern corner of the subject property, adjacent to the eastern property line and abutting the neighboring industrial property. As communicated by the applicant, the facility is proposed as a replacement for AT&T's existing wireless telecommunication facility located nearby at the ABC Unified School District office at 16700 Norwalk Boulevard, Cerritos, California 90703, which is anticipated to be decommissioned. According to the applicant, the replacement facility is necessary to address a significant gap in wireless coverage.
As proposed by the applicant, the monopine will contain: twelve (12) panel antennas, consisting of eight (8) 8'-0" tall antennas and four (4) 2'-7"-tall antennas will be aligned with the monopine, and all panel antennas will be wrapped with pine needle sock covers.
The facility will also contain sixteen (16) remote radio units and eight (8) surge compressors mounted on the monopine wireless facility (see Exhibit 10, Proposed Antenna Layout Plan).
Additionally, the facility will contain two (2) global positioning antennas, one (1) surge suppressor, one (1) walk up cabinet, one (1) backup generator, two (2) utility trenches, one (1) ciena panel, one (1) telco box, one (1) electrical panel, and one (1) electrical meter to be located beneath the monopine and inside the proposed equipment enclosure (see Exhibit 11, Proposed Equipment Enclosure Plan).
Faux Tree Design
The proposed monopine structure consists of a steel monopole clad with faux bark and incorporates faux pine branches designed to replicate the appearance of a mature pine tree.
Faux branch covers and antenna concealment elements will be installed in a manner that fully screens the antenna array and all associated equipment. The overall branch design maintains a tapered conical shape, with decreasing branch length toward the top, so as to resemble a live Canary Island pine tree. The proposed design allows for the panel antennas to be placed within the bulkier portion of the faux tree without compromising the overall shape of the faux tree in an effort to blend the structure with existing surrounding trees.
The top 8'-0" of the monopine wireless telecommunication facility is dedicated solely to faux branches, with no antenna or related equipment, in an effort to maintain the integrity of the faux pine tree design. Toward the bottom of the structure, the lowest branches will be 16708 Parkside Ave - AT&T

mounted at a height of 16'-0" above ground level as a security measure in order to protect the structure from potential vandalism while still maintaining a realistic branch design.
The antennas have been designed to blend into the faux pine tree through the incorporation of pine needle socks over the antennas. Antennas will be recessed relative to the faux branches that surround them. The branches will extend beyond the face of the antennas in order for the branches to be the dominant visible features on the monopine structure. All other cables, connectors, and brackets on the structure will be mounted behind the antennas and painted natural, non-reflective greens and browns using natural hues to avoid a single uniform color (see Exhibits 12 through 13, Elevations; and Exhibits 14 through 16, Photosimulations).
One (1) equipment cabinet, housing three (3) bays, will be located at grade separated from the proposed monopine and will be contained within the new equipment enclosure. The proposed equipment cabinet will be mounted on a concrete slab, and all electrical conduit and cabling will be trenched underground. No equipment, other than the monopine structure, will protrude above the height of the existing enclosure walls. In addition, one (1) new electrical meter pedestal will be mounted to the wall of the new enclosure (see Exhibit 9, Enlarged Site Plan).
Equipment Enclosure
The proposed equipment enclosure is approximately 347 square feet and will be constructed of decorative concrete masonry unit (CMU) slump block to screen the wireless telecommunications equipment and associated utility equipment from public view. Access to the enclosure will be provided by one (1) four-foot-wide heavy-duty solid metal gate on the west elevation and one (1) eight-foot-wide double heavy-duty solid metal gate on the south elevation. In addition, a total of eight (8) new protective bollards will be installed around the perimeter of the enclosure, including one (1) removable bollard to facilitate access through the side gate. Project-specific condition of approval 80 has been added that the eight (8) bollards be painted a white color with reflectors.
The proposed wireless telecommunications facility and equipment enclosure will be located within the existing parking lot serving the industrial building, immediately adjacent to the existing trash enclosure. The existing trash enclosure will remain in its current location and will not be modified or otherwise impacted by the proposed development. To accommodate the proposed improvements, four (4) existing parking spaces will be removed. The existing industrial building contains approximately 13,440 square feet, consisting of 11,570 square feet of warehouse space and 1,870 square feet of office space. Pursuant to the Cerritos Municipal Code, warehouse uses are required to provide one (1) parking space for every 1,000 square feet of floor area, and office uses are required to provide one (1) parking space for every 250 square feet of floor area. Accordingly, the existing use requires a total of 20 parking spaces. The site currently provides 26 parking spaces, and after the removal of four (4) spaces, 22 parking spaces will remain. Therefore, the property will continue to exceed the City's minimum parking requirement by two (2) spaces, and the proposed reduction in parking will not result in a parking deficiency.
Photosimu/ations and View Impacts
The applicant has prepared a series of photosimulations, which depict how the new 4 5

