PAGE 2

BACKGROUND
On September 7, 2021, City Council awarded a construction contract to Norfork, Inc., Rancho Cucamonga, CA, in the amount of $86,327.00 (#2022-152) for Recycled Water Service at Ayala Park (WA225). This project incre ases flowrate to nearby fields, thus requiring less time for the sprinklers to run. Additionally, City Council authorized expenditures of up to $8,632.00 for project contingencies and $8,632.00 for construction management, project management, and inspection cost, for a total construction contract amount not-to-exceed $103,591.00.

During construction, the contractor encountered unforeseen field conditions that triggered additional work not included in the original contract and exceeded the contingency. On December 6, 2022, City Council approved a $3,202.30 construction contingency increase after these findings were presented. In total, this increased the construction contingency to $11,834.30

ISSUES/ANALYSIS
All work has been completed per the terms of the c ontract. The following is a summary of the final accounting of construction costs:

Original Construction Contract Amount $86,327.00

• Public improvements at the northeast corner of Eucalyptus and Fern Avenues including curb ramp, sidewalk, multi-purpose trail, and parkway landscape; and • The enhanced street crossings at the Eucalyptus and Fern Avenues intersection to be constructed in-lieu of a proposed traffic signal.

FISCAL IMPACT
Approval of the Addendum has no fiscal impact as it only includes in the settlement agreement terms which had been previously approved by the City Council, but which were not included in the settlement agreement because of noticing requirements.

BACKGROUND
The City entered into a settlement agreement with Lennar Homes on a large number of tracts in the City of Chino that have accessible elements under the Americans with Disabilities Act and California law, pursuant to Council action on November 15, 2022.

The approved settlement agreement did not include language regarding improvements that are the responsibility of Lennar Homes as the specific language was not provided until after the agenda posting requirements. The improvements listed in the Addendu m were previously agreed to by the City and Lennar Homes; however, this Addendum formalizes that understanding.

ISSUES/ANALYSIS
The improvements listed in the Addendum were previously agreed to by the City and Lennar Homes. This Addendum formalizes that un derstanding by amending the settlement agreement to specifically identify the improvements to be completed by Lennar Homes in the areas indicated.

SUBJECT: ACCEPTANCE OF ADDITIONAL PUBLIC IMPROVEMENTS RE SCE MULTI - USE EASEMENT TRAILS.

RECOMMENDATION
Consider and accept all additional public improvements listed below, which include the SCE easement multi-use trail completed by the Lewis Companies, and previously constructed tracts and improvements constructed by Lennar Homes, Richmond American Homes, KB Homes, and the Lewis Companies, inadvertently omitted from the agenda on November 15, 2022:
• Tract Map Nos. (inadvertently omitted from prior agenda): 16420.3, 16519, 16520, 16521, 16522, 16523, 17148, 17149, 17150, 17266, 17357, 17390, 17514, 17515, 17571, 17610, 18778, 19936, 19946, 19947, 19948, 19950, 19951, 19952, 19979, 20008, 20102, 20102.1, 20161, 20164, 20166, 20168, 20170, 20247, 20249, and 20270. • Tract Map Nos. (SCE trails): 16419 (Lots 4, 8, AF, AI and AL), 170 57 (Lots F and J), 17058 (Lots 8 and D), 17572 (Lots B and D), 20120 (Lot E).

FISCAL IMPACT
Acceptance of the additional public improvements will not result in any significant fiscal impact.

Prior Council authority included acceptance of the above tracts , but they were inadvertently not listed on the agenda. Some were included in the accompanying staff report considered by the Council at its November 15, 2022 meeting. Information regarding the SCE easement multi -use trails was not available in time for pu blication on the prior agenda. This acceptance corrects the prior procedural error and completes acceptance of all tracts included in the prior settlement agreements.

BACKGROUND
The City entered into a settlement agreement with the Lewis Companies, Lennar Homes, Richmond American Homes, and KB Homes on a large number of tracts in the City of Chino that have accessibl e elements under the Americans with Disabilities Act and California law, pursuant to Council action on November 15, 2022.

The agenda inadvertently did not list tract map information for the SCE multi -use easement trails; however, the tract information was included in the staff report for the settlement agreements. Additionally, tract map numbers with completed construction and included in the settlement agreements, or which have otherwise been approved with bond releases but not yet accepted, should have be en listed on the agenda for formal acceptance. These acceptances correct the prior procedural errors.

