4.3. PUBLIC HEARING TO CONSIDER A RESOLUTION TO CONTINUE THE TEMPORARY CLOSURE OF A PORTION OF OLD HUMBOLDT ROAD TO UNAUTHORIZED VEHICLES Pursuant to California Vehicle Code Section 21101.4, the Chico City Council adopted an ordinance amending Title 10 of the Chico Municipal Code (CMC) relating to the temporary closure of streets and roads if certain conditions exist.  To address criminal activity and illegal littering/dumping, the City Council adopted a resolution to temporarily close Old Humboldt Road adjacent to Hwy 32 for 18 months.  Both codes, allow the City Council to renew such closure for additional 18-month periods if the conditions precipitating the closure continue to exist and a public hearing was held. (Report - Erik Gustafson, Public Works Director - O&M)
Recommendation :  The Public Works Director  Operations and Maintenance recommends City Council approval of the following resolution:

RESOLUTION OF THE COUNCIL OF THE CITY OF CHICO ORDERING CONTINUED TEMPORARY CLOSURE OF A PORTION OF OLD HUMBOLDT ROAD PURSUANT TO CHICO MUNICIPAL CODE CHAPTER 10.53

4.3. Staff Report

4.4. HEARING TO CONSIDER A COMPREHENSIVE CHICO MUNICIPAL CODE TITLE 18 SUBDIVISION ORDINANCE UPDATE The City has conducted a comprehensive review of the Title 18 Subdivision Ordinance for conformance with State planning law and the California Subdivision Map Act.  The intent of the update was to ensure the Code is consistent with State regulations, streamline the subdivision review process, and reorganize the Code for ease of use and clarity. Over the past several months, a subcommittee consisting of City staff, a consultant, and stakeholders comprised of engineers, surveyors and developers coordinated to identify improvements and updates to the regulations and review process. Key features of the proposed Update include assigning the Map Advisory Committee (MAC) as the approval body for parcel maps instead of the Planning Commission and allowing the Community Development Director, instead of the MAC, to approve minor mapping amendments consisting of lot line adjustments (formerly boundary line modifications), lot mergers and minor land divisions.  A notification process to the City Council of pending subdivision maps and approvals or denials would be established. (Report - Bruce Ambo, Principal Planner)
Recommendation : The Community Development Director and Planning Commission recommend that the City Council 1) Hold a public hearing regarding the update to Title 18 Subdivision Ordinance;  2) Find that the Title 18 Subdivision Ordinance update is exempt from the California Environmental Quality Act pursuant to Section 15061(b)3; and 3) Introduce the following ordinance repealing Title 18 and replacing with the comprehensive Chico Municipal Code Title 18 Subdivision Ordinance update by reading its title only:

ORDINANCE OF THE CITY OF CHICO CITY COUNCIL REPEALING TITLE 18 AND REPLACING WITH THE COMPREHENSIVE CHICO MUNICIPAL CODE TITLE 18 SUBDIVISION ORDINANCE UPDATE

5. REGULAR AGENDA

5.1. INTRODUCTION OF AN ORDINANCE AMENDING CHAPTER 1.14 OF THE CITY OF CHICO MUNICIPAL CODE TO PROVIDE FOR STREAMLINED NUISANCE ABATEMENT PROCEDURES Chapter 1.14 of the City of Chico Municipal Code, entitled "Nuisance Abatement," details the procedures required for the City to abate nuisance conditions that exist on properties throughout the City limits. The proposed ordinance provides for streamlined enforcement procedures that: (1) allow an administrative hearing officer - as appointed by the City Manager to conduct nuisance abatement hearings so that the City Council is not required to; (2) set forth administrative fines for failure to abate a nuisance; (3) enable the collection of attorneys' fees expended in the course of abating a nuisance; and ( 4) further define what conditions the City deems to constitute a nuisance. These revisions are recommended for the purposes of increasing the efficiency of completing nuisance abatement actions, motivating property owners to voluntarily abate a nuisance to avoid the imposition of costs and penalties, ensuring the City has the ability to recover costs that may otherwise provide a financial disincentive to abate a nuisance, and clarifying for code enforcement officers and property owners the variety of conditions the City deems to be a nuisance. (Report - Vincent C. Ewing, City Attorney)
Recommendation : That the City Council introduce and waive first reading of the following ordinance entitled:

ORDINANCE OF THE CITY OF CHICO AMENDING TITLE 1, CHAPTER 1.14 OF THE CITY OF CHICO MUNICIPAL CODE TO REVISE THE NUISANCE ABATEMENT CHAPTER

5.1. Staff Report

5.2. INTRODUCTION OF AN ORDINANCE AMENDING THE CITY OF CHICO MUNICIPAL CODE TO ADD CHAPTER 9.32 REGULATING STOLEN OR ABANDONED SHOPPING CARTS AND OTHER CARTS, ESTABLISHING AN ABATEMENT AND ENFORCEMENT PROGRAM The City has a substantial interest in promoting the public health, safety, and welfare of its residents, visitors, and businesses, and the aesthetic qualities of the City. Abandoned or unattended shopping carts off the premises of retail establishments can interfere with pedestrian and vehicle traffic and the use of public streets, sidewalks, public areas, and public rights-of-way for their intended purposes, and can create dangerous conditions for users of those public spaces. Since no City ordinance currently exists (there is State law guidance on this topic in the Business and Professions Code that permits implementing an ordinance at the local level), some shopping cart owners lack proper incentive to actively retrieve carts, leaving the City to remove abandoned shopping carts every week from public spaces. They can also constitute a hazard to streams, riparian areas, and other natural spaces, and contribute substantially to litter, clutter, and visual blight. The proposed ordinance would deem abandoned or unattended shopping carts found off the premises of retail establishments, on either public or private property, to be a public nuisance, subject to abatement by the City if the private retail owners of the shopping carts do not fulfill their obligations to maintain their carts on site or retrieve those that have migrated offsite. (Report - Vincent C. Ewing, City Attorney)
Recommendation :  That the City Council introduce and waive the first reading of the following ordinance entitled:

ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHICO, CALIFORNIA, ADDING A NEW CHAPTER 9.32 TO THE CHICO MUNICIPAL CODE REGULATING STOLEN OR ABANDONED SHOPPING CARTS AND OTHER CARTS, ESTABLISHING AN ABATEMENT AND ENFORCEMENT PROGRAM RELATED THERETO

5.3. Staff Report

5.4. CONSIDERATION OF AN AIR SERVICE INCENTIVE POLICY
The City Council considered an air service incentive policy that encourages new commercial carriers by waiving landing and facility lease fees up to $250,000.  Fee waivers will be for no more than twenty-four months and are industry standard when competing for new commercial air service carriers.  The goal of the policy was to initiate non-stop scheduled air service at Chico Regional Airport, and to sustain the service over the long term. (Report - Erik Gustafson Public Works Director - O&M)
Recommendation : The Director of Public Works O&M recommends that the Council approve the Administrative Procedure & Policy (AP&P) to establish an air service incentive program.

5.4. Staff Report

5.5. CONSIDERATION OF DESIGNATION OF VOTING DELEGATES FOR THE LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE The League s 2023 Annual Conference is scheduled for September 20-22, 2023, in Sacramento. To participate in the League Annual Business Meeting where League policy is established, the Council must first designate an attendee as a voting delegate. Each city may also appoint up to two alternate voting delegates, one of whom may vote in the event that the designated voting delegate is unable to serve in that capacity. Following Council action, the Voting Delegate/Alternate Form will be completed and forwarded to the League of California Cities for processing. (Report - Deborah R. Presson, City Clerk & Elections Official) Recommendation : The City Clerk recommends that should the Council wish to participate, that it designates a Councilmember as the City of Chico voting delegate for the 2023 League of California Cities Annual Conference.

Following Council direction, Planning and Police staff met to discuss the requested Code change. Through these discussions, staff identified an alternative path for Council consideration that staff believes better implements Council s intention, while also reducing cost, time, and redundancy for future applicants. (Report - Molly Marcussen, Associate Planner)
