EMERGENCY CHICO CITY COUNCIL MEETING - January 6, 2024

CALL TO ORDER - Mayor Coolidge called the Emergency Council Meeting to order at 12:00 p.m. in the Council Chamber, 421 Main Street, Chico, California.

Present: Bennett, Morgan, Winslow, Reynolds, Coolidge
Absent: Tandon, van Overbeek
3. DETERMINATION BY THE CITY COUNCIL THAT PROMPT ACTION IS NECESSARY DUE TO
THE DISRUPTION OR THREATENED DISRUPTION OF PUBLIC FACILITIES The City Council was asked to consider making a finding that an Emergency City Council Meeting A motion was made by Councilmember Morgan and seconded by Vice Mayor Reynolds to approve holding this Emergency Meeting.
A substitute motion was made by Councilmember Winslow to adjourn the meeting as Safe Space is moving their intake center to a nearby church and therefore the potential disruption no longer exists.
The motion died for a lack of a second.
The original motion to hold this meeting, carried by the following vote:
AYES: Bennett, Morgan, Reynolds, Coolidge
NOES: Winslow
ABSENT: Tandon, van Overbeek
EMERGENCY AGENDA - The public shall have an opportunity to address the Council on the items described in the agenda before or during consideration of that item. (Government Code § 54954.3(a).) The City Council was prohibited by law from considering any other business at this meeting.

The Council recessed for a 15-minute break at 1:02 p.m. The meeting was reconvened, and all members were present, with Councilmember Tandon and van Overbeek absent.

4.2. CLOSED SESSION - CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION:
Initiation of Litigation pursuant to Gov. Code Sec. 54956.9(d)(4) - (1 case) There were no speakers on this matter nor any Council disqualifications announced prior to Council recessing into Closed Session at 1:22 p.m.
4.3. CLOSED SESSION ANNOUNCEMENT
City Clerk Presson announced that Council met with the City Manager, City Attorney, and City Clerk in Closed Session, with Councilmember Tandon and Councilmember van Overbeek absent.
The Council was briefed, and a motion was made by Councilmember Morgan and seconded by Vice Mayor Reynolds to approve the following actions: (1) Safe Space to immediately cease operations at City facilities; (2) appoint two Councilmembers to attend Tuesday's, January 9th meeting with staff and representatives of Safe Space to help facilitate a trusted partnership; and (3) barring that happening, the City Attorney is directed to pursue the initiation of litigation.
The motion carried 5-0-2, with Councilmembers Tandon and van Overbeek absent.
Appointment of Two Councilmembers
A motion was made by Councilmember Morgan and seconded by Vice Mayor Reynolds to appoint Councilmembers Morgan and Winslow to attend Tuesday's, January 9, 2024 meeting between City staff and representatives from Safe Space.
The motion carried by the following vote:
AYES: Bennett, Morgan, Winslow, Reynolds, Coolidge
NOES:
ABSENT: Tandon, van Overbeek
5. ADJOURNMENT - Adjourned at 1:53 p.m. to Closed Session on Tuesday, January 16, 2024 at 5:00 or 5:30 p.m. followed by an Adjourned Regular City Council meeting at 6:00 p.m. in the Council Chamber at 421 Main St. Chico, CA.