ISSUES/ANALYSIS
The agenda for the January 17, 2023 meeting should include for acceptance, the following tracts:
• Tract Map Nos. 16419 (Lots 4, 8, AF, AI a nd AL), 16420.3, 16519, 16520, 16521, 16522, 16523, 17057 (Lots F and J), 17058 (Lots 8 and D), 17148, 17149, 17150, 17266, 17357, 17390, 17514, 17515, 17571, 17572 (Lots B and D), 17610, 18778, 19936, 19946, 19947, 19948, 19950, 19951, 19952, 19979, 20008 , 20102, 20102.1, 20120 (Lot E), 20161, 20164, 20166, 20168, 20170, 20247, 20249, and 20270.

These tracts would have been accepted by the Council on November 15, 2022 but for the inadvertent error of not publishing the tract information on the agenda, as r equired. Acceptance of these tracts completes a required step in the settlement agreement and clarifies their status, consistent with prior Council direction on these legacy improvements.

BACKGROUND
The Parkside Village Community is located on east side of Yorba Avenue about mid -way between Chino Avenue and Riverside Drive. Within the community is the 4700 block of Doheny Drive, San Clemente Lane, the 4700 block of Oceanside Drive, San Simeon Lane, and Cardiff Place.

Staff has received a petition from the Parkside Village Community requesting the establishment of a Residential Parking Permit Area within the ir entire community. On December 6, 2022, the City Council approved a survey (Exhibit A) prepared by the City Traffic Engineer that determined sufficient findings could exist to address the community on -street parking concerns through the establishment of Residential Permit Parking.

ISSUES/ANALYSIS
The Parkside Village Community conducted a vote of their Homeowners Association and have approved a vote approving the establishment of a Residential Permit Parking Area throughout their community. In compliance with Chino Municipal Code Chapter 10.29.040 staff prepared the attached survey finding sufficient evidence to support the establishment of a Residential Permit Parking Area within the Parkside Village Community. Please see the attached staff report from th e December 6, 2022 City Council meeting for additional analysis and detail (Exhibit B).

A Notice of Public Hearing was published two times in the Chino Champion, was prominently posted near the only entrance into the community, and notices were mailed to a ll potential impacted residents and businesses at least ten days prior to the public hearing.

SUBJECT: Request for Permit Parking Zone in the Parkside Village Community

The Parkside Village Community is located just east of Yorba Avenue between Riverside Drive and Chino Avenue at Doheny Drive. The community contains 59 single family homes and a private park maintained by the community HOA. Just south of the community are the Yorba Court Apartments and the Park West Apartments. The residents of Parkside Village community have expressed concerns with overflow parking from these apartments inside their community.

In reviewing the concerns, the Police Department, Public Works Services Division, and the Transportation Division have increased available on-street parking on Yorba Avenue by removing unnecessary parking restrictions and have met with property managers of both apartment complexes to request apartment residents’ coop eration in avoiding parking in the nearby community. While use of available parking on Yorba Avenue has increased, these efforts have not fully resolved the community’s concerns . The community is therefore requesting the establishment of permit parking within their community. Staff has met with the HOA Board and explained the advantages and disadvantages of permit parking including; • Relocation of nuisance parking outside of the community increasing availability of on - street parking for community use;
• Residents purchase of permits from the Police Department to park in their community on public streets;
• Increase of traffic signage to appropriate ly identify streets within the community as prohibited from parking without a permit;
• Parking prohibition applies to all vehicles not displaying a permit, including vehicles belonging to residents and their guests;
• Permit parking will be applied to the entire community even though the issue is currently concentrated near the community entrance.

The community h as acknowledged that permit parking with impact public parking within the community. A petition of the residents was received by city staff and the HOA has approved a vote of its residents to proceed with requesting Permit Parking within the community.

Permit Parking Zones involve the posting of specific parking by permit only signs on designated streets. The California Vehicle Code allows local jurisdictions to create such areas through local

ordinance. Chino Municipal Code (CMC) 10.29 describes the param eters for permit parking establishment in the City of Chino. In summary, the city must conduct a survey of the requested area to determine the extent of the parking concern, the status of available curbside parking, if permit parking will help address how out-of-area parking impacts the health and safety of the community, the likelihood permit parking will address these concerns.

Area map highlighting the Parkside Village Community

In accordance with CMC (10.29.040.B), a survey was completed to investigate the justification for permit parking on the 4700 block of Doheny Drive, San Clemente Lane, the 4700 block of Oceanside Drive, San Simeon Lane, and Cardiff Place within the community . Justifications for establishing permit parking include the following:

1. The vast majority of parking along Doheny Drive and San Simeon Lane were observed as having been occupied. A license plate survey of the vehicles occupying these on-street

parking areas revealed over 50% of these vehicles were not registered to addresses within the Parkside Village Community.