monopine wireless telecommunication facility will appear in the context of existing features, including existing buildings and trees. The photosimulations show that, while the proposed monopine structure will be visible from nearby arterial streets, including Norwalk Boulevard to the east and 166th Street to the north, the facility has been designed to visually blend with the surrounding environment. The faux bark cladding, dense faux pine branches, and fully concealed antenna assemblies effectively camouflage the telecommunications equipment, allowing the structure to resemble the existing landscape. As a result, the facility is not expected to be readily distinguishable as a wireless telecommunications installation (See Exhibits 14 through 16, Photosimulations).
Regulatory Framework
Chapter 22.42 of the Cerritos Municipal Code regulates the location, placement, and design of wireless telecommunication facilities in Cerritos. The proposed project's "stealth" design features, including the faux tree design and screening of support equipment are highly encouraged in the Cerritos Municipal Code in order to maintain the City's high-quality aesthetic, park-like appearance. The proposed project has been found to meet all Cerritos Municipal Code requirements as they relate to the location, placement, and design of wireless telecommunication facilities.
In the review of proposed wireless telecommunication permits, the City submits the proposals for review by a consulting firm that provides wireless telecommunication industry technical expertise on behalf of municipalities. Attached is a copy of a report containing the consultant's findings regarding the proposed Wireless Telecommunication Permit 2026-1 (see Exhibit 18, Consultant's Memorandum). The report concludes that the City of Cerritos has no legal basis under federal law to deny this proposed project based on radio frequency (RF) emissions considerations, given that the information submitted by the applicant confirms planned compliance with Federal Communications Commission (FCC) standards governing wireless telecommunication facilities. In accordance with the consultant's recommendation, Project-Specific Condition of Approval 81 has been added related to the basis for approval on the physical design and operation of the project, which fall within the City's zoning authority over wireless telecommunication facilities under federal law.
Wireless telecommunication facilities are further regulated by the Federal Communications Commission (FCC), which ensures that such facilities comply with guidelines and requirements related to electromagnetic emissions from on-site antennas, on-site effective radiated power of all equipment, and emissions and exposure levels of the general public and workers on-site. The City of Cerritos does not have jurisdictional or regulatory authority over these aspects of wireless telecommunication facilities, but rather may regulate the location, placement, and design of said facilities. Nevertheless, the City and its wireless telecommunication consultant have reviewed the proposed project and found that it meets all FCC guidelines and requirements.
In accordance with Section 22.42.120 of the Cerritos Municipal Code, this wireless telecommunication facility is considered non-building-mounted and is subject to the location and design criteria of that section. The City of Cerritos' Wireless Telecommunication Ordinance does not mandate a particular location, design or setback for a given nonbuilding-mounted site, but rather it ranks each site on the basis of ten (10) criteria that include the aforementioned, and others, that are scored on a 30-point maximum scale.
Depending on the final score a site receives, it may be administratively approved, reviewed 6 16708 Parkside Ave - AT&T

