RE: Side Letter Agreements with Chico Management Employees and United Public Employees of California, Local 792, Regarding Animal Services Classifications REPORT IN BRIEF:
Upon approval, this item updates the City of Chico and Chico Management Employees (CME) Memorandum of Understanding effective January 1, 2026 – December 31, 2027 (2026 CME – MOU) and the City of Chico and United Public Employees of California, Local 792 (UPEC) Memorandum of Understanding effective January 1, 2026 – December 31, 2027 (2026 UPEC – MOU) with the provisions of two Side Letter Agreements regarding Animal Services classifications.
The CME Side Letter Agreement adds the Animal Services Manager classification to the CME bargaining unit, aligning the position with similar management classifications within the City and transitioning the position from an individual employment agreement to coverage under the 2026 CME – MOU. The Side Letter also establishes a salary range for the classification consistent with the Homeless Housing Coordinator, Laboratory Technical Manager, Management Analyst, and Payroll Manager classifications.
The UPEC Side Letter Agreement adds the Animal Services Associate, Animal Services Technician, and Registered Veterinary Technician classifications to the Certified Professional & Technical Unit, providing representation and coverage under the 2026 UPEC – MOU for the five employees currently serving in these classifications. The Side Letter also establishes salary ranges for the three classifications and provides for their inclusion in Exhibit A of the 2026 UPEC – MOU.
RECOMMENDATION:
The Administrative Services Director recommends approval of the CME and UPEC Side Letters as submitted.

DISCUSSION:
Section 1.4 of the 2026 CME – MOU provides for a Letter Agreement for Variation of Provisions, which allows the City and Union to vary from strict adherence to the provisions of the MOU when it is mutually beneficial to the City and Union. Similarly, Section 1.6 of the 2026 UPEC – MOU provides for a Letter Agreement for Variation of Provisions, allowing the City and UPEC to mutually agree to changes to the MOU.
Pursuant to the Meet and Confer provisions of Section 2R72.250 of the Chico Municipal Code, when the meet and confer process is concluded between the City and a recognized employee organization, agreed-upon matters are incorporated into a written memorandum of understanding or agreement and submitted to the City Council for determination and implementation on matters over which the Council has authority.
Chico Management Employees
The City and CME have agreed to add the Animal Services Manager classification to the CME bargaining unit, transitioning the position from an individual employment agreement to coverage under the 2026 CME – MOU.
Revisions to the Animal Services Manager Job Description clarify the position’s supervision and class characteristics and reflect the change in service from contractual to management.
The Side Letter establishes a salary range for the classification and adds it to Appendix 1 – Schedule of Job Titles and Hourly Pay Rates of the 2026 CME – MOU.
The change will be effective the pay period following City Council approval.
United Public Employees of California, Local 792
The City and UPEC have agreed to add the Animal Services Associate, Animal Services Technician, and Registered Veterinary Technician classifications to the Certified Professional & Technical Unit. This change will result in the addition of five employees to the bargaining unit and provide those employees with representation and coverage under the applicable provisions of the 2026 UPEC – MOU. Revisions to the Animal Services positions’ Job Descriptions clarify the positions’ supervision and class characteristics and reflect the change in service from contractual to classified.
The Side Letter Agreement establishes salary ranges for the three classifications based on an internal City analysis of comparable City classifications. The classifications and salary ranges will be added to Exhibit A of the 2026 UPEC – MOU and will become effective the pay period following City Council approval.

REGARDING OF ANIMAL SERVICES MANAGER CLASSIFICATION
WHEREAS, pursuant to the provisions of the Meyers-Milias-Brown Act (“MMBA”) and Article 1, Section 1.5, entitled “Letter Agreement for Variation of Provisions” of the Memorandum of Understanding between the City of Chico (“City”) and Chico Management Employees (“CME”), effective January 1, 2026 through December 31, 2027 (“2026 CME-MOU”), this Side Letter Agreement is entered into on September 15, 2026, between the City and the CME (“Side Letter Agreement”) as an amendment to the 2026CME-MOU.
WHEREAS, it is understood and agreed that the specific provisions contained in this Side Letter Agreement shall supersede any previous agreements, whether oral and/or written, regarding the matters contained herein; and
WHEREAS, the City and CME have agreed to add the Animal Services Manager classification to the CME bargaining unit in order to align this management position with similar classifications within the City and eliminate the position as an individual employment agreement; and
WHEREAS, the revisions to the Animal Services Manager Job Description clarify the supervision and class characteristics of the position and reflect the change in service from contractual to management; and
WHEREAS, the salary placement for the Animal Services Manager classification is proposed to be aligned with the following CME classifications: Homeless Housing Coordinator, Laboratory Technical Manager, Management Analyst, and Payroll Manager.

The position of Animal Services Manager and the pay rate as noted above are included in the 2026 CME-MOU, Appendix 1 – Schedule of Job Titles and Hourly Pay Rates.
The Animal Services Manager classification shall be included within the CME bargaining unit and shall no longer be covered by an individual employment agreement.
The inclusion of the Animal Services Manager classification and the salary range set forth herein shall become effective with the pay period (September 20, 2026 )following City Council approval.
This Side Letter Agreement shall remain in effect for the duration of the 2026 CME-MOU, which expires December 31, 2027. All other sections of the 2026 CME-MOU shall remain in full force and effect.
Any amendments or modifications to this Side Letter Agreement shall be in writing, signed and dated by both parties.

The five employees currently serving in these classifications shall be included in the Certified Professional & Technical Unit and shall be covered by the applicable provisions of the 2026 MOUUPEC.