2. Parking was observed encroaching into corners of intersections, blocking curb ramps and fire hydrants, and obscured line -of sight at intersections and driveways creating undesirable traffic conditions which can contribute to dangerous conditions. Some of these parking behaviors are not legal and do not require permit parking to be addressed. These vehicles are not community residents.

3. Much of the available parking on Doheny Drive east of Yorba Avenue and on San Simeon Lane has been observed as being occupie d especially at night and over the weekend.

Multiple surveys at various days and times including weekends were conducted. The other streets within the neighborhood were observed as having an abundance of available on- street parking and thus the issue is co ncentrated around the entrance to the community.

Limiting permit parking only to the affect area would likely result in moving the issue deeper into the community and thus the entire community is recommended to be signed as permit parking to avoid relocating the issue further into the community.

4. Permit Parking is very likely to address this concern within the community. It is not known if all available parking within the adjacent apartment complex facilities is at capacity and if apartment residents use Parkside Village Community parking generally for convenience or for necessity.

5. An abundance of available and convenient alternative public parking areas currently exists along Yorba Avenue to accommodate parking restricted within the community.

6. The Parkside Village Community has a single point of access to the community on Doheny Drive, by implementing permit parking in the neighborhood, evacuation and emergency response access to the commu nity would be less likely to have conflicts with vehicle s parked on-street.

7. Parking restrictions are requested by the community to be for overnight parking only, which allows daytime guest parking without permit. In observations made by staff, overnight and weekend parking is when the concern is most significant. Restriction permit parking to overnight would address the primary concerns of the residents while minimizing parking restrictions to their guests. However, police parking enforcement resources are limited during night s and weekends . The police department has daytime staff assigned specifically to address parking related issues including permit parking. Staff recommends that parking restrictions be in effect all day every day to help ensure responsiv eness to requests for enforcement by the community. The community would be inconvenienced as guest permits would be required anytime community members have gatherings.

In reviewing the concerns of the Parkside Village Community and reviewing the current impact out-of-area parking is having on the community under the current Chino Municipal Code, it is my recommendation that sufficient findings can be made to proceed with the establishment of a new Residential Permit Parking Zone within the community on the roadways identified above within the community. Upon City Council concurrence and approval of this survey, a public hearing will be set within 45 days, and public notice will occur through noticing in the Chino Champion two times and through public posting within the neighborhood or through directing mailing at the option of the City Council within 10 days of the public hearing date as specified in the CMC.

FROM: NICHOLAS S. LIGUORI, AICP, DEVELOPMENT SERVICES DIRECTOR SUBJECT: CONSIDERATION OF THE ESTABLISHMENT OF A RESIDENTIAL PARKING PERMIT AREA WITHIN THE PARKSIDE VILLAGE COMMUNITY.

RECOMMENDATION
1) Receive the parking survey prepared by the City Traffic Engineer evaluating the need to establish a Residential Permit Parking Area (RPPA) within the Parkside Village Community; 2) determine if evidence exists to schedule a public hearing on Tuesday, January 17, 2023 to establish said RPPA; and 3) determine if notice of the public hearing shall include mailed notices to every residence in the proposed RPPA impacted area, in accordance Chapter 10.29 of the Chino Municipal Code.

FISCAL IMPACT
This action will establish a new residential permit parking area which will require signage and staff time to setup and maintain signs, permits, and requests from the public. Some minimal revenue may be realized through enforcement activities and permit issuance. Funds for these materials and services will be absorbed through the current approved operations and maintenance budget. No new funding is requested with this action.

PERMIT AREA WITHIN THE PARKSIDE VILLAGE COMMUNITY
PAGE 2

BACKGROUND
California Vehicle Code Section 22507 allows the City Council to establish, by ordinance or resolution, residential permit parking areas on streets in residential neighborhoods prohibiting parking on designated streets unless displaying an appropriate parking permit. Chino Municipal Code (CMC) Chapter 10.29 addresses the establishment and administration of residential permit parking.

Residential Permit Parking Areas (RPPA) were first established in Chino in 1975 to address parking issues related to Chino High School. Since then, multiple resolutions adding RPPAs have occurred with the last area established in 2016 for Guardian Way adjacent to Walnut Elementary School. The permit parking program thus far has been utilized to address school related parking and traffic impacts to adjacent communities around Chino High School, Don Lugo High School, Ramona Junior High School, and Walnut Elementary School.

The Parkside Village Community (TM 9512) is located off the east side of Yorba Avenue between Riverside Drive and Chino Avenue, consisting of 59 single-family homes, and a private Homeowners Association (HOA) maintained community park. The sole entr ance into the community is on Doheny Drive. The community contains the 4700 block of Doheny Drive, the 4700 block of Oceanside Drive, San Simeon Lane, San Clemente Lane, and Cardiff Place. All these streets are public streets. The community HOA sees to the communities’ needs and includes the maintenance of the private park located within the community. The Parkside Village Community is surrounded by single -family residential homes, a mobile home park, multi -family residential, and apartment complexes. Light industrial and commercial development exists further south, along with commercial/retail uses further north of the community.