solely by the Planning Commission (serving as the Wireless Telecommunication Design Review Board), or reviewed by both the Planning Commission and City Council before receiving final approval. Staff reviewed the subject design and scored the site at 21 points, which requires that it be reviewed by both the Planning Commission (Wireless Telecommunication Design Review Board) and the City Council (see Exhibit 17, Wireless Telecommunication Facility Criteria Checklist).
The Cerritos Wireless Telecommunication Ordinance is the City's municipal regulation set in place to balance the City's zoning and siting interests with federal laws allowing the development of wireless telecommunication facilities. The Cerritos Wireless Telecommunication Ordinance is designed to discourage carriers from proposing facilities that are poorly sited and that could result in negative impacts on the aesthetics of the community, and to encourage carriers to site and design facilities to benefit the goals and objectives of the City of Cerritos.
According to AT&T Mobility, approval of the proposed facility is requested in order to address a significant gap in service coverage in this developed industrial area. This new site will provide increased coverage to the people living, working and traveling through this area. AT&T Mobility will operate this facility in full compliance with the regulations and licensing requirements of the FCC, FAA, and the CPUC as governed by the Telecommunications Act of 1996 and other applicable laws.
The proposed AT&T Mobility wireless telecommunication facility, with the conditions of approval included in this report, represents an example of a facility that is designed to be stealth in compliance with the purpose and intent of the Cerritos Wireless Telecommunication Ordinance and at the same time reasonably fulfills most or all of the current network needs of the proposed carrier in the adjacent and surrounding areas.
CEQA COMPLIANCE
The project has been evaluated in accordance with the California Environmental Quality Act (CEQA) and the City's Environmental Impact Report Guidelines. The Cerritos Department of Community Development has determined that the proposed project is exempt from CEQA review, pursuant to Section 15303 of the State CEQA Guidelines. Specifically, CEQA Guidelines Article 19, Categorical Exemptions, Section 15303, Class 3, addresses those exemptions related to new construction of small structures. The project consists of the construction of a new 75-foot-tall monopine wireless telecommunications facility and an approximately 347-square-foot equipment enclosure. The project is substantially smaller in scale than the examples of development expressly identified under the Class 3 exemption, including single-family residences, stores, offices, motels, and restaurants. The Cerritos Department of Community Development has determined that the proposed non-buildingmounted wireless telecommunication facility and subject property meet the criteria for a categorical exemption.
Furthermore, the wireless telecommunication facility project (i) by virtue of its location, will not impact a sensitive environmental resource of hazardous or critical concern; (ii) will not have a cumulative impact on the environment through successive projects of the same type, in the same place, over time; (iii) does not have any unusual circumstances that will have a significant effect on the environment; (iv) does not impact a scenic highway; (v) is not located on a hazardous waste site; and (vi) will not adversely impact a historical 7 16708 Parkside Ave - AT&T

resource. Accordingly, none of the exceptions to categorical exemptions set forth in the CEQA Guidelines, Section 15300.2, apply to this project.
PUBLIC NOTICE
In accordance with Cerritos Municipal Code requirements, a notice of a public hearing regarding this item was posted at the City's four ( 4) designated posting boards on August 14, 2026 and mailed to owners of property within five hundred (500) feet of the subject property, at least ten (10) days prior to the public hearing on August 24, 2026.
FINDINGS
The Planning Commission has made the following findings related to the Wireless Telecommunication Permit 2026-1:
1. The proposed wireless telecommunication facility complies with the goals and objectives of the Cerritos General Plan. Goal CD-6 of the 2004 General Plan calls for ensuring that wireless telecommunication facilities are located and designed to protect the health, safety, community welfare, and aesthetic qualities of the community. The proposed monopine wireless telecommunication facility has been designed to meet this goal by incorporating the existing non-building-mounted facility into the existing site features in an effort to minimize the visual impacts of the facility on surrounding uses.
2. The proposed wireless telecommunication facility is not detrimental to existing uses or uses specifically permitted in the Industrial (M) zone in which the facility is proposed to be located. The proposed project is consistent with the stated purpose of the M zone, which is to promote appropriate land uses and to encourage the highest possible quality of design and environment, with objectives, policies, and standards set forth in order to capitalize upon the special qualities and opportunities of the area while permitting the flexibility required to consider unique and imaginative designs. The proposed project will utilize existing site features and enable the existing industrial building and associated industrial facilities to remain in operation in their current state.
3. The existing wireless telecommunication facility has been located on a site that is adequate in size and shape to accommodate the use, all setbacks, landscaping and other required features. The subject property is zoned Industrial (M), and the facility meets the intensity and site development standards set forth in Cerritos Municipal Code Chapter 22.28, which governs said zone, and Chapter 22.42, which governs wireless telecommunication facilities.
4. The proposed wireless telecommunication facility is the best alternative after considering collocation with another facility and location at another site, in light of the applicant's need to provide service along Norwalk Boulevard, 166th Street and the surrounding areas.
5. The proposed wireless telecommunication facility has been located and designed so as to be compatible with the purpose, intent and goals of Cerritos Municipal Code Chapter 22.42 and with the specific requirements and guidelines of Section 8 16708 Parkside Ave - AT&T
Wireless Telecommunications Permit 2026-1
August 24, 2026
22.42.120 governing non-building-mounted facilities related to stealth, setbacks, zone location, collocation, architectural compatibility, imperceptibility, separation from other wireless telecommunication facilities, and incorporation of existing site features. The proposed facility is a monopine (faux pine tree) contained within a proposed equipment enclosure, which is considered a major stealth design. The facility is set back greater than three hundred feet in a straight line to any properties zoned for residential uses and is designed to accommodate collocation. The design of the monopine (faux pine tree) and related equipment contained within a new equipment enclosure is architecturally compatible with typical features, natural or artificial, found on similar types of sites elsewhere in the City. The facility is imperceptible from surrounding residential uses, is perceptible from only one of the nearby streets, it is over 1,000 feet from the nearest non-stealth facility, and it is greater than 500 feet from the nearest stealth facility. The design of the facility partially incorporates some nearby or existing site features in the mounting and placement of the antenna and support equipment, but adds a new, and noticeable, element to the design.
6. The conditions of approval of Wireless Telecommunication Permit 2026-1 are necessary to implement the intent and purpose of the Cerritos Municipal Code.
Said conditions of approval clarify such areas as operation, maintenance, and the type and location of various site elements.
7. Pursuant to Section 15303 of the California Environmental Quality Act (CEQA) Guidelines, the project is exempt from CEQA review. Any potential adverse impact can be reduced to a level of insignificance through the standards of development included in the Development Code, the City's precise plan and design review process, other Municipal Code requirements, and the conditions of approval of Wireless Telecommunication Permit 2026-1. Furthermore, the project (i) by virtue of its location, will not impact a sensitive environmental resource of hazardous or critical concern; (ii) will not have a cumulative impact on the environment through successive projects of the same type, in the same place, over time; (iii) does not have any unusual circumstances that will have a significant effect on the environment; (iv) does not impact a scenic highway; (v) is not located on a hazardous waste site; and (vi) will not adversely impact a historical resource.
Accordingly, none of the exceptions to categorical exemptions set forth in the CEQA Guidelines, Section 15300.2, apply to this project.

The facility is set back greater than three hundred feet in a straight line to any properties zoned for residential uses and is designed to accommodate collocation. The design of the monopine (faux pine tree) and related equipment contained within an existing trash enclosure is architecturally compatible with typical features, natural or artificial, found on similar types of sites elsewhere in the City.
SECTION 3. PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED that the Cerritos City Council approves Wireless Telecommunication Permit 2026-1, subject to all related conditions of approval.
13 PASSED, APPROVED and ADOPTED this 24th day of August 2026.

1. Summary
Mr. Wyman Wong 1
Dr. Jonathan Kramtt:::r ,~
October 22, 2025
(MP1796} Technic eview for Proposed New Wireless
Facility located at 16708 Parkside Avenue
Eukon Group
AT&T Mobility
CXL03935
The City of Cerritos (the "City") requested that Telecom Law Firm, PC ("TLF") review the Eukon Group {"the Applicant") application, submitted on behalf of AT&T Mobility ("AT&T"}, approval to construct a new wireless facility site on a new pole designed as a 71' tall faux pine tree located at 16708 Parkside Avenue {APN: 7011-011-007}.
Within the application materials, the Applicant indicated that this wireless facility will be constructed to replace an existing nearby AT&T wireless facility site that will soon be shut down due to lease termination.
The instant project is for an entirely new site, thus we recommend the City should conclude, this new site will be subject to the normal wireless facilities code sections within the Cerritos Municipal Code ("CMC"). Accordingly, this project will be subject to a 150-day shot dock; and does not fall within the scope of Section 6409{a) because the project is not on an existing base station or antenna support.
Additionally, we recommend that the City direct the Applicant to submit a separate wireless site application to remove the existing site and restore the ground to its prior condition. That application should likely be properly processed under Section 6409{a).
With the proper mitigation measures for RF emissions safety, AT&T's proposed new facility will be in planned compliance with the FCC RF emissions guidelines. TLF recommends that the City review and condition any permit issuance for this project to be subject to the conditions proposed in this memorandum regarding RF emissions safety.
This memorandum reviews the application and related materials for technical and regulatory issues specific to wireless infrastructure. Although many technical issues implicate legal issues, the analysis and recommendations contained in this memorandum do not constitute legal advice. 2708 WIishire Boulevard• Unit 330 • S•n11 Monica• CA 90403 • T 310,312,9900 Telecoml.awFirm.com

