RESOLUTION NO. 2024-005
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHINO, CALIFORNIA, ADOPTING THE ADA TITLE II SELF-EVALUATION AND TRANSITION PLAN WHEREAS, Title II of the Americans with Disabilities Act of 1990 prohibits discrimination on the basis of disability and requires state and local governments to ensure access to government programs, services, activities and employment; and WHEREAS, the Americans with Disabilities Act requires public entities to conduct a self-evaluation of all programs, services and facilities; and WHEREAS, the Americans with Disabilities Act requires jurisdictions with more than 50 employees to establish a transition plan addressing structural or programmatic barriers, the method to make the facilities accessible, and the schedule for achieving compliance; and WHEREAS, the City of Chino developed an initial transition plan in 1994 and conducted a subsequent evaluation of public buildings and parks in 2017, to update the outdated plan and be in full compliance with statutory requirements, the City completed a citywide evaluation of parks and buildings, public right-of-way facilities, and City programs, policies, and procedures with consultant Bureau Veritas Technical Assessments, LLC; and WHEREAS, the City of Chino ADA Title II Self-Evaluation and Transition Plan is a living document to be reviewed and updated to maintain compliance with all federal and state laws; and WHEREAS, identified barriers in facilities and programs will be removed systematically citywide based on priorities and scheduled phasing determined by public outreach, City programs and citizen request; and WHEREAS, the City is dedicated to assuring all its programs, services, and facilities are usable by every resident and visitor, including those who have disabilities.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHINO, CALIFORNIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the City of Chino ADA Title II Self-Evaluation and Transition Plan, attached hereto and labeled as Exhibit A, is hereby adopted.
Section 2. That the City Clerk shall certify to the passage and adoption of this resolution and thereupon and thereafter the same shall take effect and be in full force.