ISSUES/ANALYSIS
City staff received concerns about excessive parking within the Parkside Village Community in early 2021. The com munity believes that the excessive parking results from overflow from the adjacent apartment complexes. The Transportation Division, Services Division and the Police Department have worked together to address these concerns with the community. Parking restrictions on Yorba Avenue in the vicinity were evaluated and modified to safely increase the amount of on-street parking available to the public. The managers of the apartment complexes were contacted in -person, and staff requested that they notify their re sidents about available parking in the area, and the responsible use of adjacent neighborhood parking. The Police Department responded to several requests for service related to parking violations.

Staff's efforts thus far have not been able to fully addre ss the concerns of the Parkside Village Community. Staff received a petition from the residents of the Parkside Village Community requesting the establishment of a Residential Permit Parking Area (RPPA) within their community. They believe that vehicle own ers from outside of their community are choosing to park in their community, which is impacting their welfare and wellbeing.

Staff has had multiple conversations with the Parkside Village Community HOA board members and its residents discussing their park ing concerns and the advantages and disadvantages of permit parking. While permit parking can offer a mechanism to prevent outside parking, parking restrictions do not solve parking supply issues but relocates the problem away from the area addressed. Perm it parking requires that residents display permits for their vehicles and their guests, or they can be cited as well. Permits will be required to be purchased by the residents from the Police Department.

Prior to establishing a new RPPA, staff is required to conduct a survey of the parking issue to determine if the conditions and purposes of residential parking have been met and present this information to the City Council for consideration. A survey was prepared and is attached to this staff report as Exhi bit A. The survey concludes that excessive parking continues near the entrance to the Parkside Village Community and is likely caused by residents of the adjacent apartment complexes and other adjacent residential users. The survey also concludes that permit parking is likely to resolve the issue within the Parkside Village Community, a required finding. At the November 15 City Council meeting a resident of the community spoke and recommended staff review the parking impacts over the weekend. Staff did cond uct a windshield survey on a Saturday and did observe significant on -street parking use on Doheny Drive and San Simeon Lane.

Historically, permit parking has been used to address school related parking issues which often stem from non -area parking congesti ng the neighborhoods around schools. In this case, the availability of convenient parking in and around the apartments on Yorba Avenue are not an out- of-area issue. This parking concerns occur every day by residents who belong in these neighborhoods. If es tablished, this would be the first time in Chino where permit parking was used to restrict parking within a neighborhood by others living in an adjacent neighborhood, which may establish a precedent opening the opportunity for other neighborhoods to effect ively "reserve" public on-street parking solely for their neighborhood.

While reviewing CMC 10.29, staff realized the fees and fines outlined in the code have been updated through other legislative actions. Further, the findings listed in the code leave br oad subjectivity where staff would like clearer direction on how and when residential permit parking can be used. Staff is therefore working on a code update that will be brought before the City Council in a separate staff report later.

Based on the study presented and in concurrence with the current CMC, staff finds evidence for the City Council to consider the establishment of permit parking within the Parkside Village Community; however, consideration should be given to potential unanticipated consequences of permit parking, as well as setting new precedent for the establishment of an RPPA. If approved by the City Council, a public hearing should be set for January 17 th, 2023 to consider the establishment of a new Residential Permit Parking Area within th e Parkside Village Community.

If approved, staff will notify the public through two published notices in the Chino Champion newspaper, posting of notices at the site, and at the City Councils direction, mailings to potentially impacted residents in the area.

At the Council Meeting, staff is asking Council to:

1. Vote to determine if a Public Hearing should be held on January 17, 2023, to establish an RPPA within the Parkside Village Community; and

2. Give direction to staff on mailing notices to all potenti ally impacted residents if a Public Hearing is set.

CALIFORNIA, ESTABLISHING A RESIDENTIAL PARKING PERMIT AREA ON THE 4700 BLOCK OF DOHENY DRIVE, SAN CLEMENTE LANE, THE 4700 BLOCK OF OCEANSIDE DRIVE, SAN SIMEON LANE, AND CARDIFF PLACE BY AMENDING SECTION 2 OF RESOLUTION 86-44

WHEREAS, the residents of the Parkside Village Community have requested that the 4700 block of Doheny Drive, San Clemente Lane, the 4700 block of Oceanside Drive, San Simeon Lane, and Cardiff Place become a residential permit parking area because of the negative impacts of excessive on-street parking from surrounding areas; and

WHEREAS, the current property owner s of the residential lots along the 4700 block of Doheny Drive, San Clemente Lane, the 4700 block of Oceanside Drive, San Simeon Lane, and Cardiff Place support a parking prohibition to discourage non-residents from parking in front of these residences; and

WHEREAS, a survey was prepared by the City Traffic Engineer that made findings relative to the request to establish the residential parking permit area; and

WHEREAS, on December 6, 2022, the City Council approved a survey prepared by the City Traffic Engineer that made findings re lative to the request from the Parkside Village Community, and set Tuesday, January 17, 2023, at 7:00 p.m., in the Council Chambers, as a time and place for a public hearing where people interested in, or objecting to, the proposed residential parking permit area may be heard; and

WHEREAS, Notice of Public Hearing has been published two (2) times in the Chino Champion, was also prominently posted near the only entrance into the area that proposed residential parking permit area, and mailed notices were sent to all residents and businesses impacted by this project at least ten (10) days prior to the date of the public hearing.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHINO AS FOLLOWS:

SECTION 1. City Council, consistent with the p urpose and intent of Section

10.29.010 and Sub-section (b) of Section 10.29.040 of the Chino Municipal Code, hereby makes the following findings:

a. The residents along the 4700 block of Doheny Drive, San Clemente Lane, the 4700 block of Oceanside Drive, San Simeon Lane, and Cardiff Place would be protected from unreasonable burdens in gaining access to their residences because if there were no parking restrictions, vehicles from outside the community would park close to, and sometimes block the resident’s driveways, and reduced access to the single entrance into the community. b. Parking of vehicles from outside the community impact the delivery of street sweeping services hindering maintenance of these streets in a clean and safe manner.

c. Safety would be promoted in this residential area because if there were no parking restrictions, the intensive vehicle parking by residents residing outside the community would result negative impacts to a health and welfare of the community by blocking fire lanes, fire hydrants and restricting movements in the event of accidents and other disasters.
d. The current owners of the residential lots along the 4700 block of Doheny Drive, San Clemente Lane, the 4700 block of Oceanside Drive, San Simeon Lane, and Cardiff Place support the establishment of the residential parking area.

SECTION 2. That Section 2 of Resolution No. 86 -44, which lists streets and restricted parking hours of all existing residential parking permit areas in the City of Chino is hereby amended to read as follows:

“Permit Parking Only – 5 p.m. to 6 a.m.” along the 4700 block of Doheny Drive, San Clemente Lane, the 4700 block of Oceanside Drive, San Simeon Lane, and Cardiff Place.

BACKGROUND
In 2020, the Development Services Department initiated the 2021 -2029 Housing Element update. During preparation of the document, the City’s Housing Element consultant gave updates to the City Council on March 2, 2021, March 16, 2021, and June 15, 2021, that included a discussion on the preliminary Sites Analysis map that was reviewed by the Housing Element Update Steering Committee. The City Council approved the list of sites to go into the Housing Element Public Review Draft with minimal revisions. The consultant also hosted a community workshop on July 13, 2021, to get feedback from the community and answer questions. In addition, a public study session was held before the Planning Commission on July 19, 2021 to receive comments and get d irection. Per direction from the Planning Commission, the Housing Element was submitted to the State Housing and Community Development Department (HCD) on September 3, 2021 for a 60-day review period.

On November 2, 2021, HCD provided the City with a forma l comment letter containing required and suggested edits, which the Housing Element consultant and staff addressed. Following recommendation for adoption by the Planning Commission on December 6, 2021, the City Council took final action to adopt the 2021 -2029 Housing Element on January 4, 2022. The document was adopted locally by City Council on that date. After local adoption by the City Council, the 2021 -2029 Housing Element was re -submitted to HCD for a second State compliance review and final certification.

The City received a second letter containing further revisions from HCD on April 18, 2022 and worked with HCD to address the remaining comments. The revised document was made available for public review for seven days from September 20, 2022 to Sep tember 28, 2022 as is required by State law. The revised Housing Element was then subsequently resubmitted to HCD for the mandatory 60 -day review on September 27, 2022. Revisions to the document were primarily in the fair housing analysis, a reduction in the assumption of accessory dwelling units, and in several housing programs. The City received a third letter back from HCD on November 23, 2022 requiring a few more changes to the Housing Element Update document.

How the changes were addressed are further discussed below. None of the changes requested by HCD change the number or location of candidate housing sites from the previous draft seen by the City Council, however a higher assumption of units on each site was made. This does not change the permi tted density on the site as the City did not previously assume maximum buildout on each candidate housing site.

