PAGE 2
BACKGROUND
In 1978, the Chino Basin Judgment adjudicated the Chino Groundwater Basin, providing water retailers, including the City of Chino, with annual groun dwater production rights. The Judgment also provides for water retailers who may not fully utilize their production rights to accumulate under-utilized groundwater production rights in the form of stored groundwater reserves.
Additionally, the Judgment allows water retailers to transact arrangements for the purchase and sale of groundwater production rights, subject to the approval of the Chino Basin Watermaster (the administrative branch of the court with continuing jurisdiction over the Chino Groundwater Basin).
Over the past 20 years , the City has sold approximately 73,000 acre -feet from its stored reserves while continuing to build up and maintain a stored water reserves balance sufficient to satisfy its anticipated needs.
In 2022, out of concern that th e availability of imported surface water would likely be reduced due to prevailing drought conditions, the State required all water retailers to declare a Level 2 water supply shortage and implement water use restrictions. Even though imported surface water represents approximately up to only 1/3 of Chino’s total potable water supply, to comply with the State -imposed requirements, the Chino City Council declared a Level 2 water supply shortage by resolution, reinforcing the City’s long -standing practice of requiring responsible water use, permanently. Currently, the State-imposed requirement has been lifted, and the City has rescinded its water shortage declaration.
ISSUES/ANALYSIS
Currently, the City has accumulated stored groundwater reserves totaling app roximately 136,000 acre-feet. The City’s annual groundwater production right in FY 2021-22 was 17,497 acre-feet. After satisfaction of its groundwater production needs, the City’s unproduced amount of groundwater production entitlement (11,307 acre-feet) was accounted for as stored water and added to its reserves.
The City’s plans to utilize its stored groundwater reserves include the production of water to meet its own demands, the satisfaction of the City’s share of regional replenishment requirements, and the potential sale of water to other Chino Basin water retailers.
This year, three water retailers, the Fontana Water Company, the Cucamonga Valley Water District, and the Niagara Bottling Company, separately expressed interest in purchasing some of the City’s stored water reserves. Staff evaluated the City’s projected needs for stored water reserves, considering groundwater production and the anticipated accumulation of under - utilized annual production entitlement, and determined sales totaling a volume of 21,500 acre- feet at this time would not adversely impact the City’s ability to satisfy its own projected groundwater production needs. Additionally, the City’s proposed transactions have been approved by the Chino Basin Watermaster.

BACKGROUND
The Storm Drain Improvement Project SD223 - Mountain Ave at Chino Avenue is identified in the City of Chino Master Plan of Drainage (MPD) as System 75. The Fiscal Year 2021 -2022 Capital Improvement Program-Budget for the City Master Plan of Drainage Projects includes the construction of the Chino Avenue Storm Drain from Mountain Avenue to Bunker Hill Place for project SD223, previously known as project SD152.
The project consists of ins talling 125 linear feet of reinforced concrete pipe (RCP). The project alignment is located from Mountain Ave to Bunker Hill Place. Construction will entail the installation of 36”, 24”, and 18” (RCP), trench repair, slurry seal, PCC curb ramps, PCC sidewalk, and striping.
ISSUES/ANALYSIS
A discrepancy between the project bid sheet quantities and plan quantities, (10) additional water crossings are required to be completed to accommodate the proposed improvements. The additional water crossing conflict work is beyond the original bid amount. Contract change order No. 2 will reimburse the contractor for the required extra shoring needed to install the additional water crossings as well as balance quantities to compensate the contractor for installation of these additional water crossings. In addition, due to underground utility interference on Joshua Place, the manhole serving the new storm drain lateral will need to be moved approximately 12’ to the west resulting in additional quantities for 30’’ reinforced concrete pipe (RCP).
Due to significant underground utility congestion on Chino Avenue between Mountain Avenue and Bunker Hill Street, the project will need to be split into 2 phases. The contractor has completed approximately 90% of the project undergr ound work and will demobilize shortly due to utility conflicts. The contractor will return to complete the remaining underground work and surface improvements after interfering utilities have been relocated by the appropriate parties.
Staff recommends a c onstruction contract Change Order #2 in the amount of $277,160 for a new contract amount of $1,402,850, plus contingency of $119,669 for an amount not -to-exceed $1,522,519.

COUNCIL MEETING DATE: MAY 2, 2023
SUBJECT: CONTRACT AMENDMENT - ALL AMERICAN ASPHALT FOR SLURRY SEAL
MAINTENANCE WORK
PAGE 2
BACKGROUND
On May 19, 2020, the City awarded a contract to All American Asphalt, Corona, CA, for slurry seal maintenance work at various locations throughout the City. City Council approved a contract term of three years beginning July 1, 20 20, with the option to extend for two (2) additional one-year periods.
Slurry seal is the application of a mixture of water, asphalt emulsion, aggregate (very small crush rock), and additives to an existing asphalt pavement surface. This combined mixture of the emulsion and aggregates represents “slurry.” Polymer is commonly added to the asphalt emulsion to provide better mixture properties. The placement of this mixture is on existing pavement and is intended to “seal” the pavement surface. Slurry seal is applied to help preserve and protect the underlying pavement structure and provide a new driving surface. The roads chosen for slurry seal applications generally have low to moderate distress and narrow crack width. Slurry seal applications serve to seal the cracks, restore lost flexibility to the pavement surface, provide a deep rich black pavement surface color, and help extend the pavement life until resurfacing becomes necessary.
As part of the City’s ongoing street maintenance program, the Public Wor ks Department began slurry seal maintenance work and localized patch and pothole repairs on Pipeline Avenue, Chino Avenue, and Schaefer Avenue in FY 2021-2022. In anticipation of placing the slurry seal, substantially localized asphalt patch and pothole re pairs on Ramona Avenue have been completed, but additional patching is needed. Additionally, staff has already prepared various residential neighborhoods. Staff anticipates placing slurry on Ramona Avenue, and depending on available funding, will be placing slurry on as many of the residential streets that are already prepared in the current fiscal year.
ISSUES/ANALYSIS
In Fiscal Year 2021 -2022, the Public Works Department had a late start on the street maintenance program due to cold weather conditions an d material shortages. The late start in the beginning of 2022 caused Chino Avenue and Schaefer Avenue to be pushed into Fiscal Year 2022 -2023. Due to these delays as well as cost of material increases, the Fiscal Year 2022-2023 project budget has been impa cted to cover the costs of completing Chino Avenue and Schaefer Avenue. To accommodate the delays and cost increases, staff recommends approving the amendment with All American Asphalt in the amount of $1,200,000 for a total contract amount not-to-exceed $5,676,262.
Original Contract Amount $1,156,262.00
Contract Amendment No. 1 FY21-22 $1,820,000.00
Contract Amendment No. 2 FY22-23 $1,500,000.00