31 2. Project Description
Mr. Wyman Wong
MP 1796 (Eukon-AT&T)
October 22, 2025
The Applicant submitted project plans dated August 26, 2025 ("Plans"). Those Plans show that AT&T is proposing to construct a 71' above ground level ("AGL"} new tower concealed as a faux pine tree ("Monopine") to attach a four-sector wireless facility. AT&T's ancillary equipment will be located within a cement masonry unit ("CMU") enclosure at the base of the Monopine. See Figure 1 for a photo simulation of the proposal.
Figure 1: Photo simulation of AT&T's Monopine (Source: Photo Simulations).
AT&T is proposing to install twelve new panel antennas to be dived equally between four sectors, sixteen remote radio units ("RRUs"), and eight new surge protectors ("Raycaps") at the antenna level on an entirely new mono-tree at a location that has not previously had a wireless site. A written summary of AT&T's proposal is described in Figure 2.

3. Alternative Sites Analysis
Following a thorough desktop review of the area surrounding the proposed location, TLF concludes that the proposed site is both technically and contextually suitable for the intended wireless facility.
While several alternative locations may offer theoretical technical viability, AT&T has provided what we review as reasonable justifications for eliminating those optionsprimarily due to land-use constraints, lack of landlord consent, or infeasibility related to permitting, see Figure 6.

The project will address the significant Gap/coverage issues outlined above and will be designed and situated so that the antennas and equipment are mostly concealed from public View. The project location was selected as the best, least intrusive solution for meeting AT& T's technical ob,ectives and the City's land use objectrves. The stealth design will allow the facility to serve its intended function withoul bemg uns1ght1v or Cdu~rng adverse impacts to s.urrounding properties .
.. ,gure b: A1ternanve ~n:es 1~ource: Jusu11cat1onJ.
According to the Applicant's Alternative Sites Analysis, the seven alternatives considered were unable to meet AT& T's service objectives in a meaningful or reliable way. In weighing the competing factors of technical performance, regulatory compliance, and community sensitivity, the proposed location emerges as the most practical and appropriate solution. It provides a credible path to regulatory approval while minimizing visual and land-use impacts relative to the rejected alternatives.
As such, the proposal reflects a reasonable and well-considered effort and appears to identify the least intrusive means of achieving AT& T's coverage goals.

37 4. Design Recommendations
Mr. Wyman Wong
MP 1796 (Eukon-AT&T)
October 22, 2025
TLF recommends the following design conditions as conditions of approval for the project:
1. All Monopine branches should extend at least two feet beyond all the antennas and treemounted transmission equipment, and above the top of the pole (the Mono pine's trunk) to achieve a natural tree canopy illusion to hide the antennas and related equipment on the Monopole.
2. Permittee shall design, update, and always maintain all branches in a way which results in the natural projection of a pine tree with natural canopy.
3. All panel antennas, cables, transmission equipment including without limitation to RRUs and DC/fiber cabinets and antenna supports affixed to the Monopine shall be painted with a camouflage pattern of brown and green as approved by the City.
4. All panel antennas shall always be covered with mock pine needle antenna socks consistent with the needles on the Monopine branches.
5. All branches shall be maintained at all times. All broken or discolored branches must be repaired or replaced without further notice from the City.
6. All antennas, RRUs and associated equipment shall be within the canopy of branches on the Monopine.
7. All cables shall be inside the trunk of the Monopine tree except at the cable exits at the top and bottom of the Monopine trunk.
5. SECTION 6409(a) ANALYSIS
As a threshold matter, the City must determine whether federal law mandates approval for this permit application. Section 6409{a) of the Middle Class Tax Relief and Job Creation Act of 2012 requires that State and local governments "may not deny, and shall approve" an "eligible facilities request" so long as the proposal does not result in a "substant[ial] change." 1 Localities must review applications submitted for approval pursuant to Section 6409(a), but the applicant bears the burden to show it qualifies for mandatory approval. 1 See Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012, Pub. L. No. 112-96, 126 Stat. 156. (Feb. 22, 2012) (codified as 47 U.S.C. § 1455(a)).
38 5.1. Eligible Facilities Request
Mr. Wyman Wong
MP 1796 (Eukon-AT&T)
October 22, 2025
Section 6409(a)(2) defines an "eligible facilities request" as a request to collocate, remove or replace transmission equipment on an existing wireless tower or base station. 2 The FCC defines "collocation" as "[t]he mounting or installation of transmission equipment on an eligible support structure for the purpose of transmitting and/or receiving radio frequency signals for communications purposes." 3 Unlike the traditional definition, a collocation for Section 6409(a) purposes does not necessarily mean two wireless sites at a shared location-it more accurately means simply "to add" transmission equipment.
The term "transmission equipment" encompasses virtually all equipment found at facilities that transmit communication signals. The FCC defines transmission equipment as [e]quipment that facilitates transmission for any Commission-licensed or authorized wireless communication service, including, but not limited to, radio transceivers, antennas, coaxial or fiber-optic cable, and regular and backup power supply. The term includes equipment associated with wireless communications services including, but not limited to, private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul. 4 A "tower" means any structure built solely or primarily to support transmission equipment, whether it supports any equipment or not.5 In contrast, a "base station" means a non-tower structure at a fixed location approved for use a wireless support by the local jurisdiction that actually supports transmission equipment under a valid permit or other approval.6
Here, AT& T's application materials do not appear to establish that the proposed modification is an eligible facilities request. Based on the application materials, the proposal does not meet the criteria to be processed under Section 6409{a).
Per the Plans, the proposal calls for a completely new support structure, in an entirely new location, to operate the antennas and all associated equipment. A newly engineered foundation and pole will be constructed to serve as the new wireless support structure, with upgraded antennas and equipment located elsewhere on the parcel.
Section 6409{a) is limited to eligible facilities requests involving the collocation, removal, or replacement of transmission equipment that does not substantially change the physical dimensions of an existing tower or base station. This represents complete redevelopment and relocation of an existing facility. Accordingly, the application does not appear to qualify as an 2 See 47 U.S.C. § 145S(a)(2).
3 See 47 C.F.R. § 1.40001(b)(2). The rules further define an "eligible support structure" as a short-hand reference to an existing wireless tower or base station at the time an applicant files a permit application. See id.§ l.40001(b)(4). 4 See id.§ 1.40001(b)(8).
5 See id.§ 1.40001(b)(9).
6 See 47 C.F.R. § 1.40001(b)(l)(iii), (iv).

"eligible facilities request" under Section 6409(a) and must be processed as a new wireless facility subject to full discretionary review.
As noted above, we recommend that that Applicant be directed by the City to file an entirely separate and new application to remove its existing site being decommissioned. That application should most likely be processed under Section 6409(a). We further recommend that the removal application be timed so that the duty to remove the improvements and restore the site to be decommissioned to its prior condition be tied to the completion and activation of this application for the new site.
6. Planned RF Compliance Evaluation
Under the Telecommunications Act of 1996, State and local governments cannot regulate wireless sites based on the environmental effects from RF emissions to the extent that such emissions comply with applicable FCC regulations. 7 The FCC occupies the field with respect to RF emissions regulation with comprehensive rules for maximum permissible exposure (collectively, the "FCC Rules"). 8 State and local governments cannot establish their own RF standardswhether more strict, more lenient or even the same. However, State and local governments may require an applicant to demonstrate "planned compliance" with the FCC Rules. 9 Wireless antennas generally operate at relatively low power, and do not require an in-depth environmental analysis when virtually inaccessible to the general public. 10 The FCC Rules "categorically exclude" wireless antennas for "cellular radiotelephone services" when mounted (1) on a structure constructed solely to support wireless antennas and (2) more than ten meters above ground.11
Here, the FCC Rules categorically exclude the AT&T antennas because the antennas are mounted on a Mono pine-a structure solely or primarily built to support wireless antennas-and all of the transmitting antennas are at least 10 meters AGL. The lowest point of the antennas is at approximately 58 feet AGL.
To demonstrate planned compliance with the FCC Guidelines, the Applicant submitted Local and State Government Advisory Committee ("LSGAC") forms. The Applicant has marked that this wireless facility is categorically excluded.
7 See 47 U.S.C. § 332(c)(7)(B)(iv).
8 See 47 C.F.R. § 1.1307 et seq.; see also FCC Office of Engineering and Technology Bulletin 65. 9 See In re Procedures for Reviewing Requests for Relief from State and Local Regulations Pursuant to Section 332(c}(7)(B)(iv) of the Communications Act of 1934, Report and Order, 15 FCC Red. 22821, 22828-22829 (Nov. 13, 2000) (declining to adopt rules that limit demonstrations of compliance). 10 See generally Human Exposure to Radio Frequency Fields: Guidelines for Cellular and PCS Sites, Consumer Guide, FCC (Oct. 22, 2014), available at https://www.fcc.gov/guides/human-exposure-rf-fields-guidelines-cellular-and-pcssites (discussing in general terms how wireless sites transmit and how the FCC regulates the emissions). 11 See 47 C.F.R. § 1.1307(b)(l).

MP 1796 (Eukon-AT&T)

Accordingly, the FCC Rules categorically exclude this site from the need for routine compliance demonstrations. A categorical exclusion does not exempt a transmitter from actual compliance.
The FCC Rules still require AT&T to affirmatively prevent unknowing access to areas where the emissions exceed the maximum permissible limits.
In this case, AT&T can demonstrate planned compliance with the FCC rules through the following recommended conditions:
1. Permittee shall keep its base station equipment gates and cabinets closed and locked at all times except when active maintenance is performed on the equipment.
2. Permittee shall ensure that all federally-required radio frequency signage be installed and maintained at all times in good condition. All such radio frequency signage be constructed of hard materials and be UV stabilized. All radio frequency signage must comply with the sign colors, sign sizes, sign symbols, and sign panel layouts in conformance with the most current versions of ANSI Z535.l, ANSI Z535.2, and ANSI C95.2 standards. All such radio frequency signage, or additional signage immediately adjacent to the radio frequency signage, shall provide a working local or toll-free telephone number to its network operations center that reaches a live person who can exert transmitter power-down control over this site as required by the FCC.
3. In the event that the FCC changes any of radio frequency signage requirements that are applicable to the project site approved herein or ANSI Z535.1, ANSI 2535.2, and ANSI C95.2 standards that are applicable to the project site approved herein are changed, Permittee, within 30 days of each such change, at its own cost and expense, shall replace the sign age at the project site to comply with the then current standards. /JLK

Planning Commission Resolution
Wireless Telecommunication Permit 2026-1
72 WHEREAS, AT&T Mobility, will operate this facility in full compliance with the regulations and licensing requirements of the FCC, Federal Aviation Administration (FAA), and the California Public Utilities Commission (CPUC), as governed by the Telecommunications Act of 1996 and other applicable laws; and WHEREAS, the City and its wireless telecommunication consultant have reviewed the project, as well as the updated conditions of approval attached hereto, and found that it meets all location, placement, and design standards of the City's Wireless Telecommunication Ordinance under Chapter 22.42 of the Cerritos Municipal Code; and
WHEREAS, a public hearing to consider said application was set and held before the Planning Commission on August 5, 2026 at the hour of 7:00 p.m., and notice of the hearing was duly given.
NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
CERRITOS does find, determine and declare:
SECTION 1. All of the above recitals are incorporated herein. SECTION 2. Based on the foregoing, and all oral and written testimony submitted to the Planning Commission at the public hearing, the Planning Commission finds and determines as follows:
73 4. The proposed wireless telecommunication facility is the best alternative after considering collocation with another facility and location at another site, in light of the applicant's need to provide service along Bloomfield Avenue, 166th Street and the surrounding areas.
5. The proposed wireless telecommunication facility has been located and designed so as to be compatible with the purpose, intent and goals of Cerritos Municipal Code Chapter 22.42 and with the specific requirements and guidelines of Section 22.42.120 governing non-building-mounted facilities related to stealth, setbacks, zone location, collocation, architectural compatibility, imperceptibility, separation from other wireless telecommunication facilities, and incorporation of existing site features. The proposed facility is a monopine (faux pine tree) contained within an existing trash enclosure, which is considered a major stealth design. The facility is imperceptible from surrounding residential uses, is imperceptible from only one of the nearby streets, it is over 1,000 feet from the nearest non-stealth facility, and it is greater than 500 feet from the nearest stealth facility.
SECTION 3. PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED that the Planning Commission recommends approval of Wireless Telecommunication Permit 2026-1 to the Cerritos City Council, subject to all related conditions of approval. 74 PASSED, APPROVED and ADOPTED this 5th day of August 2026.