ISSUES/ANALYSIS
While the City Council previously reviewed and approved the 2021 -2029 Housing Element in January 2022, the additional revisions made by the City to address HCD’s comments required the document to go back to the Planning Commission and City Council again for review. A previous version of this document went to Planning Commission for review on October 17, 2022 and is now before City Council to take final action on the revised Housing Element document.

Staff is not expecting any more comments from HCD during their current fourth review of the document that is expected to be completed by January 2023. However, if there are any remaining comments, they will be minor in nature and can be addressed without having to go back the Planning Commission or City Council.

HCD comments addressed with the most recent round of revisions to the Housing Element include:
· Assessment of Fair Housing including analyzing disparities in access to opportunity and

local knowledge and data on past zoning actions and City investment within the community.
· Analysis of access to educational opportunities.
· Clear goals, priorities, metrics, and milestones to add ress identified contributing factors to fair housing issues.
· Analysis of nonvacant sites resulting in further information on market trends and a quadrant analysis of the sites identified. No change in candidate housing sites was made as a result of this analysis.
· Analysis of existing multi -family residential housing developments completed or approved within the City to compare the City’s past performance to the anticipated development potential within the Housing Element.
· Analysis of proposed small and large sites identified within the Housing Element. · Reduction in assumption of Accessory Dwelling Units developed throughout the planning period.
· Zoning for a variety of housing types consistent with the requirements of State law. · Evaluate processing and permit procedures, including typical timeframes for review and approval.
· Successful approval of the Measure Y vote.
· Request by HCD to evaluate Measure M as a potential constraint to the development of future housing.
· Additional outreach, including a required seven-day review period prior to resubmittal of the Housing Element to HCD.

The completion of the 2021-2029 Housing Element ensures responsible long-range planning through policies, strategies, and actions that facilitate the construction of new housing and the preservation of existing housing to meet the needs of the City throughout the Housing Element planning period for all economic segments, as required by State law.

A link to the updated 2021-2029 Housing Element document is identified below for reference.

ENVIRONMENTAL REVIEW
Based on previous approval by the City Council on January 4, 2022, no further action is needed for the Negative Declaration (State Clearinghouse No. 2021100569) associated with the Housing Element update.

PUBLIC NOTICE
A 10-day notice was published in the Chino Champion on January 7, 2023 and the City posted information on the project on social media outlets. In response to the public notice, no comments have been received. The notices meet legal noticing requirements.

RESOLUTION NO. 2023-003

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO,

CALIFORNIA, RECOMMENDING THE CITY COUNCIL A MEND THE
ADOPTION OF THE CITY OF CHINO 2021-2029 HOUSING ELEMENT

WHEREAS, the City has received a mandate from the S tate of Califo rnia and the California Department of Housing and Community Development (HCD) to update the Housing Element of t he General Plan, in order to set f orth the C ity’s strategy t o preserve and enhance the community’s residential character , expand housing opportunities for all economic sectors , and provide guidance and direction for local government officials in all matters related to housing; and

WHEREAS, the City adopted the 2021-2029 Housing Element on January 4, 2022.

WHEREAS, the City is proposing to amend the adopted 2021-2029 Housing Element to address revisions requested by the California Department of H ousing and C ommunity Development (HCD); and

WHEREAS, on October 17, 2022 , the Planning Commission held a duly noticed public hearing for the proposed 2021 -2029 Housing Elem ent changes and adopted Resolution No. PC2022-025, reaffirming its recommendation for the City Council to adopt the 2021 -2029 Housing Element; and

WHEREAS, based on a variety of factors including development trends, propert y owner interest, structure age, property valuation, and development capacity, the existing uses on the sites identified in the site inventory to accommodate the lower -income RHNA are likely to be discontinued during the planning period, and therefore do not constitute an impediment to additional residential development during the period covered by the Housing Element, based on the following factors:

1. The City of Chino has determined based on analysis within the Housing Element that it ha s identified sufficient capacity on vacant parc els to meet at least 50 percent of their very low and low -income RHNA need. T he remaining need is met through the identifi cation of non -vacant parcels with existing uses. The City of Chino has identified 44 nonvacant parcels as par t of the candidate sites analysis. These sites were identified based on the feasibility and potential for redevelopment and considering:
age, quality, and vacancy of the structure; property owner or developer interest; access to inf rastructure and communit y resources; presence of large surface parking lots; existing development standards; and neighboring uses and zoning.

2. Existing uses on the nonvacant sites are provided in Table B -6 of the Housing Element. The large majority of non vacant sites identified have existing uses on a portion of the site with the remainder containing either large surface parking or vacant land. The City has co mpleted a nonvacant si tes analysis based on the underlying existing use to analyze development trends and demonstrate availability and development potential. This i ncludes an a nalysis and timeline for availability of the identification of the California Institute for Men (CIM) parcel and the rezoning actions to create mixed-use and affordable housing overlays within the City.

