WAIVE FULL READING OF AND ADOPT A RESOLUTION OF
THE CERRITOS CITY COUNCIL APPROVING AND
ATTESTING TO THE VERACITY OF THE 2025 POWER
SOURCE DISCLOSURE ANNUAL REPORT TO THE
CALIFORNIA ENERGY COMMISSION
In 1997, the California Legislature adopted Senate Bill 1305 (SB 1305), adding Article 5 entitled "Electricity Generation Source Disclosure", to the California Code of Regulations. Under state law (Public Utilities Code§ 398.4 and § 398.5), retail suppliers of electricity must annually: (1) disclose to their end-use customers the electricity sources of their sales to those customers in the form of a Power Content Label (PCL); and (2) report this same information, together with supporting documentation in verified form, to the California Energy Commission (CEC), in the form of a Power Source Disclosure Annual Report (PSD Report). Cerritos Electric Utility (CEU) provides the PCL to its customers on the City's website annually, after the reports have been submitted to the CEC.
In 2017, the CEC regulations implemented by SB 1305 were amended by Assembly Bill 162 (AB 162). AB 162 included a provision that requires utilities to engage a certified public accountant to verify data reported in the PSD Report. AB 162 includes an exemption from the audit requirement for publicly-owned electric utilities if the governing board of the utility approves and attests to the veracity of the data contained in the PSD Report and PCL at a public meeting. In a June 2025 rulemaking, the CEC further clarified that the utility's governing board is only required to attest to the veracity of the data in the PSD Report, not the PCL, as the PCL is created based on the PSD Report.
FINDINGS
The CEU's 2025 PSD Report (Exhibit 2) has been submitted to the CEC. The PSD Report includes an attestation from an authorized agent of the CEU, under penalty of LYNDA P. JOHNSON

perjury, confirming the accuracy of the information provided. In accordance with the CEC regulations, the 2025 PCL has been posted on the City's website at cerritos.gov/ceu. The attached resolution (Exhibit 1) approves the annual PSD Report and provides the attestation to the veracity of the PSD Report as required for exemption from the third-party audit requirement.
RECOMMENDATION
Staff recommends that the Cerritos City Council waive full reading of and adopt the attached captioned resolution:

A RESOLUTION OF THE CERRITOS CITY COUNCIL APPROVING AND ATTESTING TO THE VERACITY OF THE 2025 POWER SOURCE
DISCLOSURE ANNUAL REPORT TO THE CALIFORNIA ENERGY
COMMISSION
WHEREAS, the City of Cerritos, a municipal corporation, is authorized under various provisions of the California Constitution and the general laws of California, including, specifically, Article XI, Section 9(a) of the California Constitution, Public Utilities Code Section 10004, and Government Code Section 39732(a), to establish, purchase, and operate a public utility to furnish its inhabitants with, among other things, electricity;
WHEREAS, the City of Cerritos operates a municipal electric utility (Cerritos Electric Utility);
WHEREAS, as a municipal electric utility, the Cerritos Electric Utility is generally subject to the legislative and regulatory requirements applicable to local publicly owned utilities;
WHEREAS, Senate Bill 1305, as amended by Assembly Bill 162, requires retail suppliers of electricity to disclose sources of energy being used to the California Energy Commission and consumers in the form of the Power Source Disclosure Program Annual Report and Power Content Label;
WHEREAS, the 2025 Power Source Disclosure Program Annual Report has been submitted to the California Energy Commission, and the Annual Power Content Label has been posted on the City's website for consumers to review; and WHEREAS, the 2025 Power Source Disclosure Program Annual Report includes an attestation from an authorized agent of the City, under penalty of perjury, confirming the accuracy of the information provided.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CERRITOS DOES RESOLVE AS FOLLOWS:
Section 1. All of the above recitals are incorporated herein; and Section 2. The City Council of the City of Cerritos hereby approves and attests to the veracity of the 2025 Power Source Disclosure Program Annual Report.
