Over the past several months, a subcommittee consisting of City staff, a consultant, and stakeholders comprised of engineers, surveyors and developers coordinated to identify improvements and updates to the regulations and (MAC) as the approval body for parcel maps instead of the Planning Commission and allowing the Community Development Director, instead of the MAC, to approve minor mapping amendments consisting of lot line adjustments (formerly boundary line modifications), lot mergers and minor land divisions. 5. REGULAR AGENDA

5.1. INTRODUCTION OF AN ORDINANCE AMENDING CHAPTER 1.14 OF THE CITY OF CHICO

MUNICIPAL CODE TO PROVIDE FOR STREAMLINED NUISANCE ABATEMENT PROCEDURES Chapter 1.14 of the City of Chico Municipal Code, entitled "Nuisance Abatement," details the procedures required for the City to abate nuisance conditions that exist on properties throughout the City limits. The proposed ordinance provides for streamlined enforcement procedures that: (1) allow an administrative hearing officer - as appointed by the City Manager to conduct nuisance abatement hearings so that the City Council is not required to; (2) set forth administrative fines for failure to abate a nuisance; (3) enable the collection of attorneys' fees expended in the course of abating a nuisance; and (4) further define what conditions the City deems to constitute a nuisance. These revisions are recommended for the purposes of increasing the efficiency of completing nuisance abatement actions, motivating property owners to voluntarily abate a nuisance to avoid the imposition of costs and penalties, ensuring the City has the ability to recover costs that may otherwise provide a financial disincentive to abate a nuisance, and clarifying for code enforcement officers and property owners the variety of conditions the City deems to be a nuisance. (Report - Vincent C. Ewing, City Attorney)
Addressing the Council on this item were James Hutchinson and Rob Berry.

A motion was made by Vice Mayor Reynolds and seconded by Councilmember van Overbeek to introduce the following ordinance:

ORDINANCE OF THE CITY OF CHICO AMENDING TITLE 1, CHAPTER 1.14 OF THE CITY OF

CHICO MUNICIPAL CODE TO REVISE THE NUISANCE ABATEMENT CHAPTER The motion carried by the following vote:

The Council recessed at 7:20 p.m. for a 15-minute break.

The meeting was reconvened, and all members were present.

5.2. INTRODUCTION OF AN ORDINANCE AMENDING THE CITY OF CHICO MUNICIPAL CODE TO ADD CHAPTER 9.32 REGULATING STOLEN OR ABANDONED SHOPPING CARTS AND OTHER

CARTS, ESTABLISHING AN ABATEMENT AND ENFORCEMENT PROGRAM The City has a substantial interest in promoting the public health, safety, and welfare of its residents, visitors, and businesses, and the aesthetic qualities of the City. Abandoned or unattended shopping carts off the premises of retail establishments can interfere with pedestrian and vehicle traffic and the use of public streets, sidewalks, public areas, and public rights-of-way for their intended purposes, and can create dangerous conditions for users of those public spaces.

Since no City ordinance currently exists (there is State law guidance on this topic in the Business and Professions Code that permits implementing an ordinance at the local level), some shopping cart owners lack proper incentive to actively retrieve carts, leaving the City to remove abandoned shopping carts every week from public spaces. They can also constitute a hazard to streams, riparian areas, and other natural spaces, and contribute substantially to litter, clutter, and visual blight.

The proposed ordinance would deem abandoned or unattended shopping carts found off the premises of retail establishments, on either public or private property, to be a public nuisance, subject to abatement by the City if the private retail owners of the shopping carts do not fulfill their obligations to maintain their carts on site or retrieve those that have migrated offsite. (Report - Vincent C. Ewing, City Attorney)

5.4. CONSIDERATION OF AN AIR SERVICE INCENTIVE POLICY
The City Council considered an air service incentive policy that encourages new commercial carriers by waiving landing and facility lease fees up to $250,000. Fee waivers will be for no more than twenty-four months and are industry standard when competing for new commercial air service carriers. The goal of the policy was to initiate non-stop scheduled air service at Chico Regional Airport, and to sustain the service over the long term. (Report - Erik Gustafson Public Works Director - O&M)