RESOLUTION NO. 2023-003

Page 2 of 4 ends

3. Additionally, the City has determined based on analysi s of existing multi- family housing developments that the assumed 25 dwelling unit s per acre ( du/ac) is consistent with current and past development trends for this type of housing.

WHEREAS, all provisions of the California Government Code and Chino Municipal Code related to the 2021-2029 Housing Element have been complied with; and.

WHEREAS, the City Council has completed its study of the proposed 2021- 2029 Housing Element, as amended; and

WHEREAS, on January 17, 2023, the City Council held a duly -noticed public hearing on the proposed 2021- 2029 Housing Elem ent changes and considered all verbal testimony and written evidence presented as part of such public hearing and closed the public hearing.

NOW, THEREFORE , the City Council of the City of Chino, California, does hereby FIND, DETERMINE, and RESOLVE as follows:

A. The foregoing recitals are true and correct and incorporated herein.

B. Based on substantial evidence, both written and oral, from the public hearing, the City Council makes the following findings and takes the following actions on the 2021 -2029 Housing Element Update, as amended, and related Negative Declaration:

1. CEQA Findings. On January 4, 2022, the City Council adopted a Negative Declaration (State Clea ringhouse No. 2021100569) for the 2021- 2029 Housing Element update.

The proposed amendments to the 2021-2029 are sufficiently addressed in the Negative Declaration, and therefore no further environmental review is required.

2. Approval of 2021-2029 Housing Eleme nt. The City Council hereby approves the 2021- 2029 Housing Element, as amended.

3. Actions by the City Clerk. The City Clerk is hereby directed to attest as to the adoption of this Resolution as of the date set forth below and forthwith transmit a copy of this Resolution, by regular mail, to the Applicant at the address of record set forth in the Application.

BACKGROUND
The Fiscal Year 2022-23 Park Fund budget provides funding for the Walnut Park Improvements Project (G8223). The Communit y Services Department received a California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access for All Act 2018 Per Capita Grant in the amount of $232,854 through the State of California, Department of Parks and Recreation Office of Gra nts and Local Services. The grant funding is required to be used towards park recreational improvements or development.

During the Parks and Facilities Master Plan development, inspection services were conducted on all City parks to determine the exist ing condition of park amenities and replacement schedules. As a result, staff elected to utilize the grant funds for park improvements at Walnut Park. The existing playground apparatus and surfacing at Walnut Park is over twenty years old and is due for replacement. The scope of work will include the replacement of the existing playground with an all -inclusive playground apparatus, pour -in-play surfacing, shade sails, and lighting. Additional improvements will include accessibility improvements to the p arking lot, walkways, picnic tables, park benches, and a drinking fountain.

ISSUES/ANALYSIS
The City’s Purchasing Ordinance allows the City to take advantage of competitive bids awarded to contractors and vendors by other public agencies. Sourcewell iss ued a Notice Inviting Bids and conducted a nationwide competitive bid process to select a manufacturer/vendor to provide parks and recreation equipment, which includes Miracle playground equipment and shade sails to public agencies throughout the country. As a result of the Sourcewell bid process, Miracle Recreation Equipment Company, Inc. -PlayPower, Inc., was selected to provide playground equipment and shade sails by the Sourcewell bid program through February 17, 2025 (Contract No. 010521-LTS-3), giving the City the ability to purchase the playground equipment and shade sails. The City Attorney's Office has reviewed all documents relevant to the Sourcewell bid solicitation for parks and recreation equipment and found the documents to be in order.

The City contacted Miracle Recreation Equipment Company, Inc. -PlayPower, Inc., requesting design assistance for an all -inclusive playground apparatus and shade sails, including engineering and footing designs. In October 2022, the City received a proposal fro m Miracle Recreation Equipment Company, Inc. -PlayPower, Inc., in the amount of $192,631.64 for the purchase and delivery of the playground equipment and shade sails for Walnut Park. At this time, staff is recommending that City Council authorize a purchas e order in the amount of $192,631.64 to Miracle Recreation Equipment Company, Inc. -PlayPower, Inc., Dallas, TX for the purchase of playground equipment and shade sails for the Walnut Park Improvements project.

