5.3 VICE MAYOR REYNOLDS REQUEST - QUALITY OF LIFE BALLOT MEASURE At its meeting of 5/17/22, the Council voted to agendize a discussion about the possibility of placing a voter initiative on the November ballot that would establish the elements of quality of life as safety, cleanliness, beauty, and economic vitality which would provide a means for citizens and businesses to hold the City accountable.

Addressing the Council on this item were Nichole Nava, Julie Threet, Jody Gallaway, Jesica Giannola, Katy Thoma, Melody Proebstel, Katie Posey, Benson, Doug Guillon, and Rob Berry.

Councilmember Morgan stated for the record that prior to agreeing to a quality-of-life ballot measure that a legal opinion on unintended consequences would be needed first. He also asked that the City Attorney address what would happen if another injunction would occur should the ballot measure be successful. City Attorney Ewing stated that he would have to prepare an analysis on the election code related to initiative process.

Mayor Coolidge stated that "quality of life" would be hard to define.

Councilmember Brown expressed concern that Section 2 was not an all-inclusive list, the measure was vague and didn't address how the proposed measure would impact the settlement agreement, and that the overall language of the document was problematic.

Councilmember O'Brien also stated that he supports some parts of the proposed measure but agrees that the measure must pass legal review before any consideration.

A motion was made by Councilmember O'Brien and seconded by Councilmember Morgan to agendize Vice Mayor Reynold's request for consideration of a quality of life ballot measure at the July 5, 2022 meeting, with the City Attorney to provide a legal analysis of: (1) the proposed measure in conjunction with the applicable election laws; possible impacts due to the terms of the Warren settlement agreement; what would occur if another injunction occurs in the City; and identify any unintended consequences should the ballot measure be successful.

Vice Mayor Reynolds asked for a friendly amendment that when the legal review comes back, that the required resolution or ordinance related to a ballot measure that balances the legal terms of the settlement agreement with the proposed actions of the measure be included for possible Council action. That amendment was accepted.

The City Attorney indicated that he would analyze the proposed measure and bring back his recommendations, along with any corresponding ballot measure documents for Council's consideration at the July 5, 2022 City Council meeting.

The motion carried by the following vote:
