Counties with a non- compliant Housing Element to include 11 of 25 in San Bernardino County, 8 of 29 in Riverside County, 30 of 89 in Los Angeles County, and 15 of 35 in Orange County.
City Council members inquired about the required amendments and expressed concern regarding the risk of losing retail opportunities in the City. City Council members understood the urgency to be in compliance and approve the Housing Element, however, want to ensure language exists that clarifies retaining viable commercial sites.
Fred Galante, City Attorney, noted the extensive process with HCD to approve the proposed plan, and noted if the City does not have a certified Housing Element, developers have other tools available to force development. Mr. Galante also clarified if City owns the land, they get to choose what is developed on that land and have options to change the zoning, however, the City would need to replace that lost zoning identified in the Housing Element. In addition, the City cannot eliminate the housing zone area without creating a replacement.
Mayor Pro Jem Comstock expressed concerns regarding the term " by right" and its meaning to bypass zoning ordinances and the overlay function and encouraged the City Council proceed with a workshop before making a decision.
The City Council expressed that during this process they understood the mixed- use overlays as allowing a mix of both residential and commercial and are now concerned the overlay sites selected can be developed as 100% residential. The City Council expressed concern about the makeup of the neighborhoods and what is right for the Chino Community.
Mayor Ulloa inquired about adopting the Housing Element and then going back and identifying additional locations be included for overlay sites.
Mr. Barquist explained if the City had a certified Housing Element, and then made zoning changes to City owned property, the City will need to go through the process with the HCD to stay in compliance status. Mr. Galante concurred with Mr. Barquist and noted if the City approved the Housing Element and sought an amendment for zoning changes, there may be a potential Measure M vote for changes increasing density.
Mr. Galante discussed recent years housing bills that have allowed certain rights to Developers and explained benefits to having a certified Housing Element in place.
Kevin Cisneroz, Chino Planning Commissioner, provided a public comment in favor of continuing this item for further discussion in a workshop. He encouraged the City Council to discuss the item further, noting concern with approving the Housing Element as proposed.
City Attorney Galante provided guidance to continue the Public Hearing to a certain date will not require the Public Hearing to be re- noticed.
Mayor Ulloa inquired when is the soonest a workshop can be held, and City Manager Reich explained the previously scheduled February 13, 2024 Workshop is an option to discuss the item.