HOMELESS OUTREACH COORDINATOR POSITIONS
PAGE 2

BACKGROUND
The contract with SWAG began on February 4, 2019, to help the City bridge the gap in services for the homeless population in Chino, specifically those identified as chronic unsheltered homeless. Through continued outreach and case management efforts, SWAG staff were able to successfully assist many homeless individuals to connect with other service providers for mental health, rehabilitation, housing, and/or family reunification assistance. The contract with SWAG has terminated as of November 2022. The funds used to pay the contract will cover the new proposed positions to provide in -house services. This will ensure more consistency with staff and services provided to the targeted population.

ISSUES/ANALYSIS
To properly address the homeless issues in the City of Chino, the Community Services Department is proposing new two positions. These positions will work in coordination with the Chino Police Department’s Quality of Life team, as well as the current Case Managers to provide a more comprehensive team approach to the needs of the unhoused population.

Through continued outreach efforts and by incorporating case management practices, the Homeless Outreach Coordinator and Assistant Homeless Outreach Coordinator will ensure unsheltered individuals receive the necessary resources and referrals that will help them get the services they need and successfully find sustainable housing.

The proposed salary ranges were determined by comparing similar positions in the surrounding communities.

RECOMMENDATION
Resolution in support of state legislation to authorize the California Transportation Commission to relinquish State Route 83 (Euclid Avenue) within Chino city limits to the City of Chino.

FISCAL IMPACT
There is no direct fiscal impact. Potential expenditures associated with research, planning, environmental studies, design, construction, project management, and other costs related to the acquisition, improvement, and maintenance of the applicable portion of Euclid Avenue would be proposed in the City budget or brought to the City Council for consideration.

TRANSPORTATION COMMISSION RELINQUISHMENT OF EUCLID
PAGE 2

BACKGROUND
The California Department of Transportation possesses and controls all state highways. State law authorizes the California Transportation Commission (CTC) to relinquish a state route or portion thereof, to a local jurisdiction at the jurisdiction’s request.

SR-83 (Euclid Avenue) is a state highway that is owned, operated, and maintained by the California Department of Transportation. It begins at State Route 71 (SR -71) and traverses through the cities of Chi no and Ontario, terminating at Interstate 10. As a state route, the entirety of Euclid Avenue was under the jurisdiction of the State of California, but portions of Euclid Avenue have been or are in the process of being relinquished to local jurisdictions, including the City of Upland and, most recently, the City of Ontario.

ISSUES/ANALYSIS
Euclid Avenue connects residential neighborhoods in the Chino Valley and western San Bernardino County to major employment centers in Orange and Los Angeles Counties by providing access to SR -71, SR -60, and SR -91. It is also a major goods movement corridor providing vital access to warehouses and distribution centers located throughout the Inland Empire from the Ports of Los Angeles/Long Beach.

In addition to serving as an important regional route for goods movement and commuters, Euclid Avenue also connects Chino residents from various neighborhoods in the City to each other and City services, making its condition of critical importance to the City.

There are currently bottlenecks, inefficiencies, and many needed improvements along Euclid Avenue. While the City has projects and plans under development to make the necessary improvements and upgrades, CalTrans’ possession of SR -83 requires permits and authorizations that add complexity, costs, and time to proposed projects. The City wishes to undertake these projects in a more efficient and expeditious manner. Working with CalTrans to have the portions of SR -83 in Chino relinquished to Chino would allow the City to proceed with these important projects.

One such project would improve the segment of Euclid Avenue from SR-71 to Pine Avenue that traverses through riparian habitat known to support special status species. The roadway is subject to frequent flooding during winte r months when heavy precipitation occurs in the area.

The flooding results in the closing of the highway for several days, forcing motorists to take long, circuitous alternate routes that might not have the capacity to handle the additional traffic.

Proposed improvements and projects include raising the profile of Euclid Ave by 12 feet at Chino Creek, which will allow it to serve motorists year-round without having to be closed due to minor storm events and eliminate the recurring maintenance costs of clea n-up and debris removal after flooding and will resolve road closure inconveniences for motorists.

Staff approached Assembly Member Freddie Rodriguez, who represents the City of Chino and

authored similar relinquishment legislation for the City of Ontario and requested his sponsorship of legislation to authorize the relinquishment to Chino, which is the first step in the process. The chart in Attachment 1 shows the process for the relinquishment of a state highway to a local jurisdiction.

Staff submitted draft language to Assembly Member Rodriguez’s office and a bill was drafted by the State’s Legislative Counsel (Attachment 2). To ensure that the City is in support of the proposed legislation before it is introduced by Assembly Member Rodriguez, the measu re is brought to the City Council for consideration.

Staff recommends that the City Council adopt Resolution 2023 -006 (Attachment 3) and authorize the City Manager to proceed to negotiate and enter into a cooperative agreement with CalTrans on the terms, including any payments, for the City’s acceptance of title to the specified portion of SR-83.
